How about looking at the bright side — no matter what happens with Libby and Rove and everyone else involved, the entire Administration has been exposed as being a bunch of vengeful liars whose word can’t be trusted.  And not just with liberals, but with a lot of conservatives as well.  And Dick Cheney’s hand is all over it, just like his handwriting on the Wilson op-ed.  How about that just for starters?&lt;/p&gt;</description>

		<description>&lt;p&gt;The very first post I ever read on FDL and probably one of the first on the Libby indictment said that this trial will never take place. Cheney’s statement last week saying he would probably testify at the trial was probably a good a sign as any that it won’t.&lt;/p&gt;
&lt;p&gt;The pardon can come at any moment. I suppose it will be after the election. Not that it makes any difference. If there are 100 voters in the entire nation who would change their vote because of a pardon I’ll eat my hat. &lt;/p&gt;
&lt;p&gt;It’s silly for me a nobody to be so sure I know. I wonder what Fitz thinks. I wonder  if and how that figures into his own functional pardon of Rove&gt;&lt;/p&gt;</description>

&lt;p&gt;I have only made my way through about 20 percent of the Hamdan decision, and I refer back to all of my other caveats stated earlier.  Certainly I defer to anyone who has read the entire decision.  And I respect what BarbaraB says.  With regard to your specific question, it does not appear to me to really be about whether Hamdan is an enemy combatant or a POW.  It has more to do with the president’s limited powers to use military commissions, and what limitations exist on the jurisdiction and powers of those commissions.  It finds the terms that created the commission in Hamdan’s case to be insufficient to provide all legal safeguards that are applicable.  BarbaraB?&lt;/p&gt;</description>

&lt;p&gt;Re: Bush/Hamdan - still think that every time it comes up and the GOP tries duck and dodge and “we need new laws” they should be NAILED with the fact that if Bush had not broken the laws set forth in both the Geneva Convetions, UCMJ, and War Crimes Act, there was nothing to keep military trials from going forward from the get-go. A refusal to follow law, and a refusal to conduct even UNLAWFUL tribunals until after years of detention charges, is the only reason that the GITMO situation is not already resolved and if Congress buys into the canard of illegal proceedings and delay, when legal proceedings and expedited resolution are available, they are putting us all at risk.&lt;/p&gt;

And for all the Repugs want to be seen as “strong” and to paint the Dems as “weak,” there were only 8 Senators, IIRC, willing to vote in favor of torture.  It still amazes me that there were that many.  My best guess is a lot of sound and fury for a bit but nothing much in the way of imminent legislation — but my crystal ball isn’t great at predicting the course of insanity.&lt;/p&gt;</description>
