
I'm a football fan. I've got plans to catch up with my everyday friends after two weeks of fun in DC; I plan to sit back, catch up on all last week's beer thirties, and yell at the TV. (I'll be rooting for the Bears tonight, though I suspect Adam Vinatieri will make me cry.) So I'll only check in sporadically on this thread. But since not everyone has gotten their book in the mail yet, we decided to give you one more teaser from Anatomy of Deceit to read while you're watching the game. In honor of a tentatively planned appearance on Talk of the Nation tomorrow (2:00 ET), in which we'll discuss media coverage of the CIA Leak case and the trial, I decided to offer a piece on the campaign to impugn Ari Fleischer from July to October 2005. Based on this campaign, I guessed correctly [it was a classic wild-arsed guess] in July 2005 that Ari was going to be a key witness in the trial.
I'm just glad I noted that Ari "may have leaked to a journalist," given what we know now. But the rest of it--the transparent attempt to distract from Rove's trouble--that all holds up well, I think.
Rove needed to get the spotlight off himself and onto someone else. That someone turned out to be former White House press secretary Ari Fleischer. On the same day that the Times identified Rove as one of Novak's two sources, the New York Daily News published an article citing unnamed sources "close to the probe" explaining that, in addition to Rove, the grand jury was investigating Fleischer's role in the Plame affair. "Ari's name keeps popping up," one source told the paper.[i]
Clearly, the behind-the-scenes media campaign was giving reporters fresh meat (in the form of Fleischer) to distract them from Rove. The campaign based its insinuations about Fleischer's involvement on what is now called the INR memo, the same document from which Armitage had learned of Valerie Wilson's identity. The memo was faxed to Air Force One during President Bush's trip to Africa during the week of July 6, 2003. The Daily News story, quoting the unnamed sources, pointed out that the memo "included background on Wilson" and that it "appears to be a key" to revealing who gave Valerie Plame Wilson's name to Robert Novak.
A whole slew of stories in the national media followed in quick succession, each of them describing the memo and Fleischer's purported incrimination due to it.[ii] The press, which just a day before had been in a frenzy reporting Rove's demonstrable role in the CIA leak, had abruptly shifted its attention to chasing down a story implicating Fleischer and (to a lesser degree) Colin Powell in unsubstantiated ways.
One typical and egregious example of such misdirection was a Bloomberg story that began with a relevant question: "What did [Rove] know and when did he know it?" But then it answered that question by pointing to Fleischer:
On the same day the memo was prepared [July 7], White House phone logs show Novak placed a call to White House Press Secretary Ari Fleischer, according to lawyers familiar with the case and a witness who has testified before the grand jury. Those people say it is not clear whether Fleischer returned the call, and Fleischer has refused to comment.
The Novak call may loom large in the investigation because Fleischer was among a group of administration officials who left Washington later that day on a presidential trip to Africa. On the flight to Africa, Fleischer was seen perusing the State Department memo on Wilson and his wife, according to a former administration official who was also on the trip.
In addition, on July 8, 2003, the day after the memo was sent, Novak discussed Wilson and his wife with Rove, who had remained in Washington, according to the New York Times.[iii]
The story suggested the following scenario: Fleischer looked at the INR memo, learned of Valerie Wilson's purported role in Wilson's trip, returned the call to Novak and passed on the information about Valerie Wilson, and then Novak brought it up with Rove. Barely noticed among the flurry of articles was a denial: "Fleischer told the grand jury that he never saw the memo, a person familiar with [his] testimony said, speaking on condition of anonymity. . . . Fleischer has told the grand jury that he did not return Novak's call, a person familiar with the testimony said."[iv]
Furthermore, the INR memo simply could not have prepared Fleischer to leak to Novak. Two articles pointed out that the memo didn't include the name, Plame, used in Novak's column,[v] and two others noted that the memo didn't identify Valerie Wilson as covert.[vi] (Indeed, an Isikoff article published the year before had pointed out both of these facts.)[vii]) And yet many reporters continued to focus on Fleischer, such as Jim VandeHei of The Washington Post, who kept reporting the Fleischer story until October 2005, even after co-authoring a July 2005 article that made clear the memo couldn't be the source of the Novak leak.[viii]
We now know the insinuation doesn't make any sense. Fleischer testified that Libby told him on July 7, before the memo was sent, "The Vice-President did not send Ambassador Wilson to Niger. . . . the CIA sent Ambassador Wilson to Niger. . . . [H]e was sent by his wife. . . . [S]he works in . . . the Counterproliferation area of the CIA." Libby also made sure Fleischer knew this was sensitive, calling it "hush hush," "its on the QT."[ix] It's possible that Fleischer did leak Valerie Wilson's involvement to a reporter. But when, on July 11, he pushed John Dickerson of Time magazine and other journalists to look into the roots of the trip, sending them to discover Valerie Wilson's purported involvement themselves, he stopped short of leaking her classified identity. And according to Fleischer, the provenance of any information he leaked didn't come from the INR memo, it came from Libby.
The timing of leaks about the INR memo-particularly in relation to Fleischer-makes sense only in the context of the revelations about Rove and the more distant threat of Miller's testimony. While some of the articles in July 2005 suggested that witnesses had recently been asked about Fleischer's role, the bulk of interviews with administration officials took place in early 2004, with a second batch after the Senate released its report on Iraq intelligence in July 2004. And one article makes clear that the questions about the INR memo came much earlier in the investigation.[x] Yet all of a sudden, just as scrutiny turned to Rove, the series of articles focusing on Fleischer appeared.
The leak campaign against Fleischer served one other purpose, albeit a crafty one. Since Libby had told Fleischer of Valerie Wilson's identity in such a way that made it appear that Libby knew her identity was classified, Fleischer was a potential witness against Libby. Focusing suspicion on Fleischer would undermine his role as a witness if Libby were to face charges.[xi]
The leaks about Fleischer and the INR memo served several purposes: They distracted the press corps from validated revelations of Rove's involvement; they provided an alternative source for the Novak leak and a provenance for that leak outside the White House; and they impugned a potential witness at a trial. All of this was possible because some journalists didn't question what they were being fed by their unnamed sources.

If the press reports are correct, and Mr. Fleischer disclosed information concerning Ms. Wilson to reporters, he himself may have been a subject of Mr. Fitzgerald's investigation. Mr. Fleischer may thus have a motive to shade his testimony. Such possible bias will be vigorously explored on cross-examination.

Like everyone else, I can’t thank you enough for all you’ve done both in writing A of D and the live blogging. The last two weeks on my home front have, unfortunately, left me with little time to follow the trial. (I’m about two days behind on the trial and have given up on the comments, one of the best parts of FDL!)
I apologize if this has already been asked and answered, but do you plan to write a second book after the trial? Do you think that Libby is the first, rather than the only individual that Fitz plans to prosecute? If so, would you wait until the entire house of cards falls before doing a follow up?
After all the lies, spin, and spite that the Bush administration has produced, we need someone like you to write the definitive history on Traitorgate. (No pressure!)

Well except for the fact that it demonstrated that Libby knew about the NAMED “Valerie Plame” BEFORE [July 7th] he talked to Tim Russert [July 10- or 11th].
And that it pretty much shows that he didn’t “forget” anything from the time period back in early June when he learned both Wilson’s name and that “Wilson’s wife works at the CIA”)
[Clearly in the interim Libby lso must have found out her maiden name!]
So, except for the fact that it basically destroys two legs of Libby’s DEFENSE…I guess it wasn’t all that explosive!

My point was that Matlin already testified that she told Cheney and Libby that Plame worked for the CIA. (I forget the date) and I’m left puzzled as to why Ari was given immunity, and what he did with the information he was given that would nececitate his seeking immunity, and who else was involved in the thing he was given immunity for.

I had lotsa fun getting your book: sorta teased it outta local Borders, & left a play-by-play in a couple places in the comments back a few days. I left 2 of their on-site-book-xprts going, “Gee, wow, this looks really interesting!”
Borders only alloted their branch 3 lousy copies [in the initial shipment - heh], and no one had ordered theirs in advance. I think I convinced the gals to put the 2 remaining cc (after I bought mine!) ont front on those “NEW NON-FICTION” tables, instead of buried in Politics & Govt in the back of other store. - as well as urging them to order more because they WERE going to sell fast, because of this trial. (Also told the sr. employee about its rapid rise in sales rankings.)
I started dipping into the book right away, in Prologue, Epilogue & Acknowledgments, and was instantly riveted. Too busy with live-blog coverage to read the rest right now, but you’ve done an INCREDIBLE job. And I think it’s a terrific idea for FDL to follow up with all the “gathering up” of related posts all in a few posts devoted ONLY to the Plame/Iraq-War story. It’s so complicated, that’s the only way, other than your book, to keep people’s eyes from glazing over in utter confusion. The administration did a good job of poofing out a monster smoke screen. Thanks to you guys, there isn’t enough smoke ANYWHERE to cover their ***s anymore.

To join in somewhat with Subway Serenade @ 15, I think your analysis was kind of off target here — IMO, there was no Rovian campaign to smear Ari.
For example, here’s a quote from the Bloomberg article you called egregious example of such misdirection:
Some misdirection, huh? Note also that the accusation that Fleischer saw the INR memo is sourced as “according to a former administration official who was also on the trip.” Rove and Libby weren’t on the plane.
More to the point, the series of stories about INR memo simply kept the “WH outed a CIA agent” story alive in the public’s mind, which didn’t do Rove any favors. Rove’s preference would have been no stories at all.
It was this combination of facts that led me to conclude during the summer (along with Kevin Drum and Josh Marshall) that the INR memo stories were being pushed by the State Dept., and that Colin Powell himself was likely the whistle-blower who told the WaPo about “two top White House officials” leaking to at least six journalists.
Since you’ve been semi-transcribing the testimony, you know that Ari’s testimony ended with him and Dan Bartlett calling six or more journalists from Air Force One — although neither legal team seemed interested in establishing whether Plame’s identity was leaked during the calls (hint: you can bet it was).
So if someone like Powell, who couldn’t directly confirm any Rove leaking, wanted to keep the Plame story, he had to do it by pointing the finger at Ari (or Dan Bartlett… and I’m not sure how he stayed out of it, or whether Ari’s already having immunity was known to anyone).

I received my book last week. I am a BIG football fan, so read before the game, and will continue afterwards — in addition to some switching over to the Puppy Bowl. [BTW, a good friend worked as a consultant to last year’s Puppy Bowl and was mortified that they kept trying to get the puppies to “run around” and be “in action,” even at times they wanted to sleep. She was really upset.]
I was wondering if you saw Frank Rich’s column today. He had an excellent “laying it all out for the slow to comprehend” folks — emphasis on how the OVP/Libby machinations were aimed at covering the faulty original “intelligence.”

Years ago, when I had my first VCR, I sat through the whole game with the remote, just taping the actual plays from snap to tackle. Replay lasted less than thirty minutes.

Agreed, you guys. This is really scary stuff and our new Dem congress is moving way too slowly. Minimum wage increase is great, but it’s fluff compared to the thought of losing America. Is anybody else semi-hoping that the military temporarily takes charge for the first time in our history? Bush/Cheney et al are nutcases and cannot be allowed to continue pissing off the Mideast. They have trampled all over our Constitution. They have smeared our reputation world-wide. I held great hope that the new Democratic congress would be strong, but just look at them. This is no time to play tittlie-winks. I want to see a bold Out of Iraq Now bill put before the house and senate. Just let the war mongers vote against it, and let’s see how they do in 08. Let’s just see who dares to stand with the WH. If whoever sponsors the bill sees it filibustered, perhaps just this once the press could cover it properly. It’s pathetic.

On July 8th she told Libby and Cheney that the CIA told her “Wilson’s wife is a CIA agent”.
I suppose that may have “refreshed” Libby’s memory about her name being “Plame” and that she worked in the CPD, and that she “sent him”, etc. But again, that’s BEFORE his conversation with Russert.
And I suppose that Libby’s defense could argue that Libby didn’t really pay attention to his Secretary’s comment.
But I find it interesting that Cathy Martin remembered this little snippet of what Harlow told her on June 11th, and then remembered it, and passed it on to Libby and Cheney on July 8th. Yet Libby can’t remember information that he repeatedly heard, saw in reports, and actually was passing to reporters and other officials BEFORE he meets with Russert. Then he attributes it “erroneously” to Russert.
ARI’s testimony knocks that argument apart. But if by “explosive” you mean something that wasn’t already demonstrated by Judy Miller’s meeting notes, Craig Schmall’s notes, Robert Grenier’s testimony, Libby’s references to “the spouse of a CIA agent” to Addington, and several other bricks in the wall in front of the cask of Amantillado…well perhaps ARI’s testimony was simply the bricks that pretty much walled him in. Of course, Bonds testimony on what he told HER is essential as well.
Of course, one could argue that all of this stuff is in the INDICTMENTS. Thus it isn’t groundbreaking, new information. But people have already warned us…there aren’t likely going to be any Perry Mason moments where witnesses crack on the stand and confess to a series of murders ;-)
