
Morning all. We had some storm problems halfway through my writing the Hamdan article last night -- and I'm just able to get back on the computer in the last five minutes or so, so it's going to take me a little longer to get the first installment up and readable. But I wanted to let everyone know that I'm working on it and give you a fresh thread.
In the meantime, Howie Klein sent me an update on his Blue America series for tomorrow that I thought would be of interest to a lot of folks here:
This week's BLUE AMERICA (like every week, Saturdays at 2:00 pm East Coast time/11:00 am West Coast time) will feature a very special guest, John Laesch, the progressive fighting Dem who is taking on the Speaker of the House and the kingpin of the Republican Culture of Corruption, Denny Hastert. John will be taking some time out of his grassroots effort to sit down and answer questions live from FireDogLake community members. John is an independent-minded candidate and not a shill for the Big Business interests that completely control the Republicans (especially Hastert) and control more Democrats than is healthy for working and middle class America. John is a perfect example of the kind of candidate who is not someone who is "just better than the other guy." John is the kind of man who will help clean up the horrible mess that the Bush Regime in leaving behind and the kind of man who will move our country forward and make it a better place for us all.
Hope you can join us for Blue America tomorrow -- it's going to be a great chat, and as always with Howie's posts, I'm sure we'll all learn a lot about this race.

UPDATE: SCOTUSblog has this announcement posted, and I thought it would be of interest to everyone: "The Georgetown Law Center will be hosting at noon today a faculty discussion on Hamdan, featuring Neal Katyal, Mark Tushnet, Carlos Vazquez, and David Luban. It will be held at the law school, 12th Floor of the Gewirz building. C-SPAN will carry it live." Talk about your must see TeeVee -- that sounds like an intriguing faculty discussion, doesn't it?

All three men see chaotic explosions of violence. But the Guard gets stuck with some mundane details, too. Bazzi watches the dumping of a septic tank, for instance. And a lot of time is spent escorting and baby - sitting supply trucks for the Halliburton construction subsidiary, Kellogg, Brown, & Root, whose monopoly on the region and the war is farcical.

As a matter of stir craziness or real fanaticism, he advocates nuking the country. But like a number of troops who show up in the footage, Moriarty turns cynical and increasingly disillusioned about the point of being in Iraq. They suspect that it’s more about oil than any freedom.
While the men headed to the Middle East, Scranton stayed in New England and interviewed the women they left behind: Moriarty’s wife, Pink’s girlfriend, and Bazzi’s mother. They give the film emotional counterweight, helping us to better understand their men — especially Moriarty, whose rah-rah attitude starts to make a different kind of sense.
Before he left, his job as a forklift operator was eliminated. In the meantime, he took care of his kids while his wife went to work, and during his deployment, in his instant messages to her, you get the sense that this tour in Iraq is really redemptive for him. Shrewdly, Scranton sticks around for the homecoming, so we can see how the war ends up leaving Moriarty at a loss in civilian life.”…

Some thoughts on Hamdan.
The constitutional law is one thing. How it all plays politically is another thing.
This morning’s WaPo includes this analysis:
Now the Supreme Court has struck at the core of his presidency and dismissed the notion that the president alone can determine how to defend the country. In rejecting Bush’s military tribunals for terrorism suspects, the high court ruled that even a wartime commander in chief must govern within constitutional confines significantly tighter than this president has believed appropriate.

That’s true as constitutional analysis. Will it prove to be true as political analysis? In other words, how will political Washington and the President himself react?
Some hint is given by Tony Snow, the President’s spokesman, in the same article:
Snow later disagreed that the ruling undercut Bush’s authority. “I don’t think it weakens the president’s hand, and it certainly doesn’t change the way in which we move as aggressively as possible to try to cut off terrorists before they can strike again,” he said.
This is the old declare-victory-even-when-you-lose approach, and it often works. It means two things: first, the President is not likely to respect the broader meaning of the Court’s ruling; second, he is rallying his Republican allies with a signal not to respect it either.
If the President says that the ruling changes nothing, and the American people do not pressure him to change how he governs, then nothing will change.
Let’s let Supreme Court Justice Stephen Breyer, in a 2003 Boston College commencement address, tell us the story of President Andrew Jackson:
In 1832 the Cherokee Indian tribe lived on land guaranteed them by treaty. They found gold on that land. Georgia tried to seize the land. The Cherokees sued. And eventually the Supreme Court, in Worcester v. Georgia, held in favor of the Cherokees. Georgia then refused to obey the Court. President Andrew Jackson reportedly said, “John Marshall has made his decision; now let him enforce it.” And Jackson sent troops to evict the Cherokees, who traveled the Trail of Tears to Oklahoma, thousands dying along the way.
Justice Breyer was sanguine in his 2003 speech that, 200 years later, “that losers as well as winners will abide by the result, and so will the public.”
In his concurring opinion in Hamdan, Justice Breyer again expressed his faith, believing that if President Bush wants the power to use military tribunals, he will go to Congress to seek it: “The Constitution places its faith in those democratic means. Our Court today simply does the same.”
We will now learn whether that placement of faith is justified.
The statement by Tony Snow suggests that it is not. We can, instead, expect the President to act as if his power is not impaired by this decision.
And that will be the greatest tragedy for our democracy.

We’re going to start the South Beach diet soon — I need to take off some weight due to my arthritis issues, which can be tough when any substantial exercise exacerbates the problems. So we are trying to tweak diet to start with and I’m going to try doing some regular yoga and see if the stretching and muscle toning help.

Now here is a serious thought, however: in a footnote J. Stevens cited the famous Youngstown Sheet & Tube decision, and even the dissenters cited it. Does this foretell the legal demise of the illegal NSA wiretap program? (I think so…)

Christy about yoga and arthritis, I have RA and I find yoga to be a great exercise that does not impact my joints. Personally I like the DVDs that Rodney Yee outs out. There’s a good DVD called AM/PM Yoga that he guides you through a very simple session for the AM part. It was a great introduction for me being a novice.
Also I use Yoga for Strenght, another of his DVDs.
Between that and walking it’s helped me physically. I also had success with swimming.

I tried South Beach, it did not work wel at all. And all the reliance of artificial sweetners set up massive cravings. When I gave it up, I had a horrible 10 sugar binge (not a healthy thing for a hypoglycemic) and wound with a net gain of 5 lbs.
Trying the Sonoma diet right now b/c it sounded like my normal summer food cravings (salads fruit protein grilled on the bbq).
I was a little wary of putting grain in my diet (hypoglycemis kinda need to eat like diabetics) but I have been doing so sparingly (they want you to eat only whole grains) and have given up diet coke.
Those who knew me from my prsecuting days would fal down in shock to learn that I have gone from a minimum of 2 liters a day of diet coke and quit cold turkey.
I have almost eliminated all artificial sweetner. I have been using 1/2 teaspoon og honey per big soupbowl of coffee and eliminated all sweetes (except a tiny bt of chocolate at night–my only cheating)
I have only relost the extra 5 lbs in 2 weeks of dieting, but the side benefits are amazing
I have moster energy during the day. My productivity has virtually doubled. I am going to bed early for the first time in my life and REALLY REALLy sleeping (I have been a nightowl/insomniac literally since birth)
And my wrinkles are fading. My “botox frown” wrinkles are noticably better. My mother asked me yesterday if I had “something done”
It’s all summer type food. And it’s hard to eat it all in a single day. It feels like I am constantly stuffing my face (most days I don’t get it all in) the cravings are gone, so cheating (except the choclate–A girl’s gotta live doesn’t she?) is really not an issue
It’s jsut not a quick fix, this seems to be slow steady weight loss (it’s only been two weeks, let’s see if it peteres out). there was an article in some Women’s magazine about how you can stick this dit=et while eating fast food (I ‘m not a big fast food person, but I will see if I can find the article).
So much for Roberts’ goal of unanimity, tsk tsk. Slapped down by his own Associates, first big chance they get. I’d love to hear O’Connor’s reaction — if anyone gets wind of that, please share, okay?

Re health, I got turned in the right direction by walking a half hour a day in the park, pilates once a week for developing core strength, and eating more protein and less starchy stuff. People tell me I look great, what can I say.

Christy, I’m a fan of pilates. You can try the tapes that don’t require equipment and are floor exercises.
Spork at 36 and Squirrel Hiller at 67 — we’ve spent a lot of time in and out of Pittsburgh, especially in the last year with trips to the zoo. :) But with the peanut in tow, lately it’s been all about being near a mall with a kiddie play area — South Hills Village or Robinson Town Center — that also has a proximate good book store. As she gets older, we’ll be able to get back to regular Pittsburgh visits with more fun stuff like baseball games and thai food and such, but for now, giving her space to play and wear herself out so momma and dad can have some book store time is a huge plus. (And everyone in the book store appreciates it, too.)

Re exercise: Just found myself a book called MEGAYOGA (Megan Garcia, DK pbk, $15, ISBN 0-7566-1947-5). Lots of advice on modifying the traditional poses to compensate for extra flesh, weak joints, and the other flaws that female-in-particular flesh is heir to. First yoga manual I’ve found that doesn’t start with the attitude, implicit or explicit, that “If you can’t manage postures invented by slender males, go lose weight or get stronger and THEN come back here”…

I just saw your artwork on this post and was caught by surprise (pleasantly). The artist who created that famous Hilda series is a man by the name of Duane Bryers. He lives in the Tucson, Arizona area.
Ironically, since this is a political blog, his daughter is running for Congress in my district. It is rated the 3rd hottest race in the country with a heavily contested primary. Her name is Patty Weiss. She does her own blog on her website and started to blog on DailyKos too. I am very enthusiastically supporting her. A progressive woman, with great integrity, who is working her butt off on this campaign.
Since this is end of the quarter, I guess I should put in a plug for donations to her campaign.
Maybe you can do a blog interview with her sometime? She really enjoys working with the netroots and how creative people have been in using the technology.
