People followed up on what he was interested in.

There's one small factor. He did talk to one person.
Why in Fall 2003, does he not tell VP, btw I did talk to reporters. Doesnt tell McC, btw, you should know that Rove spoke about the wife.
Does he tell VP, that he talked to Miller?
What's the one thing he told, he told the one person from whom he learned from in the first person. Why is that one fact so important.
Why does the one thing, of all the facts in the case, not that I heard it through Rove, all he tells VP that it was Russert. What they tell him, when he saw the note, he goes back and tells the VP, the VP cocked his head.
Why is the ONLY thing he told anyone is who he said was the source, to the guy who was his source.

I wonder if Wilson's married, I wonder if he has a wife. What examples do you have of how good his memory was. Zeidenberg has a phenomenal memory of someone else talking about Wilsons wife. Rove, he had a conversation with someone else's wife.
Defendant had a better memory of Roves conversation with Novak, than Rove did.
He remembers things. If I told you what conversation you had. If I asked what days of the week a series of articles ran. IN March 2004. When asked about Pincus articles, he says there were articles from the fourth week of May last year. THat's why we showed Pincus some articles. Libby could remember those articles. Could remember the week in March 2003. Which shows you hos focus on the press. Remember his discussion of leak to WSJ. They seem to have good relationship with WSJ. Libby talks about how to get oit, give it to Wolfie, and lo and behold it's on the editorial page. He says, VP and I talked abut it on Tuesday, and it appeared on Thursday. He can tell you the day o fthe week.
What are people suppsoed to say. Investigators already know that Russert said that never happened. He wasn't charged with leaking to Kessler. Of course he was questioned closely. When someone is questioned closely in GJ, it's like being in a house of mirrors. What
Matt Cooper, he was sitting there with two other witnesses. Libby wasn't going to tell all these other reporters.
He was busy telling Pincus a lie, That an aid caused the trip.
Best way to get the story, is to leak an exclusive. Showing that other people didn't get it doesn't help.
The three things they don't want you to focus on. Unique, importance,anger.
We all remember unique. That's why a lot of the witnesses remembered stuff frm their conversation with Libby.
Libby said this was the FIRST TIME he had ever declassified something by virtue of talking to VP. It had never happened before, hadn't happened since.
Importance Remember the others things going on. He had ten conversation with nine people. He's asking Schmall about . He's monitoring Hardball. He's not watching other things. He's remembering Rove telling him. Why is that important? It goes into his brain, bc that's important. VP cuts out column, he makes note on Dowd column. One thing that's really important, Schmall told him, this is a big deal, every intell service, whether innocent or not, they could arrest, torture, kill them. If you're sitting ont eh beach as a 21 year old, and you say, what you did, that can get people killed. If someone brought to your attention, you could get some people killed, that better be important, certainly NSA to VP in time of war.

Just so we're perfectly clear, I'm talking about Libby's state of mind. They're saying he's like a 21 year kid not remembering anything after the summer. Schmall did not know about Plame. He's saying that if this happens, you can get people killed. For his state of mind, When you're reading about a front company being exposed. Isn't that important. They want to tell you the wife wasn't important until later. They're saying it was important enough to read on July 14. IMportant when someone tells you, harm can happen. ANd unimportant when facts prove defendant told a lie.

Schmall, with all the terroist threats in teh world, Libby was bringing up Wilson and Valerie Wilson.

We all know, when you're angry at someone, you remember. Whether you're a chief of staff, whatever you do for a living, He was angry about Wilson. What Wilson said is that country got lied into war. One of the people he blamed was defendant. ANd VP. Don't for a second believe, that the defendant wouldn't get pissed if someone said you lied the country into a war.
If you think it's important, when you're focused on it, when you're angry about it. You know the things you forget and the things you remember. You know how to tell the difference. It's actual common sense.

Remember to talk, two things have to happen. you have to be asked, you have to talk.
5:09 Think about the mindframe of trying to subpoena. Sitting in a room, as someone who sits behind VP in meetings. When it has already been proclaimed that no one will investigate. The mindset is to make sure Agent Bond is satisfied. He made his bet, planted his feet, and stuck. From then on he told the same story. YOu have to assume that the reporters will not want to talk. If the FBI agent doesnt' catch Rusert at home. Russert feels compelled to knock down false allegation. Don't be confused by looking backwards at history.
You would be very very rational to think you'd get fired if you did something like taht.
Armitage and Rove. Don't be distracted by things you don't know. You have no evidence to indicated that they walked into GJ that they learned it anew, they were sitting around wondering if Wilson had a wife. DOn't be distracted by peple who aren't mentioned.
Is this about a bunch of madmen, two men. Or is about somemthing bigger, Is it about someone to whom Wilson's wife wasn't a person, but an argument. He focused on it June 23, July 8, July 7, focused on it when he talked to Addington. His boss thought it was important. His boss thought it was important. Did his boss forget about the wife/ One of the first thing he wrote, did his wife send him on a junket. They both talked to a briefer about it. You can't believe that 9 witnesses remember 10 conversations the same way. There is no conspiracy. There is no memory problem. He remembers a conversatoin that did not happen. But forgets all of his. He had a motive to lie, and he lied in a way that exactly matches his motive. You don't forget something on Thursday that you've passed along on Monday and Tueday. You don't forget about important arguments. You know they talked about a cloud over the VP.,

Walton: Sometimes during course of argument. Lawyers say things they don't mean to say. I want to say a couple of things to make sure. Reference to AG guidelines, those were admitted for a limited purpose, so you could assess whether Fitz' interaction was consistent with those guidelines. Argument that Libby would have been aware of those guidelines. There is no evidence before you [shit--Fitz could have used the fact taht Libby refused to sign waiver!]
Walton THe truth of whether someone could be harmed based on disclosure of covert identity should not be dismiseed. What is relevant here is what, if any impact, things had on his state of mind.

The funny sidebar, I suspect, was because Wells et al. thought that Fitzgerald was making this about the war and about the exposure. Jefress looked really angry! I’m suspecting this because Fitz afterwards reiterated his points, but carefully made sure to mention that he wasn’t accusing Libby of the *actual* crime, just the metametacrime that he’s currently being tried for.

I keep thinking about the description of closing arguments that Sayers had in (IIRC) Busman’s Honeymoon: taking the rope of evidence apart and showing the strength of each strand to the jury, then handing it to them.

you are exactly right. revealing a covert operatives secret identity can and has led to the agents death. why cant the remaining few bush/cheney supporters see this? aldrich ames murdered many covert agents by revealing their identities to the russians. most of these executions happened after the fall of the berlin wall. cheney is guilty of treason. high treason. hopefully, a libby conviction will result in cheneys prosecution and more.

I absolutely love the contrast Fitz evoked at the end! Wells had asked the jurors (most of whom are women) to be soft forgiving nurturers. Fitz made it clear that he considers them to be intelligent, clear-eyed patriots. Put together with Fitz’ clear recognition that Wells was dissing Valerie (and all women) with “the wife” I’d have to say that Fitz very clearly won the gender war subcontext.

Contrast the Solomonic righteous anger of Fitzgerald with the crocodile tears at the end of Wells’ charade.
Just like Scout and all the black spectators stood silently and respectfully in the balcony as Atticus Finch packed up his papers and left the courtroom, all of the FDL commenters and lurkers now stand silently and respectfully at their computers as Fitz, Zeidenberg, EW, Jane, Christy, Pach, and the others pack up their things and walk out of the Prettyman Courthouse.

So, even if Libby doesn’t flip, a conviction in this perjury and obstruction case means that there is one less critical witness Cheney can call upon in his defense.
Oooooh. I really like it. This means that Fitz’ larger case against Cheney (if any) is advanced with a conviction, even if Libby doesn’t cooperate.
I find this very compelling reasoning – I wish I had thought of it.
If this speculation is correct, a conviction in this case would kick out one of the legs supporting Cheney’s defense in the event that charges are later brought against him.
I see “a cloud over the VP” and hear, “There’s a cancer on the Presidency.”

I had been having a lot of difficulty figuring out how Fitzgerald could advance any investigation of Cheney without relying on Libby flipping. I think this answers the question. Indeed, it may be that Fitzgerald has key testimony from Rove, Hadley, Martin, et. al. regarding Cheney, and Fitzgerald has advanced this perjury and obstruction case in order to wipe out the primary person who can confirm Cheney’s testimony. The conviction itself, then, is the final piece in the puzzle for Fitzgerald to move forward with additional charges. No cooperation from Libby is necessary.
If the above is true, and Fitzgerald may be able to move forward without Libby’s cooperation (assuming a conviction in this case), Libby’s efficacy as a firewall seems diminished.

First, thanks to Marcie, Jane, and everyone else who helped put this together, including all the great commenters. I’ve had lots of fun spending way too much time here the past couple of years. I’ve been (mostly) lurking since before Redd/Christie got “promoted”.
I would think that Scooter could start to cooperate even after he’s found guilty. Even late cooperation could help mitigate his sentence.
Fitz works step by step. Cheney is clearly in his sights; Rove cooperated enough to duck his own indictment, and “Sealed vs. Sealed” is still out there, right?

Fitz needs a conviction to go after Poppa Cheney. He needs the facts, the momentum and a crime: his target is the de facto president. If he gets it, and after that close he should, Congress will support him and Bush/Gonzales daren’t interfere except to keep funding his investigation. If he doesn’t get a conviction, he has to worry about having his investigation shut down and the truth being buried. But he just made it bloody hard for the jury not to convict.
Fitz successfully lulled Wells and Jeffress – and me – into thinking he would not make this frontal an attack until after he won a conviction. As the SAS says, Who Dares, Wins! Thank you Marcy, Jane, Christy.
Cheney, of course, is travelling this week. Australia, Japan, etc.

I just read Jason Leopold’s June 16, 2006 article Sealed vs. Sealed — intriguing…
I then noticed that this was after his infamous May 12th, 2006 article claiming that Rove was going to be indicted.
Knowing what we know now about where this might lead, is it possible that the Rove indictment leak was a deliberate smokescreen by Team Bush to burn Leopold with this false info as a smokescreen towards the real target of Cheney being next up in Fitz’s crosshairs? Thoughts?

No way they get done in a day if they parse out 2 of the 5. One day for 5 out of 5, maybe (though I think almost certainly not). It will be several days no matter what.
Most juries do their job — even if they take an initial straw vote and come up 12-0 to convict, they frequently still take the time to go through each count and discuss it. It’s more complicated than “yes” or “no” (unlike most criminal cases).

I was very impressed with how Fitzgerald laid this case out, very crisp and straightforward. And devastating. He’s also a great storyteller (the Irish in him?). He brings us down to “the moment”–what the pressures on Libby were, what his choices were, what he knew, as he faced agent Bond (that, if he could just get his story past her, the threat of prosecution for what he had done would go away). He shows what the temptation was, and very clearly shows how Libby yielded to the temptation to lie.
And THAT took–to get to that moment took–GREAT ORGANIZATION, untangling the web of lies and cover stories he was presented with when he started this investigation.
His remark about pretending to be organized is the coup de grace. To catch these liars, he had to be very organized, indeed. And that subtle implication, that if only they had told the truth to start with, all this effort to track their intricate web of falsehood and misdirection would have ben unnecessary.

Reading Wells today, I’m tempted to think that Wells threw this game. He did so many things to alienate the jury–even insulted them, implying that some of them would convict Libby because of their political party affiliation. He also tried to intimidate them with Libby’s importance. It was almost a veiled threat. And throwing in that bit about “protecting” Libby. Jeez. Fitzgerald took that right apart. (Who was protecting Plame?) If I was on that jury, I would feel insulted, demeaned, and angry at both Libby and his attorneys–most of all for their contempt for the truth, and Fitzgerald’s final line about the truth upon which the justice system is based, and the answers that are owed to the American people was the perfect answer to “the sand” that has been thrown “in the umpire’s eyes.”
Will this image that Filtzgerald paints in the courtroom of a cloud hanging over the VP resonate like one of those Katrina-type storm systems I wonder? Or will this all just be some claps of thunder and flashes of light that just get blown off shore?
You should pick an appropriate place for one of your spots. Are you nearby the Watergate by chance? Is it cloudy outside the beutifull (W-speak) White House there inside the DC greenzone?

It’s been a while since I saw the movie, but I remember in the ending, the magistrate indicted the bad guys and the indictments were somehow undone by the corrupt government. It wasn’t in the movie but as I also remember, in the real-life incident that the movie was based on, the government collapsed as a result and the magistrate became president of the country (Greece). Plame, of course, is Wilson’s wife Valerie, a WMD specialist at the CIA. Wilson almost assuredly revealed the identity of his wife to Kristof long before Miller knew.
To quote Kristof in his article, “I’m told by a person involved in the Niger caper that more than a year ago the vice president’s office asked for an investigation of the uranium deal, so a former U.S. ambassador to Africa was dispatched to Niger. In February 2002, according to someone present at the meetings, that envoy reported to the CIA and State Department that the information was unequivocally wrong and that the documents had been forged.”
To quote Fitz at 5:09 today, “DONT YOU THINK THE AMERICAN PEOPLE ARE ENTITELD TO ANSWERS.” I can hardly wait for the civil trial between the Wilsons and Cheney, Rove, Libby, and others.

what an amazing day. to have been able to “hear” what was said as if we were there was priceless. I will never understand why a Federal trial of such magnitude could not have been televised. bring on the hearings!

Fitzgerald has been put through the ringer with this case. The various smear campaigns were just cruel. And the fact that he couldn’t respond made ME furious. I can only imagine what it was like for his friends and family.
So today, regardless of the outcome of this trial, Fitzgerald got his voice back. And, as is true of ethical people with a platform, he showed all of us, loudly and clearly, what it is to prevail.
The fate of America hangs in the hands of a dozen citizens. May they have both wisdom and strength.

Slipped into, and passed, in last year’s defense bill was a provision making it easier for the “president” (such as the AWOL TRAITORBoy) to declare martial law.
A bipartisan bill, sponsored by Pat Leahy and Kit Bond (he’s such a rubber-stamper, you KNOW it’s serious), would repeal this.

Those notes on the margins weren’t questions, they were Cheney’s directions on how Scooter should present the Wilson story to the press once the outing campaign was initiated. Cheney wasn’t asking Libby to find out if it was a junket, he was instructing him to frame it that way to the media slugs they had come to depend on for their subterfuge.
And did anyone else get incredibly indignant when they read the comment about the Wall Street Journal acting as a posting board for Cheney’s war-mongering shenanigans?
Billionaire, no-bid, book-cooking bastards, one and all. They were salivating at the chance to use this war to gain money for blood.
Lincoln warned us of the influence of financial interests in government, and Eisenhower lumped them all together with his military-industrial admonition (too bad they made him ake out the “congressional” tag, it would have fit perfectly in this millieu.)
