UPDATE: Huge thank you to the great folks at PoliticsTV. Here's our first recap for them from today.
Emptywheel and I are back at the house now. She's exhausted, and my hand may have formed into a perpetual cramp from taking notes in the courtroom. I'll be working up a summary, and doing some of the legal play-by-play (for the law wonks in the audience, hang onto your seats) — but it will be a little while before I can complete it. There's lots of good stuff to discuss.
In the meantime, the tie of the day award goes to Jeffrey Toobin of CNN — for a lovely sky blue tie with a darker grecian tile motif. Quite classy.
Here are a few tidbits from the courtroom:
– Pach got to ride up in the elevator this morning with Patrick Fitzgerald. They talked a bit about the Mets.
– I got to ride up in the elevator with Team Libby: Mrs. Libby, Scooter Libby, Ted Wells, and William Jeffress — with whom I had a conversation about the jury selection process and the "math geek" moment from yesterday. (It was a weird timing coincidence for both of us, I have to say.)
– Scooter Libby has a nervous habit with his hands — it's not quite a wringing of hands, but more of a squeezing, with a thumb caress, when he's nervous. I first noticed it early this morning when Patrick Fitzgerald was replaying tape of Libby's testimony before the grand jury, and it showed up again when he was watching Marc Grossman's testimony regarding the conversation that Grossman had with Libby after the Deputies Committee meeting wherein Grossman told Libby about Valerie wilson working for the CIA (or as Wells calls her "the wife").
– Barbara Comstock is a Chanel #5 kinda gal. Just FYI.
– David Shuster is as amusing in person as he is on KO's show. And he was also wearing a lovely chartreusey-green tie today with another tile motif. (Must be the thing in DC.)
– Because I've gotten lots of questions on this, I'm going to do the Fitz versus Wells ensemble eval.: Fitz was in a charcoal gray suit with a cerulean blue tie with a darker blue pattern woven into it. Wells was in a navy suit with a lighter pinstripe woven into the fabric, very nice cut, and a magenta tie with a darker navy diamond pattern woven into it. (There, I'm done with ties and ensembles today.)
– My favorite bit from the Wells' opening today? Scooter Libby is just a "viewer" of MSNBC calling Tim Russert and actually getting him personally on the phone to complain. Because, you know, I often just call up Tim Russert to complain about something I've seen on the news and get him to pick up the phone. Not. It had nothing, nothing at all, to do with the fact that the power of the Veep's office was behind Scooter Libby makng a call to a major national journalist to complain. Yeah…um…sure.
Much more later once I have time to comb through my notes. There is SO much going on in and around this trial, and I'm trying to figure out a way to weave it all into something coherent for you guys. But, I do think I've found something that expresses the true theme of the Libby defense: Everyone Makes Mistakes.
Also, I just got off the phone with Jane, who sounds wonderful, and we were talking shop. Whew! What an amazing day…so much more to write. And Marcy and I did an interview with PoliticsTV, which we ought to have video of this evening. I'll post a link as soon as we get it!

Ooh, that’s a tell! As a poker player, I spend more time studying the other players than the cards.
Of course, I lose a lot. Maybe I should study my cards a bit more.
But I also learn quite a bit about the player’s state of mind. The more visible stress indications (tells) you see, the more likely they’re lying (bluffing). The best time for you to watch is when a critical question is being asked.

Patient fixes hospital machine
A Bosnian hospital patient spent seven hours repairing hospital machinery so his operation could go ahead.
Doctors had told car mechanic Slobodan Mocevic, 56, his operation to remove a kidney stone was cancelled because of faulty equipment.
Mocevic asked to borrow a set of tools and then stripped down and repaired the Extracorporeal shock wave lithotripsy machine at the hospital in Kasindol.
He said: “I was in agony, and there was no way I could have waited any longer.”
The device removes kidney stones by sending a sonic wave through a patient’s body to break up the stone.

NBC Nightly News had David Gregory out the starting gate along with a clip about Russert. They didn’t get into the trial portion until the 3rd segment, nor disclose either’s involvement in the case. Imagine that.

Yes. Quite the distinguished looking fellow himself, and given his track record, a distinguished opponent for Fitz as well. Of course, Wells has got a major problem of a client, and a set of facts that isn’t looking too good either.

On throwing Rove and/or Cheney under the bus. Something is not sitting well with me on this. Is it really only about setting things up so that Wells can say Scooter was the intended fall guy? Or, is it setting things up so in the end Wells can say Fitz did not do what he needed to do and prove that Cheney made him do it? Or is there something more nefarious going on (in keeping with the history of Cheney, Rove and this admin), of setting the press and public up to think that the admin did VERY wrong, when in the end they will be shown to be only a “little” wrong. And how much is Wells here working only for Libby versus for Cheney and the admin (rememember Mary Matalin’s party’s for Scooter defense fund; she works for Cheney).
On the thumb rubbing. Lots of interesting symbolism there, massaging emotional pain, not “thumb’s up,” urge to thumb suck (but can’t obviously). The photos of Libby show a man who looks deeply worried about what is happening here.

If Irving really wanted to throw Rove under the bus, I’m thinking there would have been a bit more cooperation with Fitz rather than obstruction.
Of course, it’s not too late, Irving. I’m sure Wells has Fitz on speed dial, if there’s something you’d like to share, and Fitz would likely be understanding when it came time for making a sentencing recommendation.
Christy: I LOVE the clothes wearing part, in part because it is NOT about what “the wife” (any woman, take your pick) is wearing. And, you know these guys are dressing pretty carefully. I would be curious about whether the jury is lookig at Libby and his thumb “tell” – also, whether they are dressing in any way that might reveal something.

One thing that stuck with me from Matthews. When he harps on a point to the point of annoyance, as he did with McCain’s Bush-loyalty and attack on Cheney, I thought ‘why?’ Matthews seems to do this when he has a theory in mind but he seems too skeered to say it….so I will.

Richmond at 57 — I don’t think the jury can see the hand motion. He has them clasped in his lap, below the lip of the counsel table. I can only see it because my vantage point from the gallery was the perfect angle today to see exactly where Libby was sitting. It caught my eye, frankly, because I learned to look for that sort of thing from a defendant during testimony because that sort of tell can show you where to play up questioning. It was very interesting, because he concentrated very hard on trying to keep a sort of bemused look on his face most of the day for the jury — fairly neutral — but it would slip periodically. And you would catch jurors stealing little glances at him, off and on, as they usually do at the defendant. Very interesting stuff.

These threads are likely being monitored by both sides, to get an outside perspective on how things are being perceived. For Fitz & his crew, it’s also got to be a great place to see ideas being bounced around that may be helpful. Between the lawyers around here and the perspectives of all the non-lawyer former jurors, they’d be nuts NOT to be watching us watching them.
There was a retired Army Colonel Douglas MacGregor tearing Petraeus a new one on the NewsHour. That’s pretty unusual. The NewsHour is about as staid as it gets. MacGregor described Petraeus’s initial role in the campaign for Iraq as undistinugished, blasted his patrolling policies in Mosul which increased conflict there, ridiculed his efforts in training the Iraqi army (OK, I agree with him there), and doubted his ability to change the dynamic in Iraq (ditto) now with the escalation. I’m really surprised by this.

IMO, it’s a PR campaign. Not for the jury but for us. Minimizing and spreading blame for the crime paves the way for a pardon that (they hope) will be seen by the public as appropriate so it won’t hurt them politically.
wow- that’s the first negative review I’ve heard of Petraeus’ work in Mosul. Been all raves up till now.
But the fact that he signed on for this nonsense and helps to sell it suggests that there’s less to him than meets the eye.

2) Noticed that women in courtroom were giving me dirty looks today but I was wearing a really nice tie. Don’t know what they could be worrying their pretty little heads over. Remember to throw that tie away, just in case.

Can I just unload for second, here? This morning I received a horrible e-mail forwarded by a college friend which was simply a hate-filled, Rush-inspired rant against Muslims and anybody who is interested in protecting their rights. On the heels of this followed a religious (”Christian”) e-mail from the same person.
Then I go to the hairdresser tonight and had to listen to this lady moaning about poor old Bush, she just loves him to death and his poll numbers are just so low and how horrible if Hillary wins. We might as well just commit suicide.

Can Fitz call Rove to the stand, or is his witness list now closed? I’m thinking maybe that the Libby team know that Rove had something on them and had to make a deal to save his own skin. This would require them to tar and feather him early on. All this is predicated on the possibility that his evidence would bear on Libby’s lying.

What happens at that point is that Bush would have already appointed St. John McCain or some other flunky as vice president. Hmmm. Could Congress stall the confirmation long enough to impeach and convict Bush and remove him from office so Speaker Pelosi could become president?
My guess is that Congress would find that too bold a maneuver, flunky would become VP like Ford did, and then would become president when Bush is removed. Who will it be?

On today’s events:
Did anyone notice how Wells (via EW) was making a big deal of this idea that Wilson had said he was sent to Niger by VP’s office. My sense is that this was their (Bush admin) error or misunderstanding. But as in much of the Fox etc reporting this is the issue that is pressed supposedly to discredit Wilson. This issue seems to be particularly telling of the fact that Wells here seems to have to be defending at least 3 cases at once here: 1) Libby; 2) Libby and Cheney et al in the Wilson’s suit; 3) Libby, Cheney, & Bush in the court of public opinion. It will be hard NOT to mix those cases us. It also means he is listening to a lot of very different people (and interests) in preparing his defense and Scooter seems not to me his princpal (or even most important) client here.

The key to this trial will be Fleisher’s testimony. If Wells discredits him, scooter wins…and i think the line that will be taken is that fleisher is lying when he testified that scooter told him about wilson…and that his lies are part of the coverup to protect rove….

Never in my wildest dreams when I first stumbled onto FDL sometime around Oct 2005 did I dream that one day I’d watch ReddHedd and EW on YouTube — on the same post containing comments from Amb. Wilson.
The quality of work here is, IMHO, slowly but consistently improving the MSM. Sometime last summer, I read a news item about the fact that the NYTimes refused to print some of Rove’s comments unless he was willing to speak ‘on the record,’ and I felt the winds of change were on the way.
I have to pinch myself to believe this is really happening.

As I was searching for ANY info on todays trial, this is what the CBS News legal analyst Andrew Cohen had to say :
“The whole thing reminds me of an experience I had in law school. I was serving as a “baby” public defender and one of my “clients” was a man, already incarcerated, who was being brought up on new charges that he stole a car. “I didn’t steal that car,” he said to me. “Great,” I said. “That’s great. Can you tell me what did happen?” “You don’t understand,” he said to me, “I’m a crack dealer. I don’t do that petty car (stuff).”
That is darn close to what Libby and his lawyers are saying. He was an architect and implementer of (mostly failed) foreign policies, the defense goes, and thus did not have time, inclination or criminal state of mind to be guilty of the petty offense of perjury and obstruction of justice. We will see if Libby has better luck with this defense than my client had with his.”
Does anyone else think this is a significant shift – comparing Scooter to a crack dealer?

IMHO I think Fitz made a secret deal with Bush that he would not indict Rove:
1) If Bush agrees not to pardon Libby before, during, or after the trial even if he’s convicted.
2) Rove waives the statutes of limitations (for his alleged crimes).
3) And that the Bush administration (— especially Cheney’s office) cooperates fully throughout the trial.
Bush has literally gotten away with murder (… well, actually he still is) so why didn’t he just pardon Libby a long time ago — or why not now for that matter? The trial is far more damaging to Bush than pardoning Rove. In fact, we’ve always assumed that that’s what would happen and now we’re left to wonder what’s taking Bush so long. — Rove must be the catalyst that has imperiled Libby’s chances for a presidential pardon. Maybe this point has already been made. — But please tell me where because I need someone to validate my feelings…

I have to agree on this point. Chewing and less-than-polished dialog appeared like a half-hearted attempt and unfortunately undermines the assumption that bloggers can find a voice in other media. I do hope that they continue since their content was worth future efforts to refine presentation.
