
The media are now keenly aware that it is not just Scooter Libby on trial; he is also the proxy for a Vice President whose credibility and reputation, already damaged, are being destroyed by one revelation after another. Last night, the major networks/cable channels covered this as a lead story, and PBS' News Hour devoted a large segment to it.
With ironic justice Chris Matthews devoted an entire hour to discussing the Libby trial and its implications for Vice President Cheney. After all, it was Matthews' July 2003 Hardball segment questioning Mr. Cheney's role in the Bush Administration’s WMD deception that provoked an angry phone call from the VP's Chief of Staff to NBC’s Tim Russert. Cheney was angry at any suggestion that he may have known about Joe Wilson's Africa trip, and it was Scooter’s job to express the Vice President's displeasure to Russert and NBC. But it was this phone call that may now determine whether Libby goes free or to jail, and if the latter, whether we head down a path that could lead inexorably to Dick Cheney’s resignation. We are almost there, but not quite.
In Tuesday's op-ed, NYT columnist Nicholas Kristof challenged Dick Cheney to "Tear Down This Wall" (Times Select), laying out a set of questions involving Cheney’s involvement in the Plame outing that now demand answers from the Vice President. The questions and the emerging facts behind them are damning:
Mr. Vice President, did you push Mr. Libby to dig into Joe Wilson’s background and discredit him?
What did you mean when you wrote, in a note to Scott McClellan that has been entered into evidence, "not going to protect one staffer PLUS sacrifice the guy
the Pres.that was asked to stick his head in the meat grinder because of incompetence of others."When you discussed Joe Wilson with Mr. Libby on Air Force Two on July 12, 2003, what instructions did you give him?
Mr. Cheney, on that plane, did you specifically tell Mr. Libby to leak to reporters the fact that Mr. Wilson's wife worked at the C.I.A.?
During the leak investigation, were you aware that Mr. Libby was telling the F.B.I. apparently false information? You rode to work with him nearly every day in your limousine, and the issue never came up? Or did you ask Mr. Libby to protect you because you didn’t want it known that in fact you were the one who had told him about Ms. Wilson? Was there some other information you wanted kept secret?
Were you trying to cover up your own reliance on misinformation about Iraqi W.M.D. by blaming the C.I.A. and anybody else within range, like Mr. Wilson?
So when are you going to come clean?
Of course, we have only heard half the trial. The jury, not we, will determine whether Fitzgerald has proved beyond a reasonable doubt that Scooter Libby is guilty of the crimes with which he is charged. But I am certain of one thing: we already know that Dick Cheney and his WH helpers are responsible for a serious breach of national security, and it is only a matter of time before the media begins to couple reporting of the "smoking guns" revealed in the Libby trial with the obvious and damning evidence that has been staring them in the face the whole time.
After three years of investigations, two weeks of testimony, dozens of exhibits, hours of Grand Jury testimony and innumerable news articles fed and spun by the White House, Karl Rove’s attorneys and the President's and Vice President's press agents, we now have mountains of evidence that Dick Cheney and his White House allies worked as hard as they could to discredit Joe Wilson for suggesting that the Administration had knowingly misled the country into war. But that is not the most damning evidence.
Like the case of the dog that didn't bark, there has always been an important piece of evidence that went directly to the Vice President's integrity and fitness for office. Dick Cheney didn't care about the dedicated intelligence people who help protect our national security. In fact, he had these loyal Americans confused with the enemy.
The evidence is compelling that the OVP learned early on about Valerie Plame's identity as a CIA official involved with the most sensitve issues of WMD proliferation, but they then did nothing to protect her. Upon realizing her position it was their sworn duty to shield her from disclosure, but instead the Vice President and other members of the Bush Administration, including the National Security Adviser, repeatedly invited reporters to uncover her role in collecting national security intelligence. Whatever their specific intents regarding the nation's criminal statutes, it is irrefutable that they wanted her role in Wilson's efforts to collect intelligence exposed to public view. It is irrefutable that in the process of discrediting Joe Wilson, they outed Valerie, ending her career and exposing and shutting down her cover operation. Whether or not Libby lied, the Vice President and every member of the Administration who played any role in the effort to discredit Wilson and haul Valerie Plame into the public eye are responsible for that result.
It is also seems virtually certain that her public outing disrupted and adversely affected her Counter-Proliferation Division's classified and highly sensitive efforts to acquire critical intelligence on the status of WMD development in Iraq and Iran. It is hard to imagine any intelligence issues more sensitive and vital to US security. Whether through carelessness, recklessness or design, that intelligence capability was harmed, not only by Plame’s outing but perhaps more so by the intimidating message her outing sent to every other person working in the US intelligence community.
We have had to listen repeatedly to the most dubious and pernicious claims by this Administration that mere debate about the President's failed war policies is "helping the enemy." But can there be any doubt that serious harm was done to the national security of the United States through the reckless outing of a CIA agent? At a time when the quality and credibility of foreign intelligence are vital to US security, can there be any doubt that the resulting intimidation of every US intelligence official who might dare speak the truth to this Administration has and continues to cause serious harm to our national security? Is there any doubt that those who are asked to risk their lives to gather intelligence for the US will think twice about reporting information that they know might undermine some fantasy of the people who occupy the White House? Every member of the intelligence community knows that this Administration has not held a single person accountable for the damage they have done.
Throughout this sordid history, the Vice President has remained defiant, arrogant, and seemingly unconcerned about the mess he’s made of US security interests, never mind the plight of a CIA agent and her operations. Like Karl Rove, who once told Chris Matthews that a CIA agent was "fair game," the Vice President still holds security clearances and openly bragged of his authority to declassify the nation’s secrets (and its agents?) at will. But except for Fitzgerald's indictment of Libby, none of the senior WH officials who urged the media to seek out and expose Valerie Plame has been removed from positions that affect vital national security interests. No sane government would tolerate such an indifference to its own security.
Even if we ignore all the accumulated evidence of calculated intent, and simply take the best excuse the Administration has offered — that Valerie Plame's outing was an inadvertent consequence of an Administration's clumsy attempt to get the truth out — we must face this fact: As the chief architect of the nation’s security plans, Dick Cheney should have been the first to bark when Valerie was outed and her team compromised. But there was nothing but silence. Why? How can we possibly trust this man, and those who helped him in his scheme, with our national security?
Whether Scooter Libby is convicted or acquitted, the Vice President and those who helped carry out his vindictive and reckless scheme remain proven security risks. It is time to hold Dick Cheney and everyone who pointed a finger in the direction of Valerie Plame to cover up their duplicity accountable for the damage they have done to this country.

Excellent essay Scarecrow. I hope (beyond hope?) that we are closer to a tipping point where the MSM and others actually bring these questions to the light, where they belong and refuse to take spin for answers.
I thought LHP’s posts last night were particularly enlightening on a thread last night when she talked about Fitzgerald’s possible strategy in not indicting Cheney up front. Instead, he chose to get his findings out there(via Scooter’s GJ testimony) and not allowing them to get hidden away in “executive privilege” and a constitutional challenge right away.
The FDL team is magnificent.

I think both the Post and the NYT have been running stories that say Cheney’s fingerprints appear to be all over this thing but I think their editorial pages need to call for Cheney to answer questions or resign.

I can’t help but feel that nobody’s really going to ultimately feel the lash: Scooter’s falling on his sword, will appeal and then be pardoned. By doing so, i.e. not taking the stand (nor Cheney), he prevents more damning and possibly incriminating evidence from being uncovered.
Bush will take some heat for the pardon, but it will be a phyrric victory.

Scooter’s not gonna testify–neither is Cheney. Thus more damning (and probably incriminating) evidence will not be heard. Libby will probably be convicted, there will be a lengthy appeal, and ultimately a pardon. Bush will catch hell for it, but has he ever given a fuck? What’s it gonna do, make him unpopular?

cbl — I think they mentioned the magic wand, but Chris seemed to be focused on the likelihood that cheney was briefed on Wilson’s finding as soon as he got back. He wants someone to ask that question of Cheney. Larry Johnson has dealt with that over at NoQuarter, concluding that when a VP asks for information, he gets it right away. That’s the job of the CIA briefer. You’ll note in Marcy’s post last night, she discusses how cheney’s talking points adjusted to account for the fact that at least Scooter was probably briefed right away, while claiming that Cheney himself was still in the dark.

From one of Christy’s posts yesterday, I am haunted that we will never know what Cheney told Fitz. Could the press demand that Cheney make the transcript of those interviews public or is that bound up in some secrecy thing. It seems like since the interview didn’t take place before the GJ that it could be released although they’d probably claim executive privilege/national security/BS!
Thank you for sharpening my focus on the the vice president and the sloppy fingerprints he has left all over the yellowcake affair. When the administration is determined to fool us and to hide the truth, there comes a time when it’s obvious and necessary to jump to a few conclusions.
Kristoff has some great questions, but he’s dreaming. The vice president doesn’t intend to answer them. If he is compelled to do so, he will lie. This Libby trial deposits another truchload of evidence that Cheney will lie without compunction and without fear of contradicting well-known facts. He has lied throughout his vice presidency, he will lie in sworn or unsworn testimony. When the machine that has replaced his heart finally breaks down, he will lie to St. Peter, and when he reaches his final destination, he will lie to the Devil.

(1) the 16 words shouldn’t have been in the State of the Union,
(2) Wilson was sent on the trip b/c of inquiries made by the OVP,
and
(3) Wilson was right when he said that his trip led him to believe that there was no truth to the Niger uranium story.
So they compromise national security to get the truth out and the truth is already out.

Thanks for this. I was actually watching Imus for a few minutes this morning, and as soon as he got Matalin on the phone, I had to change channels before I heard her insufferable voice.
Bush’s previous posturing about firing anyone involved with the leak should lead to some interesting questioning of him now by the press. Unfortunately the MSM seem incapable of doing basic questioning of our King. Additionally, he’ll probably not have another press conference and will only go on Fox Noise. These are proud days for Republicans.

GREAT POST SCARECROW! I am very optimistic this morning. I have been talking about this case since late ‘05 and no one has ever been interested. This morning I got calls from friends asking about it because it is now on MSM. I believe that if regular people (not plame junkeys like us) are aware there could be some movement on Cheney and his criminal behavior. Back to lurking.

It’s way beyond time for this arrogant freak of a vice president to be shown who he really works for–and it ain’t Halliburton or Exxon-Mobil. As Marcy’s post last night reminds us, cheney was more concerned about the appearance that he would have been briefed about Wilson’s findings upon Wilson’s return. That’s prior knowledge that the yellowcake story was at least questionable. Cheney wants to claim he never knew the intelligence was faulty befor the made the decisions to got to war or the decisions about what he and Bush would say in their speeches. Their defense is ignornance, even thouh it was their job to know and check.

I subscribe to the Sunday-only NYT (dead tree edition) so can access behind-the-wall content at any time. However, I’ve also found that if I connect on-line to my local public library’s search engine, I can reach behind-the-wall content through it.
I justify my Sunday-only luxury by the fact that I send lots of the paper to folks overseas @ AnySoldier.com. They’re always asking for news, so I take care to include Frank Rich in my mailings. [Note: I send to folks @ AnySoldier with whom I’ve developed a relationship. I’m not blind-bombing these poor guys with the truth.]

lending my voice to the chorus: this was an excellent post, scarecrow. connecting dots, and in a very tight, potent fashion. talk about talking points — this should make the rounds of msm and regular folks who haven’t been paying attention.
fitzgerald is performing a public service by putting this out there. knowing what he could get (libby/perjury), as opposed to what he couldn’t (cheney/outing), he found this to be the best way to lay out the record of how the cheney administration operates.
now, what gets done with that information, that’s the big issue.
Matalin was on their first segment, what you caught was her calling back in to reverse her earlier statement about telling Scooter that Russert hated Matthews. Scooter wrote that down, and now it’s evidence in his trial. Evidently DeadEye still thinks Scooter has a chance, because clearly he watched Imus this am to see how Mary did. I strongly suspect that after hearing Matalin deny that she ever said that Russert hates Matthews, he told her to call Imus back and reverse her statement.
Mis(erable) Mary is a good reason for the Democrats to cease doing any business with James.

It boggle the mind that we have gone from George Bush the elder saying this: “I have nothing but contempt and anger for those who betray the trust by exposing the name of our sources. They are, in my view, the most insidious of traitors,” in a speech at the CIA on April 26, 1999, to Dick Cheney saying about the outing of an undercover agent, in essence: “Hey, you can’t prove it was me.”
I think Patrick Fitzgerald has proven that it was Scooter Libby. Let’s hope that Mr. Cheney gets just what he deserves soon enough.

To re-justify the 16-Words, (Bush and Cheney?) have a DEBUNKING report DOCTORED to SUPPORT the Uranium Claim. They added to it a covering memo from the DIA.
Then they invade.
The story inside the Libby Trial evidence is the story of Dick Cheney ‘waking-up’ to the fact that the Author (the ’sensitive source’) of the original DEBUNKING report – the one that got DOCTORED – was Joe Wilson.
And Joe Wilson KNEW what Bush and Cheney did to it, too.
So, not surprisingly – as Cheney slowly catches on his Talking Points, as we can see from Marcy’s post article last night, get successively narrower in scope – until they focus in on just one thing – Get Joe Wilson.
That’s why Cheney cared that Wilson was sent on the trip to Niger.

I’d suggest Bagdad …
As eager as I am to see Cheney exposed for what he is, I am very apprehensive about the potential consequences. Specifically, if Cheney is able to weather the disclosure of these facts – his knowledge of, and involvement in, the outing of Plame – then it becomes impossible to sustain the cherished American notion that no politician could so abuse his power and yet maintain that power. The country that deposed a president for abuse of power will have become the country that permits a rogue vice-president to brazenly undermine national security for his own petty political purposes, and permits him to do so with impunity.
My country has been increasingly hard to recognize in recent years, and I’ve become correspondingly cynical. But I still somehow believed that when the curtains were pulled back on abuses like Cheney’s that no amount of raw political muscle, partisan discipline and working of the unseen levers of power could save the power of the abuser.
The prospect that any American could be beyond accountability for such abuse of power is disturbing. The prospect that Dick Cheney may be operating with such impunity is horrifying.

Has anybody mentioned that the CIA honors fallen agents in a “Book of Honor”, which currently has an anonymous entry in it that emanates from the period when Brewster-Jennings was outed. The blood may be on their hands.
I commented a very long time ago that far too many people were benefitting from 9/11, the war in Iraq and all the destructiveness of the Bush administration.
I never in a zillion years would’ve thought of something so direct as the ‘pulling’ of the WTC towers on 9/11 as a direct benefit to Halliburton by eliminating their asbestos ‘problem’ and the related direct benefit to Richard “Dick” Cheney. Wow!
Excellent post. It gets to the heart of the matter in a way that I haven’t seen written about before. It is true that we are beginning to see the MSM awaken to the need to reveal the possible motivations of outing Valerie Plame. Your point about the chilling effect this power game has upon our securities agencies is the most compelling reason to turn over all of the rocks, scrape off the dirt, and unearth the worms. Fantastic piece, thank you. Let’s see if the MSM can make the same intellectual leap in their coverage, this is so important to the public’s understanding of why they should be paying attention.

Two points that I have missed in this particular conversation but are particularly relevant:
1) I feel that the reason that Fitz never indicted any of the Bush Administration people that disclosed Plame’s name is, as Emptywheel terms it “Instadeclassification”, i.e. the theory that Addington testified to that if the President or the Vice President says something is declassified than it is. Glenn Greenwald and Jack Balkin can have a field day about this horsehockey – but the fact of the matter remains that Fitz probably could not have won a trial if he had indicted any of the leakers.
2) My second point is semi-related. The standard in a civil matter is much less stringent. I will be very interested to see if the government decides to settle with Wilson and Plame in their civil law suit. For the lay people, think OJ Simpson. While it is pretty clear to anyone with a brain that OJ was guilty, the DA could not prove it beyond a reasonable doubt. The civil standard, being much lower, allowed the family to “win” that case. (I say “win” because they of course have never actually collected a judgment).
It is absolutely 100 percent clear from the testimony in the Libby case that this leak destroyed Ms. Plame’s career and that Cheney and his ilk, as Scarecrow has made crystal clear, did so maliciously. (for you litigator types out there, I don’t know the tort laws in this particular field, but I would be shocked if this case does not meet all of the relevant benchmarks)
Bottom line – we can all wish for Cheney, et al to get indicted, it’s not going to happen. The great irony of the Clinton Wars is, however, that Cheney is going find it very difficult to quash the Wilson’s subpoena. A Cheney deposition would certainly make fascinating reading….

Take all the mushroom cloud clips from Greenwald’s “The Truth About Iraq” and add the 16 words, and ask all the Congresspeople who approved the war, if they would have voted for without these warnings.
Those 16 words that Joe Wilson resisted, capped a systemic campaign that Cheney engineered, to guarantee his no-bid, book-cooking, military-industrial pals would get their trillion-dollar war.
