
The jury worked very long and hard and deliberated to find a verdict of guilty on four of five counts
The prosecutors behind me logged in a lot of hours on this case, and with that I'll take questions.
What is now clear, we knew that Mr. Libby had told a story. What is now public is that the FBI had learned that Russert did not and could not have told Libby the information regarding Mrs. Wilson. As prosecutors, we could not walk away from the fact that Libby was lying to federal investigators and the grand jury. Seems to me that no responsible prosecutor could walk away from that — the facts justify themselves.
The role of the Vice President? Any lie under oath is serious. We cannot tolerate perjury. The truth is what drives our judicial system. If someone tells a lie under oath, it is every prosecutor's duty to pursue that case. It is obviously a serious matter when a high level official does that under a national security investigation — it should never be tolerated.
Is there still information about the Vice President that you do not know? No one is above the law, no one gets less protection under the law. And we do not talk about someone who is not in the legal system in the case at bar. All we'll say is that Mr. Libby by lying and obstructing justice harmed the process.
Cloud over Vice President and over WH? Does it remain? Fitzgerald says that what he argued in court stands. Says he was responding to the defense argument, says he responded fairly and honestly — and that cloud was caused by Libby lying to the investigators and the grand jury. It was aggravated by Mr. Libby telling falsehoods.
Is your investigation over now? Fitzgerald says that he does not expect to file any further charges. If information comes to light or if new information comes forward that warrants further investigation, we will do that. The case is now inactive. We are going back to our day jobs.
Now discussing the independent counsel statue — different from independent prosecutor.
Bound by the laws of grand jury secrecy — not opening up our file drawers to write newspaper articles or books. If you want people to come in and tell the truth — if you tell them that the is grand jury secrecy, then we have to keep our word. If we are required to retry the case, I will not be happy, obviously. We feel confident that the trial was a fair trial, and we think it was appropriate, and that the jury's verdict should stand. Not going to predict on what 3 judges not yet selected, will decide Downward departure? If they wish to pursue any options, they can contact us — and we aren't going to comment on that, just as we don't comment on any other case. Did you get worried when the verdict takes a while? Of course you do. All lawyers do. CIPA hearings predicated on that Libby would testify and that Cheney might testify — can you tell us what you thought in terms of its impact on jury selection and on the case? There was extensive questioning during jury selection, yes. Lawyers make decisions as the trial goes forward, if the witness shows up, you try the case with them — if they don't, you move up to the next witness.
If the Vice President were passing on a reported rumor, and not an official channel, thatwould be different in terms of decisionmaking for the prosecutor? We tried to ascertain how this was done. If Congress does something on this, we will do what is appropriate. Do you believe this investigation changes the relationship with reporters? What Libby was doing was not whistleblowing — the reporters were a witness to a potential crime. There is a difference. By placing the information in this case behind reporters, there was no other way to proceed in this case but to talk with the reporters in question. (CHS notes: They cannot be used as shields for guilt or innocence of conduct, in other words.) Trial evidence? The judge made a ruling that the case would not be tried based on Valerie Plame Wilson's status. her relationship with the CIA was classified — I have 100% confidence in this information. If reporters were eyewitnesses to a potential crime — we could not have gotten to the bottom of this without some discussion with those reporters.

IANAL, but it looks like the jury was very clever and worked with the judge to keep this thing air-tight and unappealable. They tossed out the count that would have been the most likely choice for an appeal and made sure that the guilty verdicts on the other four counts were drawn up tighter than a drum.
Your move, Mr. Cheney.

When asked would he cooperate with a congressional investigation, Fitzgerald mentioned “parallel investigation”. He also did not say his investigation was complete, he said it was “inactive”.

I was trying to imagine typing Fitzgerald’s responses as I watched him live. No way in hell I could have kept up with him. And to do this for weeks. Team FDL, you all are TRULY amazing.

Juror–only one who wants to talk right now–says management types on jury helped lay things out. They took time because there was so much material to go through. It was never a matter of the jurors’ “opinion”–the facts spoke for themselves. They felt sorry for Scooter and wondered “Where’s Rove?” and the others. But they knew they had to do their job, he said. Says Cooper charge didn’t quite meet reasonable doubt standard. This juror is now a full fledged Plameologist. Can’t stop describing the details of the case….Can understand why, esp. after all this time.
Weird, it sounds like Denis the Reporter Juror was actually used his journalistic experience on Cooper’s credibility: that if he’d got Libby as a second source, he’d note it and file on it.
He’s also talking about Well’s opening as a kind of bait-and-switch. But the description of the jury process shows just how Plameologist they were about it.

Listening to that juror – I am amazed at how close Marcy’s speculation was to the jury deliberations. Marcy you should hire yourself out as consultant to lawyers. Wow.
“This jury was so focused on facts” says the juror. That was exactly the thrust of Fitzgerald’s prosecution and all they had to do; Defense relied on a lot of emotion, obfuscation; sounds like nothing doing.

I think it is eminently fair to congragulate FireDogLake for its fine work in this matter.
“The Plot Against Wilson”
That was the phrase Judge Tatel used in one of the earlier cases. You have to remove the sand from the face of the umpire before you can figure out the nature of “the plot.”
I think the problem with prosecuting Armitage is that, while he admits he leaked, he claims that he didn’t know she was covert. The IIPA law requires many things to be true to get a conviction, including the fact that the leaker knew the person was covert.
Also, Armitage apparently cooperated fully with Fitz, as opposed to stonewalling as Libby did.
Fitz is somewhat of an expert in how to open Grand Jury records.
It’s called a Rule 6(g) motion.
In rugby you run with the ball as far as you can and then pass it to a team mate who has clear field in front of him.
If Congress wanted to run with this ball, there are perfectly legal ways to get them the GJ info.
So, John Conyers, you want to get a staffer crackin’ on thet 3(g) research?
Reporter Juror on tv: The way the Cooper charge to the FBI was written differed from the charge to the GJ charge. That’s why they they voted the way they did.
Fitz for Attorney General. What an appropriate person to clean up all the gonzales that got tracked everywhere! We may have to replace the entire carpet.
So if the investigation is now “inactive,” does that mean that Valerie and Joe Wilson can now proceed with their civil suit?
The White House can no longer decline to comment on the Plame affair on the basis that “there is an ongoing investigation.” The results of the investigation have been confirmed by the jury.
Of course, now, for the next three or four years as Libby pursues his appeals, the White House will say it is not going to comment while the case is being appealed. That will give Bush the excuse to leave office without ever responding substantively to questions such as why, after he said that leakers in the White House would be fired, Rove is still there and still has his security clearance. Or, “Mr. President, has the disclosure of Vice President Cheney’s extensive role in this scandal caused you to lose confidence in the Vice President?”
Unless…Bush plays the pardon card. Then Tony Snow’s job becomes a living hell.

* New trial motions filed April 13, decided before sentencing
* Sentencing at or shortly after report is due (late May)
* Appeals to D.C. Circuit are quick, and this one is airtight, esp with the 1 count NG verdict. Appeal will be decided by fall 07.
* Petition to Supremes acted on by spring 08.
Thus: middle of 08 primary season, appeals exhausted, Scooter to jail — unless W pardons him. So now the question for primary season has become unavoidable and can’t be sloughed off with a “let appeals run their course”: Rudy, what’s your position on pardon? (Unfortunately, Hillary can’t talk about that topic — Scooter got her husb to pardon Marc Rich.)
If it was 9-2 on Count 3, why did they acquit? Shouldn’t they have reported to the judge that they were hung on that count?
The juror just got asked another question about Libby being the fall guy but his apparently long answer got drowned out by the IDIOTIC MSNBC talking head. I hope we get a transcript of his response somewhere– could be a most interesting thing.

There is an interesting series of posts over at d-kos examining the fact that Richard Armitage outed both the A Q Khan network suggesting that this network had been heavily infiltrated by the CIA and Valerie Plame. And taken in context with the emergence of Team B intelligence culminating in the OSP there is a vast curtain that still hangs over the apparent techniques of war mongering pursued by this administration. It is regrettable that Fitzgerald has decided to stand down with respect to the issues. But this is perhaps his professionalism and humility.
I likewise am prone to question that the concession made at this trial regarding the executive powers to declassify parts of the NIE in an ad hoc fashion reflects an unfortunate practicality here and an unwillingness to press the constitutional issues around the NIE and especially Plame that lurk in the background of this investigation. Maybe such a challenge in the end would have been unrealistic.
I know Armitage does present the appearance of being “no partisan gunslinger,” and in fact in testifying before the Senate Foreign Relations Committee in the lead up to Iraq in characterizing the relationship of previous Republican administrations with Saddam Hussien Armitage stated “…clearly, our skrits are not clean in that regard.” And so the involvement of Armitage is problematic. Perhaps he should be called before the Senate Foreign Relations Committee yet again.

I turned on Limbaugh on my way to grab some lunch immediately after verdicts were read. He was bloviating about how the case will be overturned on appeal because the jury didn’t understand the charges. They convicted the poor guy because they didn’t know what they were doing. They found him guilty but without a grasp of what the charges truly were. blah-blah-blah-blah-blah-blah
When Fitzgerald was speaking on the courthouse steps, Fox was doing the usual shtick of showing quotes they picked out from the news conference as captions. They were doing this for about ten minutes when Fitzgerald made the statement that he did not anticipate filing any further charges. Well . . . . at THAT point, the quotes went from captions to a “FOX ALERT!” complete with space-age “SWOOSH!” sound effect.
LOVE to watch Fox when they are FORCED to cover news/events that reflect poorly on their masters.!

I was watching Fitz on the WaPo live feed. I’d rather be hit by a NFL linebacker than have Fitz on my case – he’s that solid.
If he doesn’t have a case on you, he’s not going to pretend that he does. If he has a case on you, he’s going after you with great thoroughness and intensity. Either way, he’s not going to talk about you out of school. He is a man of integrity and principle, and won’t be swayed from his principles.
If I had a son, I’d point to Fitz and tell that kid, “this is what it means to be a man.”

What a bitter disappointment! Even the juryman who spoke to the press (Dennis Collins) said the jury was sympathetic to the idea that Libby was the fall guy.
But I take solace in the fact that Fitz said the investigation was “inactive,” not closed!
It seems to me that what we have here is the old Alphonse and Gaston vaudeville act being re-enacted with Fitz and Congress. Congress says impeachment is off the table; Fitz says the investigation is inactive. Will someone please get off the dime?!???
Wells will appeal. So new things could still happen. Could Cheney or Libby be forced to testify and be cross-examined?

Okay… so the legal wrangling will go on and on. And the top criminals will skate (rove, cheney, bush). So let the justice system do what it is going to do.
But we need to start thinking outside the box on how ‘the people’ should respond to this.
1. Bush WH won’t comment on an ongoing investigation.
2. Problem: Bush went to the people and commented back in 2003. “I will get to the bottom of this.”
3. Irrespective of any legal proceedings, the President said he would personally investigate this and get to the bottom of it.
4. He didn’t. And apparently he does not have any qualms about reneging on his promise ‘to the people.’
So, what are we going to do about it? There is enough evidence for him to fire Rove and Cheney. Like US Attys, they serve ‘at the pleasure of the president.’ Well…. time for the president to find people more pleasurable, eh?
We need to be Harpies at the White House steps to pressure Bush into cleaning house. It doesn’t take a trial verdict against Rove and Cheney to force Bush to act for integrity’s sake. So why isn’t he?

The “clot” now allows Cheney to *plausibly* resign for health reasons. The Vice President is damaged goods-I don’t see how he stays in the administration now. Congress most certainly will now call for an investigation into Cheney’s role in the Plame leak (especially if 41,341 FDLers call their critters).
I would definitely like to see the VP tried and convicted, but getting him out of the WH is the first step. Cheney will drag the ticket down in ‘08. My guess is that the behind the scenes manuevering to dump him is well underway.
Libby might get pardoned but who cares? Shooter’s the real target.

Because once the appeals are over, if Fitz is “going back to his day job”…then that makes him susceptible to thye same firings that the 8 Federal Prosecutors have faced from this Administration. His status as the Prosecutor with Plenary powers offered him some degree of protection from retaliation…but given the vitriol from the wingnuts…and Tony Snow’s statement that Libby is a “Great American” there is a very real potential that they will fire Fitz as retaliation for his pursuit of the TRUTH!

It was really cruel, although understandable, that CNN cut away from Denis the juror. I hope PoliticsTV is on the scene.
FOX talking points seem to be that no crime was committed. Fitzpatrick was un supervised and would have been pulled in if only Ascroft had some balls and kept the investigation “in house.” That the White House can not comment on an on-going legal matter as Libby has asked for a new trial other than to say the president respects the jury’s decision and is sad for Scooter. They had Knovac on spouting his crap that VAlerie Plame was not covert. And, finally, that this is in no way has anything to do with the VP trying to cover-up bad information taking us to war in Iraq.

On who has legal authority to prosecute Bush:
A prosecutor can prosecute and a judge or jury can convict Bush, but I believe the Prez has similar protection from arrest as Congress members do. The Consitution gives Congress members specific protection from arrest while conducting the People’s business, and they cannot be removed from office except by impeachment by Congress, even if they are convicted of something. (–goes back to the days when kings misused the courts to punish and intimidate Parliament.) I don’t think the Constitution says anything about a Prez’s immunity from arrest, but I presume that he/she cannot be arrested, no matter what they might be convicted of by a court. The matter has to go to Congress, which decides what a “high crime and misdemeanor” is, and whether or not to remove the Prez from office. After removal from office by impeachment, then I believe that a former Prez can be arrested and jailed, if convicted of a crime.
In both Watergate and the witchhunt against Bill Clinton, it was Special Prosecutors under the AG’s auspices, technically under the Prez, but with special protection and powers. The outrage Nixon caused by firing the Special Prosecutor is one of the main things that brought him down. (The other was the bad language on his tapes, according to my husband–when “Middle America” heard their ikon using the F-word.) (It’s one theory.) In Clinton’s case, he probably should have fired the Special Prosecutor. The nation would have cheered. (Remember how his approval ratings went UP about the blowjob.) Christ, Kenneth Starchamber really gave Special Prosecutors a bad name.
So-o-o-o-o, I think, in theory anyway, that Fitzgerald CAN prosecute Bush, and of course Cheney, but it’s a dicey area of law, and he may figure it properly belongs to Congress. And Congress has been so derelict in the matter–I mean, how many “high and misdemeanors” do you NEED, for godssakes?–and Fitz is looking at Gonzales, that all around shithead, at tribes of federal prosecutors getting purged, and at his own writ of powers (a piece of paper–as rippable up as the Constitution), and he likely figures he’s done his part, under what must have been the most difficult and pressured circumstances faced by any prosecutor, ever, and now it’s time to see if our democracy is working at all.
He didn’t close the investigation. He put it on hold. And there is also “Sealed vs. Sealed.” (My guess: it’s Gonzales–Fitz’s ace in the hole if Gonzales had tried to pressure or fire him.) (When Gonzales was WH counsel, he gave the perps a heads up–time to shred docs and burn hard drives. Obstruction of justice.)
