While tomorrow's release of the Scooter Libby grand jury tapes will no doubt be fodder for endless blog posts, they will be of no less interest to shrinks and dramatists. Over five and a half hours of the tapes played in court today, and although Libby's endless network of obfuscations at times became impenetrable, it was fascinating to watch his gradually dawning realization under Patrick Fitzgerald's relentless and dogged questioning that he was in fact screwed. Initially calm and self-assured, as Fitzgerald detailed one after another conversation in which Libby discussed Valerie Plame's identity with those who contradicted his claim of having heard the information first from Tim Russert, you could hear him start to slip. He grew foggy, his voice dropped, he became dour and tried to shift out from under Fitzgerald's painfully detailed questioning but there was no place to hide. Even hard core cynics in the media room were riveted.
The day started out with Judge Walton ruling that New York Times journalist David Sanger would be compelled to testify in Libby's defense. Somehow Sanger is supposed to say that he spoke with Libby during the time in question and since Libby didn't say anything to him about Valerie Plame this must be proof of…well, I don't quite know but Team Libby certainly seemed to think it was significant. Sanger's attorney was arguing against the appearance so an appeal is probably not unlikely, though one has to wonder how many New York Times reporters will go to jail, wallowing in melodrama in defense of Scooter Lilbby. I think we might already be at one too many.
My personal favorite moment came when Fitzgerald began questioning Libby about the declassification of the NIE, which Libby claimed the President could do simply by waving a magic wand. Fitzgerald comes off as something of a boy scout and you could tell it just did not sit well with him that something so sensitive as the NIE (which was also under review at the time for declassification by Tenet, Rice, Hadley and Andrew Card) was breezily declassified simply to leak to a journalist for PR purposes. His misgivings were seemingly compounded by the fact that nobody bothered to tell anyone about the declassification, and when he asked Libby if this was common practice he sounded like he was gazing on some grubby little urchin making mud pies in the sandbox with Mom's fine china. Libby was squirming — even he knew this was making him sound like a complete bonehead. As the NYT notes today, "It may be that kind of cross-examination from Mr. Fitzgerald that the defense hopes to avoid if it keeps Mr. Libby off the stand." Ya think?
There are three more hours of tapes to get through tomorrow, and then Tim Russert testifies. Fitzgerald could not have set the table for his appearance any better. Throughout the taped testimony, Libby repeats over and over again that he could not have heard about Plame from so-and-so, because he remembers being surprised when Russert told him. Well, Russert is going to show up and say he never told Libby about Plame, and if the jury were tempted to believe Libby over the endless parade of people who all would have had to mis-remember in exactly the same way in order for his story to hold up, the Russert testimony may strike the final blow. And while Russert no doubt dreads having to testify, he will probably use the opportunity to try and counter Cathie Martin's assertion last week that he was in the bag for Dick Cheney, ever the pliant administration propagandist.

While I was reading Swopa’s posts about the GJ testimony I kept thinking, Libby must think that if he keeps saying “I don’t remember” over and over, eventually everyone will beleive it, ’cause that’s what his boss said would happen.

General question here: how do we know for certain that Pumpkinhead is actually going to testify that he never told Libby about Plame? I’ve missed this someplace along the way…but then I don’t trust this tool anyhow.
People ask me in this little burg I call my home-town, how the Libby trial will affect them. I’ve tried all the ’stock’ answers I know. But I can tell by the glazed look in their eyes that my response doesn’t account for much. Any ideas?

Well, Fitz has a sworn deposition from Russert. I doubt that he would have forgotten to cover all of his bases. If Russert tries to change his story, he gets hit with a perjury charge. I think his lawyer has probably already told him not to try anything funny.

The important question is whether this whole Libby episode will hurt Timmy’s ability to promote any future radio shows that his son decides to co-host with James Carville.
That would be a real shame.

I think after Fitzgerald finishes his case anything the defense comes up with is going to be oddly anti-climactic. The memory defense has been shot through with holes so what’s left? The scapegoat defense is part of a more general strategy to blow smoke and confuse the issue. This hasn’t worked up to now because Fitzgerald has stayed focused. I don’t see this changing.
Sanger looks like an interesting if desperate ploy. All it proves is that Libby didn’t blab to every reporter he met. It says nothing about those Libby did talk to. The only value I can see in it is that the defense may hope that Sanger may fight testifying and in some way derail the trial. After Miller time, I don’t see the NYT going to the mat again, but this is where the defense is at the moment flailing about, grasping at straws, and preparing the ground for appeals that probably won’t get very far. In other words, the defense is at that point where they need a miracle, you know a little like Bush with Iraq, and about as likely.

You look wonderful. Yesterday I spoke of you with the woman operating the shop within the Lymphedema Treatment Center in Scottsdale AZ.
(While I have leg lymphedema because of trauma, arm lymphedema is a problem many women treated for breast cancer must face — numerous products in that marvelous, welcoming, and warm shop were designed specifically to make the life of breast cancer patients as comfortable and soothing and free from additional troubles as humanly possible.)
She agreed with me that your courage is inspirational to us all.
Now I need some courage — and your prayers/good thoughts — and the prayers/good thoughts of any Firepups who care to send some for me.
I have an odd sort of lump in my underarm.
After having had sporadic underarm pain for almost two months, and having my dermalogist tell me it was most likely skin irritation, the therapist at the lymphedema treatment center told me it doesn’t look like skin/soft tissue irritation to her — and that I need to get to my GYN and have a mammogram stat.

Question for “pardon not likely” theorists–
If Libby is convicted then pardoned, how does an admission of guilt (necessary for his pardon)open up all the other co-conspirators (Cheney, Rove, etc.) to future charges from Fitz? How does an admission of perjury help Fitz connect the dots for a more airtight case against Cheney, Rove, etc.?
WRT Cheney, Libby would still have to turn on him for Fitz to have a case, and I think for Rove too, unless I’m missing something. Somebody care to connect the dots for me?

I can’t imagine Russert will be effected in any way unless his ratings fall severely. Surely he would have been fired long ago if GE had any interest in even the appearance of unbiased news.

I discussed this with friends the other night and couldn’t come up with specific instances where Libby’s admission of guilt would make the other conspirators more vulnerable to charges from Fitz.

If he does get a pardon, the first thing they’ll do is challenge the “accepting a pardon is an admission of guilt” precedent. Bush already has one bogus Supreme Court decision under his belt. Why not two?

Since cheney wasn’t charged, would he have know all the documents Fitz has and the testimony he has gathered? Cheney gave me the impression a few months ago that he could testify and ’save’ Libby. Apparently he’s not so confident now.

I am sadden for you. A person can’t be replaced in their families hearts. It can happen anywhere even in a tiny place like where I am living. I know a father who’s son was the first Navajo killed in combat since the Vietnam War. He and his wife have had a tough time of it.

If Scooter is found guilty, Fitzgerald can use that to press him to cooperate in return for a reduced sentence. Scooter could be looking at up to something like 30 years in the slammer. That’s a lot to ask of loyalty if there is no hope of a pardon floating out there.

Any word on Libby’s motion to introduce a bunch of evidence without taking the stand? My bet is that it isn’t going to fly. Wells doesn’t need to use Libby to introduce all those documents. He can also get them in through Cheney. I think the motion means that neither Libby nor Cheney are going to take the stand. That’s going to piss off Walton, who’s spent a year dealing with all of the confidential shit that Libby and Cheney were supposed to talk about on the stand. And I think that’s the idea. I think the whole point of this motion is to try to goad Walton into losing it and committing a reversible error. I also think that Walton isn’t going to bite. He’s just going to slap the motion down with a terse but correct ruling. What’s everyone else’s take on this?

I predict a lengthy, confusing, and full throated defense – numerous witnesses, lengthy questioning, random tangeants.
Fitzgerald will cut through it all on cross. But it will still be a messy scene.
Muddying the waters is the only means to sow doubt in that one juror Libby needs to survive.
We’ll all feel like a bunch of mudskippers by the time the jury begins its deliberations. :)

No such admission is necessary. Ford pardoned Nixon for any crimes might have committed. Nixon never admitted anything.
The down side to a pardon for scooter is that he would have no constitutional reason (the 5th) for NOT answering any questions under oath. Like in the Wilson civil trial or if called before another grand jury.
Of course, that is just from memory and I am not a lawyer, yadda yadda yadda.

What’s your take on if he is pardoned? Some commenters think Bush won’t do it because it makes Cheney, Rove etc. vulnerable to charges that Fitz could make now that he has Libby’s admission of guilt. However, I can’t see specific instances where Libby’s guilt points the finger solidly enough at the others.

Russert is screwed both ways round: the cross by Wells and Team Libby is probably going to spend a bit of time on the Cathie Martin ‘control the message’ line.
The way MSNBC covers it will be an interesting test of how the network plans to handle itself.
I still would love the PlameHouseketeers to speculate a little on what Team Libby is going to offer up as a defence. Getting Sanger to testify that Scoots didn’t tell him anything isn’t much: are they planning on calling the other 299.99 million people that weren’t blabbed to?

Nah. There’s going to be a bunch of Hail Mary witnesses. Starting with David Sanger. They’re going to pull a lot of stunts to try to get the trial slowed down. I don’t think any of the reporters are going to help them. They’ll all bitch and moan, but they’re going to have to testify. Judy has already shown them that Fitz is willing to toss them in jail, and they can’t possibly claim reporter’s privilege if their source is asking them to testify. Greymail hasn’t worked out too well, either. I’m wondering what else they’ll come up with.

Wrt to a Pardon, see my comment earlier in the week.
Shorter version: If Scoots gets a pardon while Fitz is still in business, then Fitz will drag Scoots right back into the Grand Jury.
Scoots will then have to tell all because a pardon negates both his 5th Amendment right against self-incrimination as well as negating his ability to stand mute.
Bottomline: His fellow conspirators can’t be hoping for a pardon ’cause then they would be up the proverbial creek without a paddle.
Also, a blanket pardon for all the conspirators would likely put Junya at higher risk for Impeachment.

There are no conspiracy charges in this trial, so, I would guess, Walton’s instructions will include admonishments to stick to charged indictment.

A straight-up ‘the defense rests’ is basically asking the jury to find reasonable doubt in the prosecution case. It’s certainly plausible: the more witnesses and evidence they put out, the more time the jury has to consider who’s not being called out of those who could be called on Libby’s side.
All or nothing? I’d leaning towards a little more than nothing, but nowhere near all.

I’m curious about whether Libby might be rethinking any plea bargain offers that Fitz may have tendered. Given the way the trial has been going, especially with Libby re-living his last experience of being questioned by Fitz right out there where all the jurors can see it, I’m thinking he might be in a more receptive frame of mind now than he was a couple of weeks ago. It’s not over, and it’s not a slam dunk by any stretch of the imagination, but Libby’s got to be a lot more worried tonight than he was a while back.
And that makes me curious about how Cheney and Bush have been sleeping lately. Just the thought that Scooter might cop a plea has got to bring them lots of nightmares.
And that makes me smile.

Well, IANAL but I think that the simple fact that Libby gets convicted is irrelevant in and of itself to what happens to Cheney and Rove. It only becomes relevant if Fitzgerald could use a conviction to pressure Libby into giving evidence against Cheney and Rove.
As for the odds that Libby might be pardoned, I don’t know. Bush has never shown any loyalty to those who have left his Administration in the past. I don’t know why he would now.

The statements he could make against Cheney, Rove etc. would be a he said/she said between an admitted perjurer and someone about whom there is no other evidence (no matter how much I wish otherwise). Depends on how generous Fitz is feeling and how much Libby can give him. Libby could put a halt to the whole thing tonight if he and Fitz could agree on a deal. He could wait, and if convicted, offer to help Fitz with future prosecutions in exchange for some leniency. If he waits, he probably won’t get as good a deal – unless he’s really got some really good stuff to share with Fitz.
The kicker for Scooter is that he’s still on the hook for whatever additional charges Fitz is working on. Conspiracy comes to mind, which is probably why Ari jumped to get his deal way back when. The first one to flip on his partners in crime always gets the best deal from the state.
I don’t know if this has been said before, but didn’t Russert already testify before the GJ? If he said there, under oath, that he didn’t tell Libby anything else would be perjury.

Just my guessing here, but I bet that Fitz has a whole of lot of other damaging evidence against the other conspirators. Evidence that might not “yet” reach the threshold he has for a slam-dunk prosecution.
If Scoots were to be forced to spill all (or again be on the hook for perjury, obstruction of justice, betrayal of a CIA NOC, etc.), that might just tip the balance of evidence that Fitz has to convict the rest of the cabal.
It’s kinda like pulling that proverbial “loose thread” on a sweater. Makes the whole thing unravel.

Jane – I just want to say you look marvelous, with a winning smile. And I think you may be the bravest person in lefty blogosphere, to have lost your Mom, travel to CT to campaign, publish a book, have breast cancer, for the third time, go into hospital, and get out and come to DC to cover this trial. It is remarkable. I would never have had the courage under similar circumstances.
What’s exciting to me is the hearfelt efforts applied to the truth in this effort. It is bracing and cynicism-busting… I’m sending some cash asap and buying a bunch of those damn books…
FDL has a personal (warm, funny, real) yet truth-seeking paradigm that doesn’t put pretense above facts or hide behind a fake wall of pretending not to have a bias….
When our country was young, each big city had many papers, each expressing a distinct opinion (well that’s history) but man…. I dig the opinion here at FDL… All of it!!!

Indeed Sanger IS a desperate ploy. But I think that the NYT would be hard-pressed to argue that a “waiver” on the part of Libby (his source) is coerced in any way. Presumably anything he says about his discussion with Libby would “help”.
Of course, they way things are going for the Defense Sanger might testify to the effect that “Mr. Libby, in our interview on July 5th, assured me that he didn’t have knowledge of who Mr. Wilson was, and that he didn’t know that Val Plame, Wilson’s wife, was a CIA agent working in CPD.” And then Fitz asks, “he told you this on July 5th, right?” “Yep, in my dated notes”. Fitz to Sanger “Did YOU know who Wilson and Plame were before Libby blurted this out?”
“No…I assumed he was saying that Wilson was the “Ambassador”…but it was sort of weird that he was saying that he didn’t know who they were. I never asked.”
Libby now seems to be involved in a game of “I knew it before I didn’t”, and has been able to recall minutia about meetings and how people reacted to the things that he presumably forgot. Things like Cheney’s and his own reaction to learning about Plame, the specifics of the joke he told Grossman and that he even pointed to a CIA person in the hall, the name of some functionary at NBC that he needed to contact (Snyder?). He remembers why he WOULDN’T have told members of the Press that “Wilson’s wife” was CIA (even though he swears that he never would have thought it was wrong) but he forgets that he was told. And apparently he asserts that Cheney forgot, too!
He remembers that Judy Miller and he couldn’t arrange things for lunch…but he can’t explain how she wrote down information about Wilson and Plame in her notes TWICE…both times when they had meetings!
The list of the trivial crap that Libby does recollect from his job should be compared to the stuff that he should remember…and then we should ponder why this guy was actually considered more competant than someone obsessed with the melodrama of “Big Brother”, “The Apprentice”, and the daily soaps to be working on National Security issues.
Except that I don’t believe his idiot-savant act for a second. And I don’t think a single juror will either after that dreadful performance before the Grand Jury.
Libby’s only chance (hopefully his lawyers are eavesdropping) is to approach Fitz and become a cooperative witness…perhaps using the Trial as the way to get his mea culpas on the record.
Sworn testimony (that he could be nailed with later if he lied)…with at least the apparent humiliation of exposing the truth before a national audience! Maybe then Fitz will ask the judge for a reduced sentence if Libby “cooperates further”.

I’m not sure that Scoots is going to make a deal, because I don’t think Fitz is going to give him a very good one. Why should he? Libby’s been lying to Fitz for 3 years. It’s now plainly obvious that Libby is guilty of several felonies. He is PROBABLY guilty of an IIPA violation, but that’s almost impossible to prove. I would imagine that any deal Fitz would offer would be something like: (a) Plead guilty to violating the IIPA in betraying Plame to Judy Miller, (b) Cooperate completely (which probably means ratting out Cheney), and (c) Take 2 years (at least) in a federal prison for outing a CIA agent.
That’s not going to sound very good to someone who’s been running around with Darth “Absolute Power, No Consequences” Cheney. Of course, if he’s convicted, Fitz will offer the same deal, only with MORE prison time, since his testimony as a convicted perjurer will be worth less to the prosecution.

Hey, cataract sugery is a breeze. I have had to have both eyes done in the last two years – I was really struggling and nearly blind, esp. at night. And I’m only 53! Yikes!
The surgery itself took less than an hour, and I was out of the patch in a day.
My vision in the eye that was done was amazing…better…BETTER than I have ever had since childhood!
They’ve been doing this type of surgery for almost 50 years. Today the risk is very slight. Just be careful during the post-op. Don’t rub or take off the shield!

For starters, what if Fitz were to call Libby back in and ask him again if he and Cheney discussed outing Plame on AF2?
Pin him down to a yes or no- if he says yes, he goes after Cheney for IIPA (for example finding out who in the CIA told him she worked in CPD)…If Cheney found out ‘officially’ and spilled anyway, he’s liable, right?

Hmmm. According to Alicia Sheppard on the NewsHour just now, Matt Cooper doesn’t know what the words “off the record” mean. Testimony apparently showed he reported on that material anyway.
Both she and Tim Rutten explicitly equated Cooper and Judy Miller.
That’s on top of evidence Cooper knowingly published false information.
