		<description>&lt;p&gt;On who has legal authority to prosecute Bush:  &lt;/p&gt;
&lt;p&gt;A prosecutor can prosecute and a judge or jury can convict Bush, but I believe the Prez has similar protection from arrest as Congress members do.  The Consitution gives Congress members specific protection from arrest while conducting the People’s business, and they cannot be removed from office except by impeachment by Congress, even if they are convicted of something.  (–goes back to the days when kings misused the courts to punish and intimidate Parliament.)  I don’t think the Constitution says anything about a Prez’s immunity from arrest, but I presume that he/she cannot be arrested, no matter what they might be convicted of by a court.  The matter has to go to Congress, which decides what a “high crime and misdemeanor” is, and whether or not to remove the Prez from office.  After removal from office by impeachment, then I believe that a former Prez can be arrested and jailed, if convicted of a crime.&lt;/p&gt;
&lt;p&gt; In both Watergate and the witchhunt against Bill Clinton, it was Special Prosecutors under the AG’s auspices, technically under the Prez, but with special protection and powers.  The outrage Nixon caused by firing the Special Prosecutor is one of the main things that brought him down.  (The other was the bad language on his tapes, according to my husband–when “Middle America” heard their ikon using the F-word.)  (It’s one theory.)  In Clinton’s case, he probably should have fired the Special Prosecutor.  The nation would have cheered.  (Remember how his approval ratings went UP about the blowjob.)  Christ, Kenneth Starchamber really gave Special Prosecutors a bad name.&lt;/p&gt;
&lt;p&gt;So-o-o-o-o, I think, in theory anyway, that Fitzgerald CAN prosecute Bush, and of course Cheney, but it’s a dicey area of law, and he may figure it properly belongs to Congress.  And Congress has been so derelict in the matter–I mean,  how many “high and misdemeanors” do you NEED, for godssakes?–and Fitz is looking at Gonzales, that all around shithead, at tribes of federal prosecutors getting purged, and at his own writ of powers (a piece of paper–as rippable up as the Constitution), and he likely figures he’s done his part, under what must have been the most difficult and pressured circumstances faced by any prosecutor, ever, and now it’s time to see if our democracy is working at all.  &lt;/p&gt;

And there is also “Sealed vs. Sealed.”  (My guess:  it’s Gonzales–Fitz’s ace in the hole if Gonzales had tried to pressure or fire him.)
