I don’t know what to make of the fact that people aren’t showing up for Lieberman’s events. It’s kinda eerie-I recall when Kerry ran for President in ‘04, crowds of 200,000+ would be enthusiastically cheering for him, while Bush could only manage to assemble a handful of carefully screened loyalists. But somehow Bush ended up with more votes. Hmmmm…..

Russell Tice, an important source for the Pulitzer Prize-winning New York Times report by James Risen and Eric Lichtblau on the NSA’s warrentless eavesdropping activities, was served papers by two FBI agents outside his home on Wednesday, July 26th. Tice must appear in court on August 2nd “to testify and answer questions concerning possible violations of federal criminal law.”

In a statement issued by the National Security Whistleblowers Coalition, of which Tice is a member, he declared “This latest action by the government is designed only for one purpose: to ensure that people who witness criminal action being committed by the government are intimidated into remaining silent.”

The NSWBC also accused the government of trying to use this subpoena to prevent Tice from being able to publicly confirm the existence of the controversial NSA program. The lack of reliable public information on the NSA wiretapping effort has been used to bolster the “state secrets” defense in a number of cases filed against the government by civil liberties organizations and other groups.

If Ned wins, they are going to have to re-think that strategy. If Holy joe wins, it’s going to get ugly.

Does it have a chance to work in court? And what the whole dang this is about. Tice says he is reporting illegal activity. Is where there pedel hits the metal the rubber rips the road on whether Preznit’s whim on what’s legal in A Time of War is the law of the land?

I don’t know any answers about Tice. I do know that when the “terrorist surveillance program” aka “*the* program the President has acknowledged” came out, Tice was very clear that his information dealt with some other aspect. I don’t know timeline for his statements and the telecom stuff though, or if he has said anything vis a vis that program – so I don’t know if his info is tied to that or not.

DOJ is going gangbusters to terrify and intimidate whistleblowers and journalists right now. They have been conducting interviews of members of Congress who were briefed on the programs about the leaks. There are pretty clearly other things that we still don’t know about and they want to do everything they can to suppress information about more illegal activity — an interesting, and no longer novel, role for DOJ.

It does all revolve and devolve on the Presidential authorization to break the law trumping the actual law under DOJ’s marching orders. I don’t buy for an instant that you can classify or claim state’s secrets in illegal actvities. The fact that they have been getting the courts to go along so far – Arar, el-Masri, and Kennelly – just makes the headache worse.

I’d like to see how, though, they begin the waltz on this. One thing Gov has been doing over and over in their pending cases where they are alleging state secrets is citing cases that stand for the proposition that if Gov is going to claim state secrets, it can’t use that info in a criminal prosecution either.

We don’t really have any credible DOJ under Gonzales & Co. I know I go back to it too much, but I still can’t believe we are at the place now when judges at the Dist and Appellate court levels, even very conservative judges, openly challenge the crediblity and veracity of DOJ bc it has stooped so low so often.

So we are seeing wholesale public obliteration of any rights or protections whatsoever. Tice, Greenhouse, Rowley, Sibel Edmonds……

Another question for Lieberman: I read an article in Haaretz today that says the US expects Israel to go in kick Hezbollah out of Lebanon in order to fulfill the UN resolution. Unilaterally by force. The US will help by sending military gizoms. Please explain how this makes the US a great friend of Israel, and how it will strengthen both countries’ positions in the Middle East. Espcially since Israel is running into unexpected problems kicking out Hezbollah, and Israeli popular support is faltering?

Also explain in detail how this kind of attitude makes the War Leader a Great and Accomplished Leader, worth following out of disgusting and unssatisfactory manged calm and into explosive Birth-Pangs of the dawning of a New Era of Freedom? Eli: I am into urban exploration big time. I went to NYC this summer and wanted to go on an urban tour in the unused sections of the subways but I had a hard time hooking up with the guy while I was there. They have some pretty good tours going but I guess I picked a bad week. I do it a lot here but its such a small town and not much to see. Your pictures are really nice. Especially the torn poster. I like that one a lot.

Eli: Also, check out the blogroll there. You will get lost for hours, so be prepared. It is named Satan’s Laundromat because the guy lives in NYC over a laundromat and the number of the building is 666. He has freat stuff. Forgotten New York is good at the blogroll-especially the gargoyles. Okay, that’s it, I swear.

Earlier, Tweety had the Gilmore Guy and Some Dem Consultant on at the end of Hardball; he kept asking Some DemCon why “the Democrats can’t have two or three issues to focus on?” Some DemCon replied that he’d just given Tweety two or three (he had). Tweety said, “Dems have these long lists, why can’t they narrow it down to two or three, why did it have to be Six or Eight?”

At that point I threw things at the teevee yelling, “Because everything’s so fucked up, Tweety, we have to fix all of it.“

There are straighforward answers to all of their talking points; why can’t the Some DemCons just talk back? Was he only prepared for the earlier part of the question, when Tweety asked “why the Dems don’t have an Iraq policy?”

Don’t the DemCons understand that in Tweety’s world, All Things Are Good For Bush, and therefore we have to be able to counter BOTH arguments?

On WTNH news tonight (local CT ABC affiliate) they said that since May, 6000 Independents had changed affiliation, but pointed out that some of them may have changed to Republican (can’t imagine why anyone would bother with that, though).

There’s also a poll on their web site (wtnh.com) asking if you planned to vote in the primary. Right now it’s 45% yes, 55% no. But who knows how many people, let alone how many Repubs have voted in the poll.

I worry that people are going to start resenting the kiss float. Just as I read this blog I got a little resentful my self and I can’t stand Joe Lieberman.
Be careful, maybe give it a few days rest – so that people will start to ask where it is.

C’mon let’s not kid ourselves. A lot of folks will vote for Joe, but do not feel the need to show up to primary events. I hope the guy loses and I also hope he will drop an independent run for office as well. Ned still has his work cut out for him to win the Democratic slot on the ballot.

“In my city, Lieberman’s canvassers have been out EVERY DAY knocking on doors and asking for votes. They’re organized, they’re efficient, they’re well paid (for canvassers, anyway), and they make an impact. No matter what anyone says when they scoff at paid canvassers versus volunteers, paid staff show up. Paid staff are organized. And ultimately, the old lady who opens the door never asks if people are paid — she just remembers which campaign personally asked for her vote.

We underestimate the strength of the Lieberman campaign at our nation’s peril. Seriously.”

Ned has to get a comparable operation running RIGHT NOW or he may as well concede tomorrow and gl get some sleep. Computer generated postcards are not going to do it. He needs feet on the ground.

Make sure you escape from the Lamont halo of assured victory every once and a while and mingle with some CT folks. Energy and enthusiam are great but they are not votes otherwise Howard Dean would be president. When I was volunteering in NH in 04 I would have bet the farm Dean was going to be the next president and,given the right odds, the second coming.

Brian Lehrer tried hard to get Ned to say something incriminating about Israel yesterday, but Ned would not bite.
