
As far as I can tell, it's not making any of the big media yet, but here's the official statement from the office of Sen. Chris Dodd (D-CT):
Dodd Introduces Effective Terrorists Prosecution Act; Brings Terrorists to Justice, Honors America's Good Name
Washington- Senator Chris Dodd (D-CT), an outspoken opponent of the Military Commission Act of 2006, today introduced legislation which would amend existing law in order to have an effective process for bringing terrorists to justice. This is currently not the case under the Military Commission Act, which will be the subject of endless legal challenges. As important, the bill would also seek to ensure that U.S. servicemen and women are afforded the maximum protection of a strong international legal framework guaranteed by respect for such provisions as the Geneva Conventions and other international standards, and to restore America’s moral authority as the leader in the world in advancing the rule of law.“I take a backseat to no one when it comes to protecting this country from terrorists,” Sen. Dodd said. “But there is a right way to do this and a wrong way to do this. It’s clear the people who perpetrated these horrendous crimes against our country and our people have no moral compass and deserve to be prosecuted to the full extent of the law. But in taking away their legal rights, the rights first codified in our country’s Constitution, we’re taking away our own moral compass, as well.”The Effective Terrorists Prosecution Act:
- Restores Habeas Corpus protections to detainees
- Narrows the definition of unlawful enemy combatant to individuals who directly participate in hostilities against the United States who are not lawful combatants
- Bars information gained through coercion from being introduced as evidence in trials
- Empowers military judges to exclude hearsay evidence they deem to be unreliable
- Authorizes the US Court of Appeals for the Armed Forces to review decisions by the Military commissions
- Limits the authority of the President to interpret the meaning and application of the Geneva Conventions and makes that authority subject to congressional and judicial oversight
- Provides for expedited judicial review of the Military Commissions Act of 2006 to determine the constitutionality of its provisions
“We in Congress have our own obligation, to work in a bipartisan way to repair the damage that has been done, to protect our international reputation, to preserve our domestic traditions, and to provide a successful mechanism to improve and enhance the tools required by the global war on terror,” Dodd said.
When I posted a week ago on the "American agenda" that Democrats should pursue with their newly won control of Congress, numerous commenters wanted to know what action Pelosi, Reid, and company would take on fundamental moral issues like torture and civil liberties. I don't know when they'll schedule action on a bill like this — my coldblooded political calculation would be to do so after hearings on Guantanamo, secret CIA prisons, etc., have raised visibility and broadened the public's revulsion over the Bush regime's tactics — but this early commitment from Dodd seems like a good sign.

What a coincidence, too…I just received in the mail today a 2-page letter from Sen. Levin on S.3930 “Torture Bill”. He was clearly unhappy about it, surprised at how much detail he put into his letter.
This appears not to have been thrown together post-Nov. 7. Senator Dodd has thought this through, and I really appreciate that. I agree, it’s a good sign.
This is what we voted for. This is what our soldiers died for — until the treasonous MCA was passed…

Habeas Corpus is a fundamental right of all Americans and must be restored – should never have been threatened AND taken away. The state MUST deliver the accused to the court. Then a trial by a jury of your peers. Share the definition of habeus corpus with the unlearned so that thay may learn waht an important right we’ve lost.

Since Dodd was doing his part to help and stand with Ned, Lieberliar will find some way to try to get even. Dodd seems to be one of the good guys and we need to get his back on this.

Well. “Simple things amuse simple minds.” That’s what my Auntie says when I get silly.
I don’t think this will make it out of the Senate, and even with the next session. This, or something like it needs more of a Senate majority to pass and a Democrat at 1600 Pennsylvania Ave to sign it into law. In other words, after the 2008 election, if both of those things happen, IMO.

Sen. Dodd is making news at least here in the local CT blogs. We’re very pleased to see him take an almost adversarial position to Lieberman’s relentless warmongering.
Plus, today someone in CT changed his voter registration to the “Connecticut For Lieberman” Party, then checked with the Secretary of State’s office, found no other members (not even Lieberman), then held a meeting and voted himself chairman of the party.
You gotta love that guy!
New poll from Pew shows Clusterfuck at an all time low of 32% JAR from that poll- he was above forty just a week or two ago. Seems that losing didn’t help people’s attitude toward him.

I wanted to call your attention to an important bill that Senator Dodd proposes to introduce to reverse the egregious, anti-constitutional provisions of the Military Commissions Act (MCA). The MCA was passed by the current Congress, with Senator Lieberman inexplicably voting “yes,” and was recently signed by President Bush.
As you’ll recall, the MCA sanctioned inhumane and probably torture-like methods of interrogation, allows the President to define further permissible mistreatment methods, allows improperly obtained evidence to be introduced at trials, limits access by the accused to evidence that would be used against them, and purports to repeal the historic and Constitutional protections of habeas corpus. In addition, it provided amnesty to anyone who engaged in or authorized others to engage in methods that might be deemed torture and possibly war crimes.
The MCA stands as a huge black mark on the current Congress and Administration, and all who voted for it, including Senator Lieberman, should be held accountable for their votes. As you will see from the article below, by respected blogger Swopa at firedoglake.com, Senator Dodd’s bill would repeal the worst provisions of the MCA and restore military tribunals to the level of due process and fair treatment expected of a fair and honorable country that believes in the rule of law.
Please inform your readers about this important legislation. I hope Senator Dodd can also count on your editorial support for this bill.

Actually, this brings up the most curious thing about it. Why not wait until January 3rd to bring this up?
I’m very unhappy someone has to do this–it would have been a lot easier to preserve our rights on September 28th–but I’m glad to see Dodd is trying to make good.
I live in fear that the same people who put together the no-fly lists (40k and counting, including four congresspeople) will be in charge of rounding up enemy combatants. My mother-in-law is Chinese, and Chinese names are notoriously commonly misspelled and reversed. Heaven forbid there’s an Uigher activist named Chung Yanfung.

John Orman is a politics professor at Fairfield Unviersity who announced in 05 that he would challenge Lieberman in 06. He dropped out and along came Ned. Or so wikipedia says.
I hope your American agenda will be considered. But I must say, DLC Ellen Tauscher and her new band of “New Democrats” will probably not consider it. After all, they are centrists, not progressives, and they believe they hold the definitive interpretation of the 2006 election. According to one member of the New Democrat Coalition, ““Tuesday’s election gains came overwhelmingly from centrist Democratic candidates. These new members will join the over forty member strong House New Democrats to bring a commonsense center to Democratic policies and be critical players in passing legislation to help middle class families, keep America secure and ensure our economic competitiveness.” The quote comes from this press release, where they list the new members of the New Democrat Coalition.

Keep in mind that the Justice Department has already moved to dismiss all cases filed by detainees at Gitmo, and has also claimed that the MCA applies to persons held in US prisons, even those who were seized while legally in the US. Any immigrant, legally in the US, can be declared an enemy combatant by the President and imprisoned indefinitely without any recourse to US courts. The MCA is truly Stalinist, or like Pinochet in Chile, or as future historians will say, “like Bush in America.”

There were no meaningful hearings on the MCA, and the Administration and Senators McCain/Graham pulled a shell game trying to hide the “revised” provisions of the final bill. No amendments were allowed in the House; only five amendments were allowed in the Senate, and Reid got punked on the procedures. As Swopa suggests, this time the Dems can do extensive investigations on all the issues and really focus on what this bill does to shield the horrors. If this is done, maybe there’s a chance that Congress could override a veto.

Even now, this still takes guts, and I’m proud of Dodd. The most amazing and gratifying thing is to read this and realize it actually has a chance of passing now, even if Bush does veto it. The commenter above is right: he vetos Dodd’s bill, and the whole torture mess is his legacy until the end of time.
I was just over at C&L and I watched that awful video of the kid being tasered at UCLA. My first thought was that there are thousands of prisoners being treated just like that in Bush’s gulags, and there’s no one to video it, and no crowd to speak out in protest.

The only remotely good thing about that UCLA video was the crowd of students who defied the security guards when it became clear that they were using wildly excessive force. It looked like the situation was close to breaking out into a full-scale confrontation. It was brave of the bystanders to protest the way they did.

Members of the progressive community in CT are looking at ways to provide support for Dodd – in contrast to our total lack of support for Lieberliar.
Oh good, a senator with cojones. We need more like him, at least for this sort of thing.
The media did not say anything because it was something announced by a democrat and points up to the hollowness and nastiness of the beloved gop. It puts thier beloved Bush in a bad light.

I don’t want to go off-topic again on TRex, especially when they’re having a pretty intense discussion over there on an important subject, but I really want to try to get the word out about a new filing from Fitzgerald late 11/16 in the Libby case, that reveals what’s at stake at the moment. So I hope this late EPU in your thread, though off-topic, may be of some interest to you, if you wander back here [I also just posted this at the end of today’s Libby thread by Christy].
This is what the CIPA process (and thus the fate of the Libby case) has come down to (emphasis added), in the words of Special Counsel Fitzgerald:
There seems to be a continuance for at least one more CIPA Section 6(c) hearing, perhaps until after the Judge returns from vacation next week, but the graymail threat is coming down to the wire. The Judge will be ruling, and when he does, he will either make or break the graymail threat of dismissal of this case (prior to any government appeal). From the sound of this new government filing, Libby is now pulling out all the stops to get the case dismissed by way of a classified information graymail ruling…
The Democrats don’t take power until January. They’re going to float a few trial balloons until they take control and then come down with a hammer that Caligula Jr. in the White House won’t believe. He’ll be lucky to stay out of jail.
Dodd is also testing the waters for a presidential run! With Dodd, a wonderful senator, possibly running for president, who’s minding the store? Lieberman? Rell? Yeah right.
