
Can someone explain to me how, exactly, ABC thinks that marketing a fictional docudrama about 9/11 through the scintillating stylings of Hugh Hewitt is going to get them over the ratings hump against Monday Night Football on ESPN? As Sheldon said here yesterday:
If the goal were simply to inform the public, however, ABC would have produced an actual documentary rather than a docudrama, which gives the producers license to distort facts whenever and however they wish, while also pretending that their work is somehow a re-enactment of reality.
Sheldon documented a number of right-wing bloggers who had received copies of the film, and written reviews, and noted that left-wing bloggers were not included in the film’s publicity loop. But why did only right-wing bloggers and pundits get their hands on the unedited preview copies?
I don’t know about you guys, but it sounds to me like the people involved in making the film had an agenda — and it was not to do CYA and fact-checking on behalf of ABC. (In fact, the right-wing bloggers are already setting things up so that any changes made in the interests of historical and factual accuracy get portrayed as caving to a left-wing agenda — because, you know, "reality has a well-known liberal bias.") You tell me how and why right-wingers got their hot little hands on screeners prior to final edits being made….and I’ll tell you about setting up a backlash strategy beforehand in case you need one. Why the folks involved in making the film thought they might be on shaky enough ground to need a ratfuck strategy against ABC as insurance…well, that’s another question altogether, isn’t it?
Were I, say, on the Disney Board of Directors (ABC’s parent company), I’d be asking plenty of questions due to my fiduciary obligations to my shareholders as to just how the list of pre-screening persons was determined, by whom, mailed by whom, and so on — and why they were needed in a film that was pre-hyped as being an historical drama. Because it certainly seems to me that factual inaccuracies should be clearly labeled as "fiction" or corrected — because they ought not be allowed to claim any reationship to history if they aren’t going to portray it as accurately as possible. (Including consulting with the principals involved. See, e.g., Richard Clarke, who is ABC’s terrorism analyst for the news division and who, I am told, was not consulted regarding the film. Classy. And so much for every effort at accuracy.)
Crooks and Liars has posted a number of clips on straw man arguments made by the Bush Administration and their surrogates, but none is more painfully pathetic than the attempt to whitewash the Bush Administration’s knowledge of the threats posed by al qaeda that were known to the Bush Administration prior to 9/11 — this clip from Bob Kerrey is but one example of many from C&L. And while you are at it, check out some of these documentaries from Frontline on some of these same issues, based on interviews with real people who were actually on the scene — and which come at the issues from multiple political vantage points. Refreshing.)
9/11 happened on George Bush’s watch — and no amount of pointing fingers elsewhere changes that fact. Period.
Digby posted a YouTube yesterday of Richard Ben-Vineste’s questioning of Condi Rice during the 9/11 Commission public hearings that is well worth another viewing. Especially because the filmmakers claim the their ABC docudrama film is based, on some level, on the work of the 9/11 Commission.
Gee, can’t wait to see if they’ve included the whole, unvarnished scoop on George Bush’s reaction after reading the "Bin Laden Determined to Attack Inside the United States." PDB while on vacation in Texas before the attacks on 9/11 ever occurred, and what actions he took after reading it (or not, as the case may be).
How about you guys? Think that will be in the film? In the interest of historical accuracy and all.
I mean, I like historical fiction, I just think it is more honest when it clearly comes with the "fiction" label. Otherwise, I might be tempted to think of it as a fraudulent attempt at partisan hackery veiled in the thin veneer of Tom Kean’s tattered reputation, all tied up in a Rovian ratfuck bow. But I wouldn’t want to be accused of politicizing 9/11 or anything, now would I?
PS — For readers who are parents of children in grades 9-12, are you aware that the Scholastic Corporation has put out a teaching guide for teachers in those grades based on this ABC mini-series? You might want to discuss with your child’s social studies teacher your concerns about this mini-series, that you want your child to learn information that is factually and historically accurate, and whatever other concerns you may have about this. You might also want to contact your child’s principal and/or your local school board with concerns. As we get factual information on the movie, we’ll certainly link it up for you, but I wanted to give all of our parents a heads up that this was potentially out there for social studies classes, at least in grades 9-12.

My narrative for this is “why can’t Republicans take responsibility for their own actions?” Why should the people trust them to do anything right if they always look for someone else to blame if things go wrong?
God, if you read the drivel on the Scholastic website it says nothing about “fictionalized account” – it makes it sound like it is the definitive history of what happened, and says that it is based on the 9/11 Commission Report. I especially like the statement that the 9/11 commission was created by Congress and President Bush – are they kidding? So ABC is lying through their teeth, and they’re attempting to indoctrinate our next generation with pure propaganda. This makes me absolutely ill – it’s one thing for an adult to watch this crap on TV, but it’s another thing entirely for the media and the government to be engaging in this kind of “Hitler’s Youth” tactics. My school district will be getting a phone call from me this morning, that’s for sure!

Why are we suprised? Disney has a long history of propaganda. What did Hitler say; “Give me the children and in ten years I will give you the country.” People let their kids watch Disney because they think the violence and sex in their products are harmless. Subtle yes, harmless no. This “blame Clinton” movie is propaganda. The fact is the Republican Congress refused to give Clinton authorization to tap phones legally under FISA rules so he could stop 9/11 from happening. In this case, for evil to succeed, all it took was for evil men to do nothing.

GM: Tell us about the 9/11 miniseries you’re doing for ABC. This is the first time that a major network is tackling the subject matter of 9/11.
CN: Yes, and I’m very excited about it. It will be a six-hour miniseries that will be an objective telling of the events of 9/11. We will be connecting the facts and telling the story as it goes back to the first World Trade center bombing in 1993. It will be about how even back then, there were a lot of people who were ahead of the game, who were concerned about the threat of Islamic terrorism, and how they were treated. The series begins shooting this summer. The executive producer is Marc Platt, and I’m the writer and producer.
GM: 9/11 is a subject that Hollywood – Michael Moore excepted – has generally steered clear of. How do you feel about finally tackling it?
CN: Anything about 9/11 will be controversial – not necessarily because of a political point of view that may accompany a retelling of it, but because of the inherent nature of the subject matter. I commend ABC because they have continually asked me to be as truthful and honest as I can be. The producers have made every effort to be objective and tell the story truthfully – because that’s what the subject matter, and our audience, deserves.
GM: Now, you can’t make a miniseries about 9/11 without depicting Islamic terrorism. Has CAIR (Council on American-Islamic Relations) contacted you with concerns about this?
CN: No – but I wish them luck. I’m an Islamic-American, and I’m the writer and producer of the series! (laughs)
GM: What do you think of Michael Moore?
CN: To quote Team America, he’s an out of control socialist weasel (laughs). Listen. I’m probably more of a libertarian than a strict conservative. In my writing and directing, I don’t want to just be a conservative version of Michael Moore. I’m here to tell a good story first and foremost – and that’s why I can navigate the networks and get my work produced.
GM: What advice would you give to aspiring conservative and libertarian filmmakers?
CN: Don’t tar all of Hollywood with the far left-wing brush. There are many people who may be open to different points of view, and you should try and engage with them. If your work is honest and truthful, people will connect to it, and it will eventually be produced. Also, you can just go out and make your own project. New digital technology today is really making that possible. Just be persistent, keep writing and creating, and you will get your projects made.

ABC is not going to listen to us, but maybe we can hit them back. What if FDL starts pushing to break up media companies that already cover a market. For example a media company in the interest of not having 3 or 4 corporations brainwashing americans into facists. Would be limited to one medium in Disney’s case hypotheticaly the Chicago market could get tv the abc network, OR the disney cable channel but not both. I know the Chicago Tribune almost had to give up WGN channel 9 when they bought into the WB network, plus they had a newspaper in the market. What if we push to make the law more strict one company has one media outlet per market. Disney stock would drop JUST on the news that Democrats were pushing this so would the Fox network. Right now it seems Karl Rove says a talking point and all the MSM discuss it and repeat it its like having only one news channel. Something has to be done!
This 9/11 series is pure, GOP propaganda in the election season. The executive producuer might as well be Karl Rove.

I’m just really hoping that football wins here – this garbage is up against not only Monday Night Football on ESPN, but also against Sunday Night Football on NBC, featuring the old ABC MNF broadcast team (I think), and featuring THE marqee game of the first weekend – the Battle of the Mannings, Peyton and the Colts versus Eli and the Giants. I hope they bury ABC that first night – and then most people won’t tune in just for the second night.

to klyde at 43 – the UK versions of the HP books (I have them all) don’t have a lot of differences any more, but some of the slang is a bit Americanized in the US version. The first one, of course, had a different title (HP and the Philosopher’s Stone, which the US publisher thought American kids wouldn’t get)and more language differences.

It is very frustrating when the GOP controlled big media (Disney)use their “trust” which was developed over many years of “family television and movies” to lie to to the American people. Unfortuneately there is not much critical thinking going on in the American public right now and they are going to take this in and internalize it without out much question.

So, really now, what’s the difference between a fake documentary and the news? Or the twisted facts and agenda-driven spin we hear from the talking heads and pretty much every Republican office-holder with access to the media?
Not much, I don’t think, not much. The news doesn’t come with a disclaimer, and no news anchor that I’ve ever watched has said that what he or she is reading is their interpretation of what’s happening – most people who watch the news assume that what they are seeing and hearing is the truth. We know better, but most people don’t.
Some of this is directly attributable to the corporate interests that increasingly drive the media, with those corporate interests’ number one priority being the bottom line, and if truth and objectivity are casualties in that pursuit – oh, well – too bad, so sad.
Something tells me that the competing networks may end up doing the heavy lifting – tearing down ABC’s product as a way of improving their own ratings for those evenings; the danger there is that people may tune in just to see what the fuss is all about.
I can only hope that the few people who do watch will do so with a somewhat jaundiced eye. That a few will have a “wait a minute…that’s not what happened…” moments, and realize they are being punk’d.
ABC has heard from me, and I will be looking into who is sponsoring this propaganda.
I will be watching football – I would be doing that even if there were something else worth watching, because I love football.

You know guys, under Sarbanes-Oxely memebers of the board of Directors are personally liable if they fail to exercise oversite. The days when a Board of Directors could just be a rubber stamp for management and suffer no consequences where supposes to end when the Sarbanes-Oxely Act was passed.

I’m just not aware at this point who and what that is going to be. I’m a bit out of the loop, after an entire weekend of caring for a sick little girlie, and am trying to get back up to speed on this and a number of other issues. If I find sponsorship information, I’ll let everyone know.

I don’t know what happened on 9.11.. or rather what made it happen. I do believe rather strongly that what we were told was almost all lies. The liars (bush cheney) are not going to change their stripes and start spewing the truth. They are self serving liars and 9.11 served very nicely to accomplish many things:
An excuse to attack the ME and control it politically and preserve the USA’s access to oil and gas.
It provided the perfect cover to take away YOUR rights…. first the patriot act… then the NSA snopping… and of course you can’t even travel without being search anyone. You have to tolerate armed militia on trains, in bus depots, subways. Yet no attack or even evidence of a plot has been discovered and all the orange “alerts” were frauds.
There is growing evidence that the 7.7 Lo ndon attacks were the result of a black ops infilitrating and setting up dupes to make it appear as arab terrorism.
This is all part of a campaign to manipulate the public through fear and grow the military and their support industries.
We have entered the slippery slope to fascism here in America. When they completely shut down the press we will have arrived. Right now they only ise false stories and disinformation, manufactured news in the form of propaganda to influence people. Christy — good question about running this crap opposite Monday Night Football. But think of what market they are targeting: SOCCER-SECURITY MOMS. That’s the segment of the market that has been most likely to flee the right-wing, also most likely NOT to watch Monday Night Football. Were we on the stick, we’d have been working on finding alternative material to put on a competing channel that would appeal to this target market.
Hence the push with Scholastic; the kids will get this crap and then bug their Soccer-Security Mommas with it.
I have to hope that kids are smart like mine, although maybe more discrete; my son slipped this weekend, started yelling, LIAR!! when Bush appeared on the television. Um, doesn’t sit well with the indie/right-leaning father…

The very next thing they cover, because the coordination between ABC and the WH is SOOOOO total, is how the WH is doing the set up for their little fictional mini series (which, oddly, they manage to never directly mention).
So, what PR flacking is the WH doing for the “docudram”? Well how about this?

It’s certainly worthy of the work necessary to prodice a prosecution memo.—Hint hint any government lawyers who lurk.
Then there is also the issue of abuse of the airways. Broadcast licenses come with strings attached (though you would never know it these days-the FCC is a joke).

Also, tell Scholastic that you won’t be letting your child purchase or read the new Harry Potter book, due to the publishers bias. They’ll perk up their ears.

You are right about Clarke — odd since he is a PAID CONSULTANT TO ABC. Also, it is true — no commerical sponsorship (this is not by desire — they could not get anyone to pay). What is most troubling is that ABC is now making this into a public service undertaking — no commercials and allowing the world to download the show for free. If I had a piece of propaganda to get out to the masses for the biggest impact — I would make it free.

The best and easiest thing to do is Brand the product before it is aired. Tell whoever will listen to you that you heard that they ruined the movie by filling it up with revisions, falsehoods, made up facts and poor acting. Discourage everybody from turning to ABC on those nights.
A good place to start this project is at schools where it is easy to question why the teachers would allow revisionism in their teaching.
Naturally ABC-Disney will up the advertising budget if they get wind that there is a movement about to damage their project, but thats the point. Get them to put more money into a ruined project. They are most likely going to remember if they try to do this again in the future.
There are limited to no advertisers for this movie so this leaves us with fewer options to try to get it off the air, Like flight 93 another TV movie about flight 93, and World Trade Center this is likely to bomb especially with choice football games as competitor. But that shouldn’t stop us from leaving these producers a message about partisanship.
I really like a lot of the Disney shareholder issues brought up in comments above. If ABC spent $40 Million on something they can’t won’t realize any advertising income from, that’s massive damage to the Disney shareholders.

IIRC Good Morning America is a joint property of both News and entertainemnnt. they use the News Division’s talent, but entertainment drives the bus.

I acctually have to do work for clients today and dont ahve time (sigh) for reasearch for fun, but I have some familiarity not only with S-O, but the legislative wrangling that led up to it’s passage and I think it is worth the effort of research for someone (like shareholdrs, like the FEC, like the FCC, like theh SEC) with either standing (shareholders) or enforcement responsibilty to DO A FREAKIN PROSECUTION MEMO.
For the lay person:
A prosecution memo is an internal legal brief (civil or criminal) where you lay out the facts and law on a given thing and lay out why or why not you think you have/don’t have a prosecutable (civil or crimainal) case.
There is enough bad smell here to justify the expenditure of resources to see if there are grounds for either a civil suit or a criminal prosecution. There are just so many regulatory issues to explore.
You don’t have to have kids in school to complain. If you are a taxpayer/voter, contact your local school board – it’s your money.

I admit there is a big disconnect between how lawyers who do corposrate repsentation view S-O and how lawyers who do IPSIG (private inpector general) work view IPSIG. In the beginning RICO was applied very narrowly until the priamry author of the legislation went around the country holding seminars with Assitatn US Attorneys and taught them to see the possibilities inheren t in the legislation.
As one of the commenters of the Draft Rules proiposed under S-O, I clearly have a particular point of view.
Folks, fraud is fraud is fraud. mislabeling your product can be fraud. Claiming that something is acommercial prodcut and then airing it without commercial sponsorship, may be that. And Violation of Election Law finance reporting rules can be a form of accounting fraud.
Do I know if any kind of fraud was committed? Of course not. That takes ahrd work and digging and painstakingly putting together evdience to see if you have evidence to support eachand every element on whcih you bear the burden of proof.
I would not libel Disney or ABC by making an unfounde daccusation.
All i am saying, is there is enough of a stench here to justify doing an investigation to see if there has been a fraud.
Under Sarbanes-Oxley the Board of Directors ahs an OBLIAGTION to initiate an investigation if there exist credible information suggestiong Fraud , Waste or Abuse by management or emplyees.
Mr. Jobs and his fellow Direcotrsmight want to contemplate their obligations. lawyers representing (or hoping to represent) sherholders may want to do a little case legal research. Attorney’s in the enforecement divisions of various regulatory agencies might want to open preliminary inquiry files. That’s all I’m saying.

Also, there’s a whole diary post dedicated to the “follow-up” materials being supplied by Scholastic. I’ve e-mailed my son’s school yesterday to set up an appointment to talk to them about whether or not they will be using the Scholastic material.

If Variety’s article is true, it suggests that they pulled commercial backing out of fear that there would be blowback. :-0 I think one of the most appaling aspects in the Variety piece is the indication that huge numbers of letters were being sent to all those educators pushing this. we stopped watching television after 9/11. We don’t have cable, and the destruction of the WTC also destroyed the antenna used for broadcast television, so our reception is pretty bad now. Like most people, we watched obsessively for about two or three weeks. And at the end of September 2001, we turned off the television, even PBS [we were devoted News Hour watchers]. We started going for long walks in the evening, and reading a lot more. We’re healthier, both mentally and physically, for quitting television.
It occurs to me that Somebody might be real happy to see us FDLers all over this. Yes, it is important, but IMO a classic distraction right at the beginning of Campaign Season. Or an opening salvo? Meanwhile we all sit transfixed like monkeys trying to open a locked box. (I’m the monkey in the tin foil hat.) This needs to be addressed *quickly* and *effectively* so we don’t get whapped by whatever is next.
Hmm, Christy said it way up at the top, Disney directors s/b all over this, and looseheadprop @ 138 and Stephen Parrish, CPA @ 120 have pointed the way. I’m not a Disney director, nor yet a shareholder. So we need to detail a *smallish* team to this. I’m not a Disney director or shareholder, but must be some out there. If one of them were to set up a fund perhaps to have a nice lawyer’s letter sent, I’m sure I’d contribute and there are tons of lawyers here who could recommend someone who specializes in that area?
Also, hammering on our own school boards and letting ABC, Disney, Scholastic & Co know we aren’t buying will help.
So, lawyer’s letter, boycott, next.

After watching the clip on Bob Kerrey, and especially the one with Ben-Vineste questioning Condi Rice, I can imagine why. 9/11 is the foundation of the Neocons control of the U.S., which is why they spend so much time on it. For myself, I cannot believe WTC 7 just “happened to fall down” because it had a couple of small fires in it. There are so many wholes in the governments “conspiracy theory’ on 9/11 that any reasonable person would have trouble believing any of it. Popular Mechanics tried to recover it up but that hasn’t gone very well. Now it is ABC’s turn at the propoganda machine.

m2m, have you got a website or blog? A lot of folks have been posting great and useful stuff here, such as yourself. It would be wonderful if there was a one-stop webpage or small site where all this stuff was collected and organized by topic with links to source documents, etc. That would help everyone to have facts at their fingertips for refutations, talks w/school principals, blog comments, e-mails to ABC or whoever. We could stop by to get ammo for letters and e-mails. It would make a great antidote to the Scholastic stuff, too, if it was available for school kids — a great way to get them initiated into original research!

Pardon this long interruption, but last night, under the post on Sidney B, there was interest in the EPA’s war against eco-whistleblowers, noted in an article now up on truthout.org.
Having already written Patrick Leahy on the subject, I posted a comment and was asked to reiterate today under an active thread, so here goes. I’ll put this in words a nonlawyer can grasp.
The EPA move is important not just environmentally but for the light it throws on the “unitary executive theory,” which looks more and more like a pastiche of pretexts for a number of Bushevik aims, including to ensure secrecy, that what happens in the executive branch stays there, sort of a Las Vegas theory of the presidency.
Here’s my note to Leahy:
This morning I read the EPA response brief. It is no better than the OLC memo: it too omits to mention the No FEAR Act. Astonishing!
Here’s what’s up with the 11th Amendment: SCOTUS under Rehnquist began reading it to imply a broad state sovereign immunity that could be overridden only if Congress included certain “magic words” in its protective legislation. On this basis the Court threw out lawsuits against states.
In the present case EPA, with no constitutional leg to stand on, argued that the same standard should apply for federal agencies facing whistleblower suits. This is another bid for judicial activism by our “conservatives” who, as they say, “don’t legislate from the bench.” ;-) (Reason: They legislate from the Oval Office.)
Under Article I of the Constitution Congress can make all laws “necessary and proper” to carry out its substantive legislation. The No FEAR Act falls under this authority. EPA never discusses this detail.
The President, as we all know now, must faithfully execute what Congress enacts. As we also know, this one thinks he has a broad loophole through that detail. So I looked for a signing statement on the No FEAR Act. (They’re here.) None turned up. They’re making this up as they go along. No surprise there either.
The Las Vegas theory is gaining ground from at least two other angles:
1. The 2004 SCOTUS decision upholding Cheney’s secret Energy Task Force defeated an attempt to open the doors to the OVP.
2. Garcetti v. Ceballos, decided this May, denied employees first amendment rights for what they say as part of their jobs.
Garcetti registers the changing character of the Court. It went 5-4. Alito was in the majority. Last year O’Connor authored a 5-4 decision encouraging whistleblowers to report sex discrimination in schools.
All these moves are of course in step with other secrecy measures such as Bush’s order denying security clearance to investigators of DOJ’s back-up for warrantless wiretaps.
Apart from the secrecy aspect, this move will further demoralize professional civil servants who don’t get the Bush-Cheney religion, continuing what has already famously occurred at CIA. The same is true at the Civil Rights Division.
The face of the unitary executive is rapidly that of a chimp.
Please keep this case in your sights and try to bring it to others’ attention. I come at it with no more than constitutional common sense, and I’ve only looked at the items noted here, but it does not take much to see the outrage.

Has anyone bothered to read the Student Resource Sheets on the Scholastic Page? #1 explains uncritically that “The dictatorial government of Saddam Hussein was overthrown in 2003, following an invasion led by the United States. U.S. Government believed that Hussein had been developing weapons of mass destruction that he planned to use against America and other targets. The Iraqi government became a transitional democracy in 2004. In 2005, Iraq held its first election since Hussein’s downfall, electing Jalal Talabani president. A new constitution was written and approved later in 2005. Coalition forces still maintain a presence in the country, battling insurgents who want the United States to pull out.”
Sheet #1’s only illustrations are maps, with one notable exception: next to the map of the US is the famous photo of George Bush, bullhorn in hand, standing on the smoking grave of 2500 citizens and vowing to get the people responsible for the attacks. The picture is not captioned. The text at that point reads, “As part of the ‘War on Terror,’ President Bush has led the United States into Afghanistan and Iraq and reorganized the national government in an attempt to combat terrorist activity.”
On Sheet #2, the 9/11 Commission is described as being “created by congressional legislation and chartered by President Bush.”
That’s just a taste. So many, many lies of omission, all carefully slanted to make President Pet Goat look good.
