For you see, here at 2:32am, commenter "tralfmadore rocks" brings us verifiable evidence of the conspiracy originating from the AG's office on election night, and well, just read for yourself:

The document pasted into the email is headed, "PLAN FOR REPLACING CERTAIN UNITED STATES ATTORNEYS"
"Step 1 U.S. Attorney calls: On or about November 8-10, Mike Battle contacts the following U.S. Attorneys:" Listed are Charlton, Lam, [two blanked out], Chiara, Bogden, [blanked out], McKay, Iglesias.
Game plan for what Battle tells them
"Step 2 Senator calls: On or about November 8-10 (very important that Senator calls and U.S. Attorney calls happen simultaneously), Bill Kelley or appropriate Associate Counsel contacts the following Senators:" Listed are Kl re Charlton, [three blacked out], Ensign re Bogden, [one blacked out], Domenici re Iglesias.
NOTE that that's NINE bullet points for USAs to be forced out, but SEVEN bullet points for Senator calls. Maybe some of the blacked-out ones were to be consulted re two pushed out USAs; or maybe some USAs from states with two Democratic senators were to be forced out, so their input wouldn't be sought.

It’s the law. Preservation of records. But it does bring the amusing instance of Oliver North superspy thinking he was deleting messages when in fact he simply flagging them as deleted.
One of the still brewing stories on this one is that Rove apparently used an RNC or other email address for the dirtiest of his work on this. This would also be illegal. There’s a Presidential Papers Preservation law.

I’m pretty sure they have to preserve the emails for legal reasons. Some might also want to have them to cover their asses. Of course, officials like Gonzo who don’t have email – sure, some execs never learned it, but some avoid it intentionally in order to keep the written evidence at a minimum.
A lot of corporations have rules about what email you must retain and what email you must discard after a certain amount of time. I’m sure the government has a LOT of rules about what must be retained. Plus, I’m sure that techs could recover a lot of discarded emails if asked to do so.
I believe they are saved automatically. The question is, why would they write such things knowing they could be made public at any time. That would be Hubris. I can’t remember whether it was my mother or my English teacher who said, “never put on paper anything you would not want to see on the front page of the NYT.” Of course that was back in the day when they were known for their decent work.

Do bear in mind that we’re talking about the guy — Specter — who made the purges possible by altering the Patriot Act in December 2005 to allow the AG to hire/fire at will without Senate confirmation.
Sounds like Leahy needs to haul SJC co-chair Specter before the committee Specter used to chair.

This is yet another thing they’re screwing up. Because some of the redactions are being unredacted through independent reporting, it’s quite clear that redactions are not always for any reason that can be justified, but are being removed because they are embarrassing. This extends the news cycle some more as reporters try to piece together what’s been deleted.
Since one of the first deredaction was Fitz’s average rating, we know there has to be more stuff to be found. This will create pressure to redact less. They really are butchering their handling of this story–and it really does seem like the decider wants to keep his Gonzo.
Anyone that has ever accidentally wipe their hard drive knows just how much a good tech can recover. I also know, from buying used computers, that the gov’t has a special protocal before selling, to “super erase” (which has something to do with re-magnetizing) the hard drive.

Email is just too efficiency enhancing not to be used. And, anyway, they were planning on not getting caught. Somebody’s epu’d comment a couple of threads ago said that they’d become complacent, since nobody had ever stopped them before, they just got into the habit of unconcern.
You know, keep in mind that they used a provsion of a law in a bill that was never knowingly voted on, and was apparently inserted by a staff member. I can’t imagine that, for instance, Feingold wouldn’t have said something about removing the confirmation process had he known about it.
Looks like it’s gonna be death by a thousand cuts rather than one giant scandal that brings these crooks and liars down.

AAAHHH–the email trap.
emails get saved routinely via backups. There are also legal reasons both at corps & in the govt for why they must be saved.
Now as to why people would say such things when they know they could become public . . . !!! I call it the email syndrome. Mostly it’s inherent in the medium. Haven’t you ever, while clicking send, regretted what you typed? Haven’t your pejorative emails ever been inadvertantly forwarded to the subject or your peeve? Even if you’re careful & paranoid, these things happen.
But with people in power it’s worse than that. When I was on Wall St., we had a compliance refresher meeting every year–things we could & couldn’t do. After the advent of email, we were told NEVER to put anything in email that we didn’t want to last forever & be open to public view. That was also to protect the company from being sued. Now what’s so hard about that? Yet, the only two securities analysts to get convicted after the internet bubble burst, got convicted on their own emails.

From the Judiciary Download Site if anyone wants to look at 7-1 the first 3 pages discusses filling empty US attorney seats and on page 3 it discusses the reasons why the statute on how to appoint US attorneys was amended…
- We are aware of no other federal agency where federal judges, members of a separate branch of government and not the head of the agency, appoint interim staff on behalf of the agency
- In early 2006, the statute that authorizes the appointment of interim United States Attorneys (28 U.S.C. 546) was amended by section 502 of Public Law 109-177 to eliminate the provision of a 120-day appointment and to allow the Attorney General to appoint interim United States Attorneys to serve until the nomination and confirmation of a United States Attorney under 28 U.S.C 541.
- The statute was amended for several reasons: 1) the previous provision was constitutionally-suspect; 2) some federal judges, recognizing the inherent problems, have refused to make court appointments, creating a situation where the Attorney General had to do multiple 120-day appointments (itself dubious under the statute, but something we had to do in some situations); 3) a small number of federal judges, disregarding the Constitutional issues, attempted to appoint individuals other than those proposed by the Department – in one case, someone who had never been a federal government official and hence had never been subject of the required national security clearance process, an unacceptable risk given the responsibilities and operations overseen by our U.S. Attorneys.
If you go to page six they begin to lay out the steps for replacing the 7 attorneys at the center of this brouhaha including who called who.
Unfortunately I’ve just now got to start working so I won’t be reading anymore of the 7-1 packet of info. It looks to be a good read though.

Question: Could they avoid “sending” the emails by writing up a draft, putting in the draft section of a proprietary email account, and then the “non-recipient” (who happns to have been given the same account name and password) could simply look into the “draft” box, read the message, and then delete it.
That way they could at least conceal the intended recipient of a message. But woukld that stuff show up in the computer files of a particular computer? Seems one would need to look at everey computer ever used by the individuals rather than their particular accounts.
This whole thing gives new meaning to the old saw: E-mails are a blessing; and a curse!

Right! Joe loses his Chairmanship and the Demds can appoint someone else. PLUS they get to replace Joe…whom they counted as a Democrat in the Committee balance.
If Joe does this the PUGS would have to drop one of their own Committee mermbers so that Joe could continue to even be on the Committees.
In my view this is a DOUBLE-PLUS GOOD for the Democrats. They lose an obstructivist Chairman who often blocks Democratic initiatives, and gain a Chair that will push the Democratic agenda whole-heartedly. They increase their committee voting power with an assured vote. AND the reduce the Republican strength in those Committees by one vote and eliminate someone who might vote solidly with the Conservative Republicans. On a few votes Lieb might actually feel compelled to support the Democrat position merely to hold onto his seat in 2012 (Gawd ~poor Connecticut! They’ve got this running sore for six more years) .

That’s way too complicated. There are simpler ways to circumvent, like a personal blackberry connected to a personal POP account. The trouble with any circumvention method is the rule of 38 Toensing pointed out. Once 38 people know something, everyone does. Karl has to coordinate well more than 38 people, so, as it has in fact turned out, his circumvention methods will end up being revealed. Bush and Gonzalez’ system is better. Don’t ever send an email. But, as we also see, that just means there are underlings who have to send them. So it hasn’t really helped Gonzalez. The only thing you can really do to avoid getting in is to not do bad things.

I see your point. If you need footsoldiers to do your dirty work you have to tell them. Even if they obediently follow your orders “without questions” the fingers still point to YOU.
So the only hing one can do is the old tried-and-true system…undertake the deed yourself and don’t talk about it. Of course that’s hard to do for bureaucratic-type stuff. Rove generally has set out some phoney “bait” that ends up being used to give good “reasons” for an action that appears legitimate.
I’m surprised they didn’t try to do this in these cases by having the Federal Attorneys investigate something that would result in them being accused of politicization…maybe false accusations of Democratic corruption that would backfire. Karl and Bush could then look magnanimous in eliminating them! Meanwhile saving the tails of Cunningham, Foggo, Lewis, and all the Abrahmoff cronies!

I’d like to believe that, but I’ve underestimated the Bush-Wehrmacht too many times. I’m thinking specifically of how they might be doctoring the emails to include “justification” for the firings. My guess is that Gonzales is not going anywhere. He knows too much and he would not take kindly to being cast adrift. And Rove and Co. aren’t testifying. Same old same old. Anyway, keep up the good fight.

I don’t know if it has been noted by anyone but Rahm Emanuel was on the ever clueless Charlie Rose last night. Rose introduced him as the first Congressman to raise the issue of the attorney firings as if he had discovered it himself. Despite the fact that Emanuel appeared less than informed about the firings scandal, he took the credit and managed to do so without ever mentioning Josh Marshall once. Go figure.

And on the rest of my lunch hour I will note that we have had fires at not one but two of our gasoline refineries here in Canada and gas here is over $1 per *liter* (around $3.5 US/gal). And we produce the stuff.
And if I am not mistaken, Canada is the largest supplier of natural gas to the US?

Rove’s gonna be in a lot of trouble over this unless the entire network he was talking to was using the same backchannel method. And, again, the problem that immediately arises is that you eventually have to leave the backchannel group.
That’s not always so bad. Putting a post up here requires a backchannel group, because post times have to be coordinated and so forth. But if someone in that backchannel group (and, in this case there is a large number who enter that backchannel group temporarily) exposes it, you’re at risk. The alternative to having this, which is the online equivalent of editors, is the more widely used Kos method. And as long as you can’t embarrassed about any potential revelations by a former member, no problem.
In Rove’s case, his “shop” (fascinating that they call it that. Not that far removed from “plumbers”) is either gonna be small, with a lot of contacts with legitimate addresses or large with all contacts with legitimate addresses from legitimate address. Both of these are fragile, for different reasons, if you cannot tolerate exposure.

At this point it would seem that the most interesting things are those things that aren’t there. All the more reason for subpoenas to circumvent what to this point is a smoke screen.

This was in support of her claim that everybody knew Plame was covert. I don’t recall the NOC list thing. Was this her argument that CIA needed to more active in protecting her identity? If so, you can’t get much dumber than that argument. You can’t actively protect somebody. All you can do is refrain from ever commenting on anyone’s covert status. And then work one of those stupid decoder ring systems like “Mr. Novak, I don’t think you should run this story.”

The Patriot Act amendment giving AG power to appoint USA’s was added in committee in mid December and was passed by the Senate on the same day that the request for investigation was sent to Lam. By the way, Duke Cunningham plead guilty in mid November, and was expected to start squealing. One month later, the Patriot Act amendment was added. Hmmmm.

Yeah, but the actual damage to consumers in state was limited by regulations under which Consumers Energy and other in-state providers operate. Unlike the other states in question, much of our electricity is generated in state by non-Enron affiliated entities.
By Enron exposure I meant that the public was at risk of financial damages because of power or contracts with Enron or its subsidiaries.

Good – I was worried she might be saying it again. I understand why she said it shortly after being elected and immediately after taking the gavel, but she shouldn’t be saying that anymore. They objected to having their careers ruined maliciously by Karl Rove, Kyle Sampson and their minions. The unmitigated gall to not just slink off into obscurity so the Bushies could have a stranglehold on the justice system in this country.
What continues to amaze me is that these thugs just weren’t satisfied with replacing them as the president has the right to do, as unusual as that might be in the middle of a term. No, they had to ruin these people’s lives by lying about the quality of their work. Isn’t that slander? Can these attorneys sue Rove et al for damages? IANAL so you guys will have to tell me whether the WH and it’s droogs are immune from such prosecutions.

THis looks like an article from the Milwaukee Journal Sentinel about voter fraud allegations, but the bottom line makes it seem as if the pdf of the article was in a file tree where “ROVE” was one of the layers?
There were a bunch of these arising from the 2004 elections regarding Democrats bribing people with cigarettes to vote or something like that. I live in Wisconsin but don’t remember if any of them were pursued. John Nichols had an op-ed over the weekend about how the Wisconsin US Attorney, who is pursuing the Democratic governor, now will be seen as pursuing partisan investigations no matter what his motivation is.

Josh and the team at TPM organized a great effort last night, but I think we can do an even better job in the future.
One of the great challenges with these document dumps (and I forsee many, many more to come) is that the documents are not searchable. Think how much more fun we could have if a searchable database of all 3000 pages. By carefully dividing up the work, a few hundred bloggers could retype all the entries in a matter of hours and upload them to a wiki.
What this would require is an online form where we can get either sign up or be given an assignment to type up several pages of released documents. Hell, I’m not a particularly fast typist, but I could enter a a couple of pages in an hour. We could have all of these documents available in a usable format in a very short period of time — then the fun could really begin…
Someone who is more web-savvy than I (about 99% of the population) could probably create a template for volunteers to use to enter the documents. We don’t need to worry about copying the formatting — just type in the documents verbatim — as long as the text refers back to the pdf, a researcher can readily access the original to verify the entry is accurate.
We probably should also come up with a standard system for tracking hand-written notes — those provided some of the more interesting tidbits in yesterday’s release.
So what do people think of this idea? I’m going to cross-post this to TPM to see if we can generate some discussion.
