Seems to me that you have to, in part, look to the impact on and consent of the parties who were protected parties or had rights under the prior legislation to see if it can retroactively be changed in a way to disadvantage them.  &lt;/p&gt;
&lt;p&gt;Part of the problem is the nature of the rights of those protected - are they real, do they have a remedy at law, or are they merely a third party to the interests of the state to bring, at its discretion, criminal prosecution against the violators of the old legislation.  &lt;/p&gt;
&lt;p&gt;It there were other freestanding grounds for recovery, I think it would be hard to take those away retroactively and but if there were no remedies but for the possiblity of criminal prosecutions, then I think it is a harder case.&lt;/p&gt;
&lt;p&gt;OTOH, if the prior remedy at law was discretionary criminal prosecution — how does Congress have the right to delve into Exec branch prosecutorial descretion to decide which cases can and cannot be brought?  &lt;/p&gt;
&lt;p&gt;I think you can kick around some intersting things, but IMO some of the better attacks may end up being the specifics of language used and the references to authorizations.  When are those going to be produced I wonder. &lt;/p&gt;

It really shows that the Republicans are all about power and will say anything to retain it.  Their only peronal value is how much plunder can they gather. &lt;p&gt;However, I think 2006 will be a vastly different experience. And thanks to Howie, Jane &amp; Christy, we’ve all had a chance to get some skin in the game all across the country. I can’t wait to see how races in Montana, VA, CO, OH, PA, etc. turn out this year. Can’t wait to watch the election results while blogging on FDL (and celebrating in Meridan).&lt;/p&gt;</description>
