
At the presser following today's WalMart rally, Jane says that Joe Lieberman claimed to the press that he had returned the WalMart PAC money that he had previously received as a campaign donation in this past election cycle.
If that is so, it would require that a form be filled out and turned into the FEC regarding the change in status of the donation. And yet, there is no form that I have been able to find in the records saying that there was a return of monies of any kind.
So, I went to Maura of MyLeftNutmeg, who has been looking at this as well, to see if she'd been able to find anything that I might have missed. Just got off the phone with Maura, and she has found something intriguing:
Turns out the WalMart PAC and the FEC records show a donation TO the Lieberman campaign FROM the WalMart PAC. It's dated 2/28/06 and was a donation in the amount of $1000.00 (See FEC information from WalMart PAC here.)
But the Lieberman Campaign never recorded that donation in their FEC filings. (See Lieberman Campaign FEC Info. here.) From Maura:
If you look at Joe Lieberman's cycle summary page on the FEC web site...
Then click on the "Non-Party (PAC or other Committees)" link:
Scroll down on that page and you'll see the contribution from Wal-Mart Stores PAC For Responsible Government. You'll see the $1,000 listed there, but no refund listed there. There are other PACS on that page with negative numbers, presumably refunds.
Now back on the cycle summary page, click "FRIENDS OF JOE LIEBERMAN" toward the bottom.
On the next page, you can see the April Quarterly filing for 2006. Click the image link (the one with the numbers) or the PDF.
Joe's PAC contributions start on page 283 and end on page 318 of this filing. They correspond with line 11C of the quarterly summary. His one return of a PAC contribution is detailed on page 389 (corresponds with line 20c on quarterly summary).
There are no other documented returns of PAC contributions, but the Wal Mart receipt is never detailed, either.
So, does this mean that the Lieberman campaign received the donation and returned the check without cashing it? And if so, why? Were they trying to avoid people finding out that the WalMart had donated to them in the first place? Well, that didn't work...so why the subterfuge?
And, is this legal? Any FEC-knowledgable folks out there know the ins and outs of donation refusals and recording requirements, now's the time to weigh in, because this just looks hinky to me. But I'm no election law specialist, so if we have someone who knows what they are talking about on election filings -- or anyone that wants to do some more digging on this -- I would love it.
Also, for those of you who have been thinking about going to Connecticut this weekend to volunteer for the final push, the Lamont Campaign has put together a resource page -- office locations, travel directions, hotels, rental cars -- everything you could possibly need to know. (Our own Siun worked her butt off on this -- she's up in CT volunteering, and doing a fabu job!)
UPDATE: Well, someone's money is being put to use, anyway -- look at the Lieberman flyer offering to pay people to knock on doors for his campaign. (via Lamontblog)
UPDATE #2: Just got this via e-mail from Maura:
I just searched all of Wal-Mart PACs reports:And there's NO RECORD of getting a refund from Friends of Joe Lieberman. Refunds from PACS or federal candidates are located on Line 16 of their summary reports. I found refunds from Menendez for Congress and one other committee, but NONE from Lieberman.
Plot thickens.
Are they going to claim Joe has the unchashed check in his back pocket and just forgot about it? Or it got lost in the mail?
So, no record of a refund from the Liberman campaign back to WalMart PAC? The plot thickens, indeed.

I’m a huge Lamont fan, and committed Democrat. I think too much is being made of a $1000 donation from walmart. walmart has been critical in keeping inflation low in the US, and has been unfairly targeted by labor activists.
Ouch. My brain hurts from trying to remember how this worked. I know that there was a ton of paperwork involved to comply with FEC. I was never a treasurer of a campaign, but I helped treasury committees log some contributions if things were either really busy for them (sign of a good campaign) or really slow (sign of a baaaaaad campaign). Man, that was 26 years ago, and I definitely didn’t deal with PAC level contributions, just the Average Joes.
I seem to recall that every donation had to be recorded–who, when received, etc. Even if denied or returned for NSF. I didn’t work on any that didn’t record it all.
Or maybe I just worked on some campaigns that were unusually meticulous (*cough* HONEST *cough*) about the money issue.

Two of the four sick babies in the ICU got better and were discharged to the ward. That left space to do two operations: yippee! One was a regular newborn, the other weighed 1.5 pounds, not a misprint. The heart was the size of a grape.
Thirteen year old Boris is slightly better today, still very sick but better is an improvement over the other options. Still ask for your prayers and positive energy–thanks.
Perhaps Lieberman used the Wal-Mart donation to help remodel Katherine Harris’ house, and that’s why it never got entered in his FEC filings…
There’s about to be a blackout in my town so I can’t be on for the rest of the afternoon, but if you look at WalMartPAC’s disclosures, there are NO records of refunds from Friends of Joe Lieberman as far as I can see. Could some of you double-check my research while I have no power?

Refunds from federal candidates should be on Line 16 of their reports. They sent out the contribution in February. I see no record of refunds from Lieberman in any months up to their last (july) filing. I do see refunds from other candidates like Menendez for Senate, but not Lieberman.

To hand your opponent a loaded gun pointed at your heart is just a mistake.

I have some experience with FEC financing — in my opinion, if the LieberAccountants did not cash (deposit) the check but returned it intact to WalMart, it would not have to be reported. If it were cashed but then returned, it would have to appear on the books. If WalMart got the uncashed check back intact, it should have been so reported on their report.
Right now, there’s a $1000 WalMart check floating around, publicly unaccounted for…
I’m finding the knee-jerk reaction to the picture of Lieberman in blackface with Bill Clinton very interesting. I thought it was on point with Lieberman’s recent action with the flyer implying that Lamont is a racist and/or race opportunist. Had it been used with that post I think the ironic graphic commentary would have been clear. Perhaps the reaction is due to the fact that it didn’t fit with the post it was paired with. Context is everything.

If you think they’ve been “unfairly targeted” then obviously you wouldn’t have a problem with the contribution, but do you have a problem with the rally appearance?
It’s not the money, it’s the hypocrisy, and whether you can trust a candidate who says he supports your cause not to stab you in the back once the election is over.
Blackface brings up unbelievable amounts of racist baggage, even worse than tar baby references. While darkblack may have an artistic justification for it, it’s an abject failure. The picture is the point of discussion and not what Jane wrote. The picture is supposed to support the writing, not overshadow it.
With all apologies to Darkblack, satire is a wonderful thing, but in political campaigns satire can be thrown back at the creator.

The picture is actually on the FDL server, not the HuffPo server. When you load the HuffPo page it links to the image on the FDL site in the uploads/2006/08 directory. All you have to do is nuke the local jpg or replace it.
I totally think it would be a good idea to point out that Lieberman’s campaign is paying for lodging, food and transportation for out-of-state college Republicans to help with his primary - talk about out of touch with his base! There goes all his talk about being a ‘real Democrat’ and ‘not being GWB’
Remember the daring raid yesterday against Baalbek? Well it turns out that the 5 Hezbollah fighters captured were “low level” if that. One was a 60 year old grocer. Two others worked in construction. You have to wonder if one was picked up simply because of a sick sense of humor. Hussein Nasrallah has the same name as the head of Hezbollah although they are not related in anyway.
Well was the raid worth it? Israel’s military chief Halutz seemed to be putting the best face on it. As reported in Haaretz:

One thing is a mistake by an overzealous volunteer — mea culpas will mitigate the damage.

An image is only hosted on one place. It is not duplicated at huffpo. It “calls” it up from the FDL server. The original is in the file of images . It is easy to find in wordpress files in your server files. Just delete it for now, please!!!!!
Back to Wal-Mart - their PAC chairperson certainly should know whether (1) the check was ever cashed, and (2) if it was cashed, whether they have a record of receiving a refund.
On the HuffPo front - the whole thing makes me queasy. I understand darkblack’s rationale, but nothing that is out there at this point should need that much explantion in order to put people at ease. At this stage, everything is res ipsa loquitur.

I think that floating check scenario is exactly why most of the campaigns I worked on recorded everything they received, even if they refused it–just to prevent any chance that the money wasn’t going where it was supposed to.
But also like I said, I worked on a lot of idealistic campaigns. We couldn’t have one whisper of anything hinky about the money, because the media would have pounced on it. They really don’t like do-gooder campaigns, you know.

Since nobody seems to have stated the bloody obvious, I will. The Lieberman campaign got the Wal-Mart check but decided to hold onto it and not report it until they could see how the winds blew. Maybe they forgot about it, or maybe they held it to see if he was going to win nomination easily, and cash it then. If not, they’d hold it until after the primary. But WalMart reported it.
I want to guys to know that if stupid, insensitive, stupid graphic damages the campaign in any way, this blog and Jane will never recover. You will take the blame, and deservedly so.
The image should be removed and a disclaimer and apology posted ASAP. Jane may also need to back away from the campaign.

Do keep in mind that it is standard operating procedure for the GOP to find anything—anything—with which to create faux outrage and derail their opponents. This picture was an easy thing for them to use, but it would be something else. Overreacting will make the GOP slime work better. Stop talking about this stupid mistake and keep to the issues.

I’m not an American.. so I’m not familar enough with the historical background on why this image is causing people to fret so much on here (though I am sure it will be explained to me).
I would state however as I did on the last thread that I think DarkBlack should at the very least go over to the HuffPo thread and explain his reasons for using the photo (I’m presuming Darkblack is also African-American which is why he posted this photo to display his strong feelings on the topic).

Look. We are all human and we make mistakes. I am not blaming Jane or Christy or anyone. What I am saying that when a mistake is made, it is always best to act fast to minimize the damage.
Not talking about a problem doesn’t make it go away. Smart strategy is to identify a problem and address or neutralize it stat.
