
Can't quite place it, but something reeks about the NIE "declassification" story that Libby and Cheney have been spinning. And I, for one, am looking forward to some answers. Rayne reminded me in the comments about the letter that Rep. Henry Waxman sent to the Bush Administration regarding all the many reasons that all those dots fail to connect:
Two recent revelations raise grave new questions about whether you, the Vice President, and your top advisors have engaged in a systemic abuse of the national security classification process for political purposes. News accounts suggest that the White House both (1) leaked classified intelligence information to furthur its faulty case for war and (2) improperly conceled information regarding your personal knowledge of serious doubts about this intelligence. These actions appear to violate your own executive order on handling classified information and — according to a new memorandum by the Congressional Research Service — represent an unprecedented expansion of the Vice President's role in this process…
Which brings me to some thoughts that John Nichols had at The Nation:
Vice President Dick Cheney should get used to testifying under oath.It is expeacted that he will start talking soon, as part of a self-serving effort to defend a former aide. But once the vice president's done giving that testimony, how hard would it be for him to head over to Capitol Hill and respond to all the questions that members of Congress have been preparing to ask?…
Since schedules and notes — some in the vice president's own handwriting — confirm that Cheney was involved in conversations about using his office to discredit Wilson, his willingness to testify in the Libby case becomes particularly significant.
Of course, the vice president will make it his purpose to protect his former chief of staff, the loyal retainer who has been described as "Cheney's Cheney." But his openness to testifying under oath about this matter would seem to open the door for him to testify before Congress regarding the matter….
A little more than a year ago, three key members of the House — Michigan Democrat John Conyers, the incoming chair of the Judiciary Committee; California Democrat Henry Waxman, the incoming chair of the Government Reform Committee; and New York Democrat Maurice Hinchey, one of the most outspoken critics of the administration's misuse of intelligence during the period before the Iraq War began — sent a letter to the Vice President's office in which they asked the Cheney to "make yourself available to appear before Congress to explain the details and reasons for your office's involvement — and your personal involvement — in the disclosure of Valerie Wilson's identity as a Central Intelligence Agency (CIA) operative."
At the time the letter was sent, Hinchey said, "We are going to do everything we can to force this administration and this Congress to face up to the truth and to face up to their responsibility under the Constitution."…
Cheney showed little regard for Congress when Republicans were in charge of the House and Senate. And no one expects him to display any more respect for the system of checks and balances now that Democrats are in control.
But if the vice president is willing to testify in Libby's trial, then surely Congress has not just the right but the Constitutional duty to suggest that Cheney must also take questions from the Congress….
Now those are some questions that I would love to see answered. How about you guys? Because there are far too many things about this whole "the Veep said I could selectively disclose parts of a highly classified document solely for the purpose of making him and George look better, all the while continuing to lie to the American public" which just flat out reek. Is it January yet?

I know pardons are partly responsible, but need to think about the strategy of Congress investigating Plame while there is a court case going on. If memory serves, Fitz earlier told Congress to hold off while he prepared the case(s).
One of my children used to ask me to take dead squirrels off the road, because “it’s undignified” for the squirrel.
See I get sad about the death of an animal in a photograph, it’s partly why I have to be careful thinking about the war. It overwhelms.

egregious at 8 — I’m actually thinking more in terms of Fitz asking the questions of Cheney in the first instance. And then Waxman, Conyers and crew getting to them next…it’s a matter of who gets first crack at Dead-eye.
Myself, I’d like a few answers on Cheney’s energy task force. Seems to me public policy should be, well, public.
I keep hoping that someone is going to catch the presidential felons with their hands in the cookie jar AND that the press and public will notice AND that there will be some consequences- but I am becoming resolved to the idea that it may never happen….When the truth is too frightening- we ignore it.
I think we’re going to be getting a good lesson in how much this administration’s unfettered power was based on a Congress that didn’t just rubberstamp, but actively helped to suppress any information the administration didn’t want the people to know. There are limits to how much Congress can control them, but while these people may not have any personal shame, the do understand political shame, and it makes me very happy that they will be dragged out and told that they work for the people and the things they do are the people’s business, not their private dealings.
Just to make you all feel better, possums only live about two years, and they have large litters of young’uns.
Heck, yes, Dick needs to be put under oath and asked lots of questions! Like:
What part of ‘preserve and defend the Constitution’ did you not understand when you were sworn as VP? Do you understand that crossing your fingers or toes when being sworn does not invalidate that oath? Do you understand that the laws apply to you? Do you understand anything besides the misuses of power?
On Conyers, On Waxman, Onward Pelosi!! On Leahy, On Hinchey and Ambassador Wilson. And Fitz, won’t you guide our sleigh tonight! To the top of the porch, to the top of the wall. Restore our Constitution, Amendments and All!!

You can be pretty sure that Cheney won’t be answering many questions to Congress under oath. Shortly after the election, he was asked if he would be testifying at many hearings and he said that he didn’t please that Congress had the constitutional authority to compell his testimony.
I wish I had a citation for you, but it was on one of the cable news/talk shows.

On my more paranoid days (which aren’t very paranoid) I start wondering if Cheney and some of his buddies were sent do destroy any chance we might have of a peaceful future. Oooh, I hope really does try to make that stick. That BS won’t go anywhere — Congress controls the purse, and has constitutionally defined oversight responsibilities. Deadeye hasn’t a got a legal leg to stand on there.
This is the sort of thing where waiting for a subpoena is a bad idea: “I’m happy to talk to my friends on Capitol Hill at any time,” is the onliest right answer. Fighting the subpoena is worse.

Cheney won’t appear before Congress, ever. Appearing before Congress would breach the firewall he has been building around the entire Executive Branch, what with repeated but historic claims of executive privilege and the pointed demands for separate powers. If Waxman is going to make any inroads, it will have to be through criminal charges, including obstruction.
Cheney could be prosecuted right now–as Spiro T Agnew was prosecuted and forced to plead Nolo . Trouble is- who would prosecute him? Gonzalez- who sold his sould for a few years of infamy? Not likely…
Congress could declare Cheney in contempt- but then the JUSTICE dept would have to act on the declaration- and then we get back to the same piece of shit attorney general..
Given this man’s record, and specifically given his utter contempt for Congress when the Repugs were in control, he will not testify under oath to a Dem-controlled Congress. He simply won’t do it.

Cheney would not do anything like that without a huge stink. But dragging Addington and Yoo and Mary Matalin and Karl Rove and…well, you get the picture…up to the Hill so that they can sit in the chair, under oath, and take the fifth? Or lower level current and former employees who have been holding in their disgust until it has grown to a level that surpasses their ability to keep their mouths shut — or who may have a future employment incentive (i.e. working for McCain, say) which makes ratting the Bushies out potentially useful? Similar to censure – as articles of impeachment are the means available to Congress to take control, but Cheney happens to be in a really secure spot…historically speaking.
If the defense calls a witness, then they will determine the scope of the testimony..the prosecution can cross examine but only within that scope–the good news is that WITHIN that scope- the prosecution doesn’t have ta be NICE.

Congress doesn’t have it’s own police force- let alone it’s own judges…therefore- they cannot bring anyone to justice without the compliance of the executive branch..they can make lots of rules but they can’t enforce any of em.
deadissue at 44 — agreed that the odds of getting Cheney to cooperate willingly with pretty much anything Congress wants are slim to none (emphasis on the none part). But that doesn’t mean that the question ought not be asked — and publicly — as often as it can be. Because, frankly, this whole “we do things one way to suit our PR needs, and screw the rest of the country” crap needs to be called for the manipulative bullshit that it is.
Beyond that, though, I do think there is much hay to be made by shining a whole lot of sun on thsi issue. Mainly because underlings tend to fold, perhaps, especially disgruntled former underlings, where the people who are destroying their political party’s reputation systematically with failure after failure piling up might not be so inclined to open their mouths. And THAT would be worth the watching all by itself.

I agree 100% – - – the Democrats can beat Cheney to a pulp through the press once facts arise and he’s unwilling to testify. Not only will it be usefull on that level, but once the pundits get their babble motors running, the comparisons between Clinton’s impeachment and this situation will be a part of the dialogue. Ironic that perjury is the charge in Libby’s case and Clinton’s as well, as then the question will be (unless spin prevails, as has been known to happen) whether perjury on the matter of little national significance even has a place alongside the same crime as part of an effort to lie about the war.
The trick is having the guy red handed (recently published pieces in the Independent build upon what is already a significant pile of evidence) and framing it in a way that it will not get overshaddowed by a story about Katie Holmes being a robot or a “threat” to suicide bomb a NASCAR event…
This can be worked out to the dismay of Cheney, and force the comparison between what the GOP held Clinton’s feet to the fire over…

IANAL, but I have been on the stand as an expert witness. Direct testimony is (usually) a fairly friendly Q&A between the witness and the attorney. With experts (and I assume with non-experts) the attorney has certain facts that she wants to get into evidence. She asks, and you tell her what she (and opposing counsel also) already know.
Cross-examination is whole ‘nother thing. Opposing counsel wants to discredit your testimony, and if possible, you as well. She looks through the record (depositions, prior testimony under oath, previously published work …) for inconsistent statements and asks you to justify them. Because it’s not a friendly Q&A, she is allowed to ask leading questions (questions phrased in a way to force a yes/no answer) and create apparent inconsistencies that way. She is limited, though, in that she can’t probe into issues not raised in the direct testimony, unless she can show relevance to the case (to the judge’s satisfaction.) Cross-examination isn’t usually a root canal, but it would go over better with that sort of anesthesia. If you can’t cope with being called a money-grubbing whore in several languages, expert witness work is something to avoid.
I’m awaiting Redd’s letting us in on the whole low-down, though.

Ideally, there will be multiple investigations that run in tandem, and the key players will be on the hot seat every single day of the remaining two years, either preparing for questioning, being questioned, recovering from questioning, being hammered in pressers following the questioning, and then all over again in the next investigation down the hall.
I figure if we keep them busy this way, they won’t have the time or energy to f*ck up the country any more than they already have.

You can’t lead the witness on direct questioning. You CAN lead on cross-examination.
As for Congressional immunity, it’s not going to happen.
Comparisons to Iran/Contra are not entirely accurate. The Plame case ties directly to the question of whether or not Bush lied his way into a war of choice. When the Iran/Contra scandal broke, the questions were all about what happened in the past. With this scandal, the war is still going on, and the person who is refusing to bring our troops home is ultimately going to have to answer for why he sent them there in the first place. Did he lie about the pre-war intelligence? The Senate is still working on their report. I suspect the new chairman may want to make some revisions. In any case, they’ll won’t be able to contain the report much longer. There are a lot of fingers in a lot of leaks in the dike right now.

If there is anything to the 6 month provision in 13292 then it would help explain the conflict reports about the confusing classification markings on some documents in question. The one that comes to mind first is the document that was passed around AF1, possibly the same one faxed there from the WH by person unknown(?) and/or the memo requested from Ford that was compiled from mixed status documents.
The simplest observation is that the provision was done in a matter of timing that would infer intent to release sensitive info under confusing and anonymous attributions during that 6 month period.
eh,…I just want to see some accountability.

You probably know this but some people swear by the BRAT diet (Bananas, Rice, Applesauce and Toast) but my little ones usually would not cooperate. Just keep the liquids flowing to keep her hydrated (NOT fruit juice, it only makes it worse – as does anything with lots of sugar).
If you think that it is something she ate as opposed to a virus, then there is some evidence that yogurt can help to speed recovery. The “good” bacteria in yogurt helps to counteract the “bad” bacterica in the intestine causing the problems. Just again, make sure the yogurt doesn’t have too much sugar. Its usually better to buy the plain stuff and sweeten it up yourself with a little vanilla extract or even some sugar. The store bought stuff usually is too loaded up.

You could try using Kaopectate (Pepto Bismol isn’t recommended because of the possibility of Reye’s Syndrome); my kids have had no reaction to it, but it won’t stop the diarrhea immediate, works to bulk stools and slow it down.
According to everything I’ve read recently, you need to give her Pedialyte to keep the electrolytes up, as well as some active culture yogurt after the belly settles down.
Looks like the current treatmentis oral rehydration therapy (fluids and the Pedialyte) along with BRAT diet (bananas, rice, applesauce, toast-plain).
Is this an antibiotic-based problem? Poor Peanut, poor Christy.

On the subject of Fitzgerald’s cross-examination of Cheney, a scenario one can dream about is “Fitzgerald impeaches Cheney”, or more accurately impeaches Cheney’s credibility. I’ve seen depictions of trials where one lawyer objects to the opposing side seeking to damage the credibility of a witness that side has called on direct. However, in cross-examining Cheney, Fitzgerald would have the perfect right to try to question Cheney’s credibility on something he has given as direct testimony. I suspect Fitzgerald would be averse to doing that, but may find it necessary for his case.

Can’t quite place it, but something reeks about the NIE “declassification” story that Libby and Cheney have been spinning.
This is a joke, right? Surely you know that emptywheel, among others, has devoted considerable attention to Libby’s story about declassifying and leaking the NIE, with impressive results.
