
We went rushing to the courthouse with computer bags and scarves flying this morning, sans benefit of caffeine, certain that we were going to see major fireworks when court convened at 9:30 am. Instead we got bupkis, five minutes of harmony between defense counsel and the prosecution over the response to the jury. It was quite anti-climactic.
I walked out into the hall afterwards and saw Mrs. Libby standing there once again. This is the second time in two days she hasn't gone into the courtroom but was peering at the closed circuit screens in the overflow courtroom through the door windows from the hall. No idea why, but her nerves must be frayed by this time — and with good reason.
I stopped at the coffee cart on my way back to fetch coffee for Marcy (possibly the greatest service I do for our coverage all day) and myself, and decided I needed some fruit for breakfast, which left me carrying a large tower of food as I teetered down the hall. Ted Wells passed me, grinned and said "you know if you spill that all over yourself, somebody's gonna write about it." I offered him the opportunity to guest blog it. I'm sure I'll hear back on that momentarily.
The National Gallery has a nice exhibit of English landscape paintings and some Rembrandt drawings, two of my particular faves, so I will probably catch that at lunch. Yesterday I saw the Jasper Johns exhibit and liked it more than I thought I was going to, lots of interesting textures that don't show up well in reproductions, but the thing that stuck with me this morning were the Matisse cutout works in the upper gallery. Very moving, joyous and hopeful. Somehow quite right for the moment.

Not sure why you say that, but clearly, all involved realize that the live blogging of this has completely taken this trial into unknown territory.
Every attorney in high profile cases knows that managing the media is a big part of the job, but how do you manage this when you can’t control the message?
They have to be studying this, and it’s made their lives more difficult I’d imagine, but then again, there’s not a whole lot they could do about it.

I don’t think we should assume any person(s) on the jury that are taking their time to review all the details and be fully confident in returning their verdict is a “wingnut”, a plant, or being a pain in the a**. Perhaps the jury members are taking this very seriously, and they want to review the evidence fully before they feel 100% comfy with convicting the man to one or more felonies. This is a pretty high-pressure, high-profile trial, and I don’t blame them a bit for taking the time to make sure they’re returning a just verdict.
A friend was on a jury recently, and he reminded me that for every count, there are multiple things you must ensure are proven beyond a reasonable doubt before you can return a guilty verdict. It will take time, and I won’t be surprised if they want to hear some testimony given during trial read back before confirming whichever verdicts they’re going to deliver.

Actually, I say that because I did note Wells was reading his blackberry in the court room yesterday, and after I said, “waves at Ted,” Jeff made a point to clarify that I didn’t really mean “waves at Ted.” What with all the winking Jeffress and Bonamici were doing with me yesterday, you understand.
But if Wells says someone’s going to write about Jane’s coffee catastrophe, why not spread the totally unsubstantiated rumor?
Libhy’s wife did not ask for this…I do feel for her. Although I did watch her put on what I thought was an unnecessary display for the photographers outside the courthouse last week.
Many days ago during Fitz’s closing remarks Libby’s wife ran her hands through her hair 27 times (that I counted) during his remarks. She did not do this during Wells or Jeffress closing statements.
This has to be madness for her!
Someday I have to get to DC to visit the musea. I’ve been told that the doors of the Library of Congress are worth seeing, but you have to get there before they open in order to see them.

I don’t think that Walton’s answer to the third question can be appealed as my understanding was that the response he gave was already agreed to by both parties. In other words, he didn’t have to rule on the response, and thus it shouldn’t be subject to appeal.
Unless Scooter wants to claim “incompetent counsel”
By the way, take note of the CSPAN3 hearings regarding the prosecutor purge.
These hearings would never happen if the Republicans remained in the majority in the House and Senate.
A Republican-run Congress would never supoena these prosecutors and get to the bottom of this.
So, for all of your efforts in the November 2006 elections to get the Democrats back in power, I want all FDL readers to give themselves a hearty pat on the back.

Also, to your earlier comment: yes, lawyers have to know the trial coverage on the internets, with the help of The Google, changes a lot. I wouldn’t be incredibly surprised if people on both the defense and the prosecution teams had groups scouring the internets to look for additional supporting information from lawyers during the proceedings. They may have increased their lawyer pool by finding interesting tidbits or analysis by many legal eagles out here.
It’ll be fascinating to look back at all of this in a year or so, and to see how high-profile cases might be affected by “playing to the internet”, much like “playing to the cameras” in TV trials.

If this trial teaches any lawyers about managing the media, perhaps the first lesson might be “make your best case, in the best way you can.”
By and large, we’ve focused on the case – the exhibits, the GJ testimony, the timeline of events, the links between the various actors, etc. All the time spent spinning to the press isn’t going to do anything but rack up billable hours.
If you can’t control the media, maybe you shouldn’t worry about it either. Just make your case, and the observers will notice.
Of course, if you *don’t* make your case, we’ll notice that too.

Pach- You “manage” the media, in this case, by paying attention to what’s being said. You know that someone on that team must be monitoring what we’re all writing about, noting our reactions to questions, what our own questions and confusions are. We’re the next best thing to listening in on the jury, if they factor in our bias. Plus, what we say is being put out on the TOOBZ, and that makes us meme creators, in a way. Just because the MSM has their collective heads too far up the white house backside to see it doesn’t mean that a lot of bright trial lawyers don’t get it!
Specter is going out of order because he wanted to read the e-mail that was sent that told the USA’s to STFU first before asking questions.

The ones my little kids like best are “My Neighbor Totoro” and “Kiki’s Delivery Service” though the latter is really for a slightly older demographic. And my eleven year old thinks “Spirited Away” is his favorite movie ever.
If it is Totoro, what I’ve really always liked about it is that there is no bad guy. It makes you appreciate the extent to which Disney movies are actually fairly cookie cutter — you can make chidlren’s movies without a menacing character. Indeed, sometimes one’s worst enemy is actually one’s own lack of will.
The hearings are making me shake with anger at this administration…

those matisse cut outs are artist stripped down to his essence. as most know, he did those at the end of his life when he could not paint anymore and (i think) his sight was failing.
underneath every work of art is a foundation of shape, balance, movement and color. (oh there’s there’s a couple more elements out there, but i think the above pertain to the matisse cut outs.) matisee shows us that, even as an old man,he was a master, totally in control of the important things in a way that can still inspire.
the cut outs are music for the eye.

Stepping back, I’m sure that even Team Libby appreciate, in a backhanded way, the fact that FDL is covering the case in a depth and form that ain’t Court TV. I hope there’s a degree of mutual respect, not just from the Prettyman nail-biting brigade. Attorneys take cases, that’s their job. A vigorous prosecution and a robust defence make for a justice system that works: that’s why its erosion is to be feared and challenged.
And like Fitz said in his closing, this case happened because the White House gang forgot that their political actions have consequences on people’s lives. And there’ll be further consequences one way or another after the jury returns.
I see this from the Gallery’s exhibition and have… thoughts.

I love that Matisse painting. It reminds me of my favorite Wynton Marsalis CD, The Majesty of the Blues; the CD cover boasts this Matisse painting on its cover. It’s my all-time favorite jazz album IMO–take a chance on it; it will blow you away.
If you’re doing lunch in the National Gallery, don’t miss Constable’s Wivenhoe Park, the greatest landscape painting ever. I went to Georgetown Law when it was still a couple of blocks north of the Courthouse. We used to go to the National most lunchtimes (it got to the point where we could tell when they moved anything in the collection). When I’m in Washington, I still make a point of going by to see it. It’s like instant art therapy.

I always have to default to the notion that the non-offending spouses have always been handsomely PAID FOR their involvement with greedy and corrupt power-mongers. Believe me, I would know if I were sleeping next to a corrupt, integrity-lacking for 15 years. And I am sure I would forego the economic benefits to get away from him.
She asked for this. Oh, wait, she didn’t ask for him to get caught. But she was no doubt happy as a clam in the boom years. I believe that. We are responsible for the world we help to create…. and that includes who we decide to marry and stay married to.
I feel for us, the American citizen, the most. And the Wilsons. And ALL the spouses of the CIA agents that were compromised. No pity.

Long story, short answer:
EPU – Evil Parallel Universe, a longtime commenter here. Often he would post a great well thought-out response that no one who reply to because a new thread had been posted and conversation was going on over there. It has come to be FDL shorthand for being left behind on a thread . . . as is soon to happen here, I think. Folks will sometimes repost the EPU’d comment in the new thread with the header “EPU’d” to note that it belongs with the earlier discussion.

These US Attorneys are law and order people and they adhere to a strict code of ethics in their jobs.
Bush decides to take their jobs unexpectedly and for reasons unexplained.
According to the usual practice, the US attorneys would have their jobs until Jan ‘09. Their terminations were not for cause. When they inquired why they were terminated they were told by the Dept of Justice that that information would not be helpful to them. As the story grew in public consiousness and as Abu Gonzalez was pressed for the reasons the suggestion of performance problems found it way into the story.
The US Attorneys were insulted and dissatisfied with the way they were treated. Terminated? Well ok, we serve at the pleasure of the President. To have our reputations trashed in the press to benefit the President politically. That’s it.
Because these terminations are unusual, because the practice of terminating US attorneys during their terms could have a chilling effect on their independence and because the replacements will be appointed without Senate approval due an obscure clause in the renewed Patriot Act the question of whether party politics takes a priority over law and order in the US
terminations.
The US Attorneys were largly ready to walk away until they get threatening phone calls from the Department of Justice discouraging them from cooperating with Congressional investigation.
Specter was rough on the witnesses.
Feingold is up now. His recap in about two minutes was devestating.
