
Now that the Libby trial is imminent, I suppose Murray Waas decided to cough up a few little treasures he's been holding on to:
While questioning Libby during grand jury testimony, prosecutors were incredulous regarding Libby's claims that he and Cheney had not discussed Plame's CIA employment during the critical July 6 to July 14 period. They also expressed skepticism that Libby had supposedly forgotten — even though Libby's own written notes indicated otherwise — that Cheney had told him that Plame worked for the CIA much earlier, on either June 11 or June 12. They were also disbelieving of Libby's claims that even though Libby and Cheney met several times every day after Wilson's July 6 column appeared, the two men did not discuss Plame during the subsequent eight days, not until Novak's column appeared. And finally, prosecutors were disbelieving when Libby claimed that he was simply passing on a rumor to Cheney that he had purportedly learned from Tim Russert that Plame was a CIA officer.
Libby even mused before the grand jury that Cheney may have scribbled his comments about Plame working for the CIA and having been involved in selecting her husband for his "pro bono" mission to Niger only after Novak's column appeared on July 14, eight days after Wilson's own column appeared in the New York Times.
Exasperated prosecutors indicated during more than one of Libby's grand jury appearances that these claims by Libby seemed implausible.
On March 5, 2004, special prosecutor Patrick Fitzgerald himself questioned Libby before the grand jury.
Asked by Fitzgerald if he recalled a conversation with Cheney during which they discussed Plame and that she sent her "husband on a junket," Libby replied:
"I don't recall the conversation until after the Novak piece. I don't recall it during the week of July 6. I recall it after the Novak…after the Novak article appeared…"
Fitzgerald then bore down on the witness: "And are you telling us under oath that from July 6th to July 14th you never discussed with Vice President Cheney whether Mr. Wilson's wife worked at the CIA?"
Libby replied: "No, no, I'm not saying that. On July 10 or 11 I learned, I thought anew, that the wife—that the reporters were telling us that the wife worked at the CIA. And I may have had a conversation with the Vice President either late on the 11th or on the 12th in which I relayed that reporters were saying that." As Libby further told it, if he discussed with Cheney that Plame was a CIA officer, he had only done so in the context of saying that the information was only an unsubstantiated rumor that he had heard from Tim Russert.
In a subsequent grand jury appearance, a skeptical prosecutor indicated that he found it hard to believe that Cheney would have written the notations he did in the margins of former Ambassador Wilson's July 6, 2003 New York Times op-ed only after Robert Novak's July 14, 2003 column appeared saying that Valerie Plame was a CIA "operative."
"OK," the prosecutor said, before asking, "And can you tell us why it would be that the Vice President read the Novak column and had questions, some of which apparently seem to be answered by the Novak column, would go back and pull out an original July 6th op-ed piece and write on that?"
"I'm not sure…," Libby answered, "He often kept these columns for awhile and keeps columns and will think on them. And I think what may have happened here is what he may have — I don't know if he wrote, he wrote the points down. He might have pulled out the column to think about the problem and written on it, but I don't know."
Libby then added: "You'll have to ask him."
Emptywheel has more on the Cheney connection. It should be interesting to watch Fitzgerald try to bring Big Time into the story.

Gotta say that as you’ve cleared your decks and turned more posting spots over to others, the quality of fdl hasn’t suffered a bit. It has widened and deepened. Good luck in DC, gang!
I really take exception to you referring to ‘DeadEye’ Dick Cheney as ‘Big Time’. That’s a ReThug frame and we need to describe this fat, greedy, vile toadie to the uber-Rich as he is:

all this “learned anew” business… running the computer lab at my school – while important to the kids and the teachers – is not the kinda thing that has national importance… 500 kids a week come through my lab… the phone never stops ringing with some classroom computer emergency or another… I am about 6 years older than God and my memory certainly doesn’t serve me like it used to… and while I may forget things/requests, a kid’s name or last week’s lesson for any particular class… I never, EVER have old information “appear” to me as if it is brand spankin’ new…

Fwiw, I don’t think there was any elaborate plan to time the speech with the trial date. I think that part was just coincidence. The rest of it though, required a lot of organization to bring together at the right time for the speech. The first expedited deployment, the staging of ships in the gulf, waiting to see the Dems first moves as new power and others but not wagging the dog…not this time anyway.

In 1992 a student at the War College wrote a paper that has circulated quietly behind the scenes in DC ever since. I find the scenario painted in the paper fascinating these days as many of the predictions made in 1992 have come to pass, and we are seemingly in a pattern in which this theory of an American military coup set in 2012 could come to pass. Maybe even in the not too distant future. With current military folks discussing backdoor coups and other chatter I have heard in recent months, I am beginnning to explore Irish citizenship issues sooner than I thought I might have to.

Listening to the statewide news on APRN (Alaska Public Radio) I heard Bradford Washburn died last Wednesday. He was 92. He was undoubtedly the USA’s cartographer emeritus. His map of Denali is the Mona Lisa of mountain charts. He was also a fine B&W wilderness photographer and had many first ascents of difficult peaks in the north. One of those people I wish I’d met.

Keep in mind this is a 14 year old paper now and much of what the paper “predicted” has occurred. Almost as if its being used as a roadmap by the neocons.

Well, the gist of the paper centers around a Chairman of the Unified Armed Services (not unlike our current command structure) that takes over the US Government after the President dies and the Vice President is convinced not to take the oath of office. The Chairman takes command of the Unified Armed Services as Commander in Chief and installs himself as Plenopotentiary of the United States.
Scary reading, basically outlines the Unified Executive theory and I wouldnt be surprised if John Yoo read this when coming up with the Unified Executive theory. Congressional staffs and other DC insiders have passed this thing around for years.

I was hoping someone knows whether Cheney could bolster Libby’s explanation of ‘the way it happened’(see below) when Cheney takes the stand at Libby’s trial. Or whether Cheney has already committed himself to a different story in front of Fitzgerald:
Libby claims (according to Waas’ 1/12/06 article) that Cheney annotated the Wilson NYT op-ed AFTER Novak’s column is published. This scenario conveniently dovetails with Libby’s lies that Libby learned of Plame from Russert and other journalists and explains how Cheney could be ’shocked’ to learn that Wilson had been sent on a “junket” by the wife.
See?! No IIPA violations here!
In fact, Cheney scribbling on Wilson’s op-ed AFTER Novak’s article is published IS more believable to me than the story that Cheney inked his marks on 7/6/03 at the time Wilson’s op-ed was published and at the time he initially read it.
Why? Not because I agree with Libby, but because we know now that Cheney and his OVP operatives were already well-versed (before 7/6/03)in the details he reveals about Wilson and Wilson’s wife in the margins of the Wilson op-ed. So what would be the point of documenting them on the newsprint itself?
Why not write talking points on an UNDATED, supersecret, plain piece of paper? Otherwise these details, which are not guessable from Wilson’s article alone, prove that Cheney and by extension Libby had advance knowledge of Plame/Wilson prior to Leak Week.
However, if Cheney contradicts Libby what is the fallout? If Cheney agrees with Libby, what is the fallout?

Because you are the power behind the goddamn throne, and the New York Times piece is the evidence that justifies you showing them that they better not mess with you. That works for me, too. Bushco, as a motivated seller of the Iraq war, does not worry about being caught, and Cheney carelessly marks up the Wilson op-ed with classified information as talking points at a point in time when Plame/Wilson are not public knowledge.
However that the annotated op-ed survived the investigation bothers me a little. Wouldn’t this same hubris enable (I presume)Bushco to disappear Cheney’s annotated copy before or even after the criminal investigation was announced? We know 12 or more hours passed between the time then AG Ashcroft warned then WH Counsel Gonzalez that an investigation would commence when Gonzalez informed the WH to preserve all materials relating to the matter. Surely there was enought time for the WH to take care of loose ends (and loose papers).
This is my thinking. I am happy to be proved wrong:
Given that Libby’s job is to protect Cheney, what better way to do so than to annotate a Wilson op-ed after learning of the criminal investigation? Yes, it’s a stupid story, as Fitz points out, but both Cheney and Libby can swear under oath it is true. Any classified information it contains was already public knowledge when Cheney wrote those words. ‘Cheney went back to the Wilson op-ed after reading the Novak article’–conveniently leaves out the fact the annotation could have occured weeks or even months after the Novak article was published. Maybe Libby hoped this annotated op-ed would force Fitz to call Cheney to the stand, then we would have been hearing about all powerfull VPs, executive privilege, separation of powers, etc.
That Fitz has declined to include Cheney in all the fun (for now) means Team Libby had to do the honors and call Cheney as a defense witness.
I do not know whether Cheney already weighed in on the timing of his annoations to the Wilson op-ed during previous discussions with Fitz. Maybe. Hope so. And I hope Fitz is allowed plenty of the other facts to disprove Libby’s self serving stories.
