My brief research on CD Circuit law suggests that although Walton has the discretion to do that, the strong presumption is to allow public access and that he has to find a strong countervailing public interest compelling their being sealed. What that public interest could be is not clear to me. Seems like the public interest would be to treat them like the rest of the trial exhibits — part of the public court record. After all, it’s not as if reporters won’t hear them played and report on them using their note taking skills (though no one is as good as you all at FDL!)
Any prediction as to what Walton will do and whether a sealing order would hold up on appeal?

Just a reminder that the Friday news dump was particularly rich today.
The NIE came out today. It said that Iraq is going to h*ll in a hand basket and that there is very little that anyone can do about it. It leapfrogged the term civil war that the Administration has so assiduously avoided. They say it looks like a civil war, only more complex. I hate to tell them but most civil wars are pretty complex affairs.
The UN Intergovernmental Panel on Climate Change released its report which for the first time tied global warming to manmade activities. While the report’s findings are serious, this is a consensus document and is a lot weaker than it could and should have been. I loved Energy Secretary Bodman’s presser where he claimed that Bush had been a real leader on the climate change issue and had spent $29 billion on research. These claims would no doubt come as a surprise to many including Bush himself. I also liked Susan Solomon’s (the US representative on the panel in Paris) response to a question about how urgent was action in the face of the report’s findings. Well, she said she was just there to report the findings not to say what should be done with them. This is a little like someone watching a 600 lb piano falling on their head and saying I know the piano is falling but it’s not up to me to say what I should do about it. Shorter version: If Bush has anything to do with this, we will all fry.
The Administration announced its $100 billion supplemental request for the wars in Iraq and Afghanistan. This is on top of the $70 billion already budgeted for in the regular appropriations process. This $100 billion is not fully included in deficit projections so the federal deficit will be larger than was stated.
What I want to know is what would this Administration do without Fridays to dump news into?

David Brooks was just on the NewsHour at his talking points best.
Point 1: The NIE says a quick pullout from Iraq will lead to greater chaos. Even though a security analyst pointed out only a few minutes previously, that the NIE did not address a phased withdrawal or how the the aftermath to withdrawal would be changed if the withdrawal was delayed by a year or two. Brooks takes the report’s quick withdrawal and spins it into any withdrawal.
Point 2: Brooks hawks his plan for a soft partition of Iraq. I believe this is called “soft” because you would have to be soft in the head to buy into it. Basically, if you could get the Iraqis to negotiate a partitition, you could just as well get them to negotiate a plan to stay together. The problem is nobody is negotiating seriously about anything.
Point 3: Bush never questioned General Casey or his strategy. This revives the narrative of Bush listening to his generals and doing what they told him. It ignores the reality that this was true only as long as they did what he wanted. The current escalation exposes the hollowness of Brooks’ narrative, which of course doesn’t stop him from recycling it again anyway.
