
If I had to bet, I’d say that Roy Black is in a foul mood this morning. Nothing like cutting a sweet deal for a client and then having them screw it up within three months: it makes you look bad as an attorney because you’ve made representations about your client’s willingness to atone and move forward that…well, were pretty much full of hot air and crap; it pisses off the prosecutor, the judge and the probation officer, whose time has been wasted on the sweet deal that your client had no intention of following; and it sours your ability to negotiate further plea deals for other clients in the future, because your word is not really so bond-worthy any longer.
In short, whatever you thought your client might be capable of, he allegedly just pissed it all away for some drugs and a junket to the Carribbean. I used to get pissed at clients who went into the pool hall across from the Courthouse and ordered a drink (morons, there was always a cop in there waiting on a to go lunch order, ready to snag any wayward probationers) – I can only imagine the crabby day that Roy Black is having today.
Which leads us right back to Rush’s pee deal:
Rush Limbaugh must pass random drug tests for the next 18 months to satisfy an agreement filed Monday that will lead to dismissal of a prescription fraud charge if he stays out of trouble.
The conservative commentator also must continue treatment for his addiction and cannot own a gun, according to details of the deal made public Monday. And the agreement says he "will refrain from any violation of any law."
Just so we are clear, in every jurisdiction that I know of, getting your drug prescriptions in someone else’s name is not legal.
That goes double when you are on probation supervision: in order to accurately assess the urine samples, probation officers have to have on file a copy of every prescription — drug name, dosage, frequency, etc. — to send to the company that does the chemistry profiles and testing on the urine screen. If the person under supervision tries to circumvent that process by getting prescriptions in someone else’s name, well that doesn’t provide adequate information for purposes of assessment — and it’s a violation of the supervision requirements, let alone a whole new set of legal violations. (Unless, of course, Rush informed the probation office that he intended to break the law by having prescriptions written in someone else’s name. Which would be highly unlikely…)

Rush Limbaugh doesn’t learn. After all his trouble with his doctor shopping case, and his being under a deferred prosecution, he asks his doctors to put his viagra script in their name instead of his "for privacy purposes." Today he was detained at the Palm Beach Airport for three hours when a search of his luggage uncovered them.
For privacy? That sure worked out well, didn’t it. Now, instead of just a pharmacist learning he takes the drug, the whole world knows.
What will happen to him? The matter has been referred to prosecutors. Possessing drugs without a proper prescription can be a class two misdemeanor. It could revoke his deal.
It’s going to depend on how many different types of drugs he had that didn’t have a proper prescription. And it’s going to depend a lot on the type of prosecutor, judge and probation officer Rush is dealing with in Palm Beach County. But I can tell you from my perspective, that this sort of casual flouting of the law in our jurisdiction would certainly result in at least a month’s revocation of the probationary period — and a definite revocation of the deferred prosecution sweetheart deal.
If Rush couldn’t make it three months without violating the law and the terms and conditions of his probation, then there is no reason to suspect that he’ll make it the rest of the 18 months without either in-house substance abuse treatment at a program selected by the probation officer — to be paid for by the defendant out of pocket — or some other more harsh method of "attitude adjustment," like incarceration for a discrete period to get his attention.
You know, just like any other person on the planet would have to do. Guess we’ll see…
Oh, and the doctors who wrote out the scrips? They could be in some deep doo doo as well, depending on the regs in Florida. In a lot of jurisdictions, writing out scrips in your own name when you aren’t the one taking the drugs is a big, fat no no. Even for your client’s privacy purposes. Guess we’ll see on that one, too.

Much like Barry Bonds created controversy by putting up huge numbers at an advanced age, Limbaugh’s situation just feels wrong. Limbaugh is 55, smokes cigars, has a thing for pills, and has had weight issues. He has no business being sexually active, and only raises false expectations in his fans when its alluded to that he’s having Viagra-enhanced sex.

But this is not about Limbaugh. No, it’s about the growing threat of performance-enhancing drugs that deluge us daily. It’s about a reality that is becoming more and more unreal, and it’s threatening to change us all.

Blank Kludge at 24 — that’s exactly right. You sign off on a deal, part of that deal is that you agree to a certain amount of supervision with regard to alcohol and drug consumption. You get value in return for that — reduced sentence, probation instead of jail time, etc. — but you have to live up to your end of the bargain. It’s going to be interesting to see how Rush is treated in this…and if anyone lives in and around Palm Beach County and has any insights on what is going on with this, I’d love to hear about it. Let’s see, this is in Florida where Jeb Bush’s three delinquient kids have been given break after break after their serious run-in’s with the law (especially daughter Noelle)and don’t forget how many chances were given to Daryl Strawberry (NY Mets/Yankees former star player) with his numerous probation violations in Tampa-I hope I am a wrong cynic but given the trend nothing will happen to Limbaugh because of this.

Why do you think they searched him? Was it a random pick? Did someone tip ‘em off? Or is it SOP for guys who are subject to a plea agreement?
Millinaryman at 29 — at the time of the plea deal, I recall someone in the comments talking about the chief probation officer in that jurisdiction as being a stickler for the rules and regs being followed (as are most probation officers with whom I have worked through the years, btw). So, we’ll see — Roy Black is an exceptional defense attorney, but lying about prescriptions when your initial offense was doctor shopping for drugs…well, that becomes awfully difficult to argue away to a judge if that judge is a law and order type.

I could be wrong about this since I only deal with physicians in Florida at the resident level, but I don’t think physicians can prescribe for themselves at all. Which means that Rush’s doctor would have had to ask a colleague to write the prescription, then pass the pills to Rush. That’s a scenario I could easily see happening, especially with a Viagra prescription, and the colleague that wrote the prescription wouldn’t necessarily suspect he/she was doing something shady. A very convoluted system, and the Florida Board of Medicine would probably say that the practice falls on the wrong side of the ethical net.

So the crime itself necessarily implicates special status and treatment. If I were a Public Defender in West Palm Beach (I was in Miami, I know a bunch of those folks up the road) — I would certainly be raising hell about my clients’ probation violations for possession of perscription meds ….

I have to seriously question whether Rush Limbaugh is being required for follow the standard rules that ordinary Citizens (particularly non-white Citizens) have to follow when they run afoul of the law. The political pressure that I suspect was brought to bear to derail any significant felony prosecution must have been immense; it wouldn’t surprise me if Cheny and his staff of vulcans had been directly involved. The Radical party _cannot_ allow their primary mouthpiece to go off the air before 2009.

The big item in your post, Christy, is the last paragraph. Sure, Rush might be a big celebrity with a big celebrity lawyer, but those doctors are between a rock and a hard place. Putting the wrong names on prescriptions is a fast way to lose your cute little prescription pad, at the very least.
I wouldn’t think that the doc is going to slide on this one, and if so, I can’t imagine that the doc will end up with harsher penalties than Rush. Wouldn’t want to be the prosecutor that slams the doc but lets the drug abuser walk. Not in Florida.

The day after Rush got his no-jail deal, I read that he said on his show, “It’s over. I won. End of story.” (Not sure about the precision of the last phrase, but that was the gist of it.
I thought at the time that the prosecution might not think much of that characterization.

and your little dog too at 54 — well, I can tell you that it would color mine. And I’d sure be bringing that gem of a quote into court with me to argue for revocation of the deal and a period of incarceration, were I the prosecutor…
What I do not understand is why anyone would think that a guy with Rush’s history would stand any reasonable chance of holding up his end of the deal. Roy Black, in my opinion, should not have been swayed by the BS, which was no doubt BS to the nth degree. And Christy – and anyone else who has dealt with someone with his kind of history – can tell you that addicts are masters of manipulation. They will look you in the eye and swear on all that is holy that they will never do “this” again, will sign whatever you want, will promise whatever you want – as long as it keeps them out of jail. They probably mean it at the time they say it, but put them back in the environment where the abuse occurred, and it’s only a matter of time before the addict slides.
Someone like Limbaugh stands no chance at overcoming his addictions if left to his own devices without treatment.
And no one is doing Limbaugh any favors by trying to keep him out of jail or out of treatment.
If a physician wanted a drug but couldn’t write a prescription for himself, wouldn’t he just pocket some of the samples the drug reps leave with him?
Seems like he wouldn’t really need to get a colleague to write a prescription for him.
I’ve been following this story closely all morning, and let me say how incredible it is that Kos was able to hide those drugs in Rush’s bag. Jesus, it’s like the guy’s omnipotent or something.

I remember when Rush’s deal was announced and voiced my concern that this was gonna be hard for Rush. It is difficult for any addict to change without a recovery program. The drug screen and probation are often part of that program. The issue is the favored treatment he will most likely be afforded, even though he has clearly broken the terms of his probation agreement.
The rate of recidivism is extremely high for addicts. Most poor addicts who break their “sweetheart” deal find themselves suffering the consequence…jail, prison, institutions and ultimately death. Rush will probably skate from the first three because of his privilege.
Bottom line- you can never be a cucumber again once you become a pickle. An addict will always be an addict. The recovering addict usually embraces openness, honesty and humility to change their behavior.
Rush seems, bases on the current picadillo, to exhibit absolutely none of the prescribed openess, honesty or humility.
But I’m guessing he’ll skate anyway.
I’m looking at this a little differently than you, Christy.
Just as the Libby case has nothing to do with the reasons for going to war or the status of Valerie Wilson when she was outed, Limbaugh’s deferred prosecution agreement wasn’t about taking oxycontin or even abusing drugs – it is about doctor shopping. Now he gets caught at customs with a prescription for one doctor written to another, according to Rush because both wanted to spare him embarassment for needing the little blue boner pills.
That’s not doctor shopping but it is a flagrant example of Limbaugh illegally subverting the prescription drug laws – just 59 days after entering into the deferred prosecution agreement for the same crime. Roy Black is having a bad day, but the prosecutor is going to be pissed.
Now a couple of questions come into play:
Did Limbaugh make any accounting to the prosecutor as part of the deferred prosecution deal? I’ve never heard of a case where a prosecutor agreed to defer prosecution without a full and honest statement about the defendant’s criminal activity, and a clear agreement with the defendant and his or her lawyer that if the defendant breaks the agreement the statement will be used in the prosecution.
Also, when was this Viagra prescription written? Is there even one doctor dumb enough to write a script for Limbaugh under these conditions after the doctor shopping investigation began? I’m betting Rush got this Viagra before all of this other stuff went down. Now, would a doctor willing to do this also be willing to play fast and loose with oxycontin scripts?
Before yesterday there could be a plea of ignorance/Fifth Amendment on both sides that would make the investigation difficult. But Rush threw his doctors under the bus when he confessed that one doctor wrote a script to the other and then gave the pills to him. If either of those doctors were involved in the oxycontin deal, imagine the kind of morning they are having. I imagine it is with their lawyers.

It probably varies from state to state, but prescriptions have to be filled in a certain amount of time, or they expire. Granted, it could have been an old bottle, but this investigation has been going on for a while. As for the Oxycontin, that’s MUCH harder to prescribe, but I agree with you that the DEA will probably be checking in on those doctors who wrote that Viagra prescription.

What I want to know: did he get the pills in Florida, or did he get them in DR while “on vacation”? What else did he get, either in Florida under another person’s name, or in DR?
Did he practice safe sex with the one pill that may have been used? Was his partner of legal age? Did he pay for sex?
And will Pfizer look at this as free promotion, or will they pony up money on the QT to quiet this negative publicity, maybe even help fund Limp-bo’s defense?

Morning. Well…I’m not so bent out of shape over all this. When I heard the news that he’d been found to possess “the little blue pill”, I just shrugged my shoulders. So what. Lots of older men take this pill…it’s almost become as common as aspirin. And the “V” pill has no correlation to pain killers.
Frankly, I’d be more concerned if the facts were that Rush was hanging out every night at a bar, drinking himself silly. Then, I’d think that his addiction is still there…he’s just substituted pills for whiskey.
My only question is the chain from doctor to Rush. So far, no-one seems to know if this is wrong…lots of guessing, but that’s all. It may be that the only person in some hot water here is the doctor.

I just read the Deferred Prosecution Agreement that lotus’ 41 directed me to. No. 9 item states:

Hellloooooooo. We are talking about the Dominican Republic, folks. Been there; it is one of those places where this is the case.

I just can’t think of any legitimate reason for that doc’s name to on the bottle in Rush’s possession.
105: well, “and other drugs” could be big! But so far….nothing else on “other drugs”. And, on the prescription “chain”….this could be wrong on the doctor’s part….maybe, maybe not. But it would be the doctor in hot water. “Other drugs” is probably the key here…we’ll see what develops!

Alan Beckoff, Hollis Hills, N.Y.: It is interesting and ironic that often you decry the current abysmal level of political discourse in this country–and properly so–yet you take an entirely gratuitous cheap shot at Kos by calling him the moral equivalent of Tom DeLay.
If your point is that Kos is an enforcer of party discipline like DeLay is–yes, present tense–and reinforces this position through his control of millions of dollars in campaign contributions, then I think you should back up that comparison with better examples than the Democratic leadership attending his recent YearlyKos. And Tom DeLay may have crashed the gates years ago, but he became the very embodiment of a corrupt political establishment. How is Kos like that?
Steve Loukin, Mazomanie, Wis.: It reflects poorly on the substance of any cohesive opinion you strive to present with your columns that you resort to such a naked ad hominem diatribe as this. If the doctor is in hot water, I think it stands to reason Rush is in hot water. In doctor shopping, the doc doesn’t know how much other drug is being prescribed by others because it’s hidden from any one doctor. In this case, it sounds like the doctor was complicit in this odd arrangement for which, no doubt, Rush would have intentionally sought cooperation to get whatever he was given.

Ghostman – I don’t think anyone cares much about Rush having V*ag*a, but the fact that, even while under a deferred pros. arrangement for drug issues, he goes out and obtains drugs in a very questionable and likely iillegal – that raises an issue.
I wondered too about leaving the country, but I guess with Rush being such an investigative journalist guy and the big need for SOMEONE to go to Iraq and cover the good news there, no one wanted to interfere with his travel needs.

HopeSprings – to my knowledge, physician self-prescribing laws vary state to state. I got back spasms for a couple days from some exuberant posture and knew a muscle relaxer would help immediately. I called my state medical board to inquire about self prescribing a non-controlled substance. Thay said that while technically it was not illegal, they strongly recommended that I call my primary doc. Made a phone call to him and it was called in. That doesn’t involve passing it on to another person, which is a whole other ball of wax.
Also, regarding samples, docs are supposed to keep a log of samples handed out documenting quantity, lot #, and expiration date of medication given. The patient’s chart should also reflect that samples were provided and in what quantity.

That’s exactly right. This man is a hall of fame addict. Bill Burroughs territory but with out any self awareness or humility, and until he understands the nature of his demon he has no choice but to relapse as far as I can tell. Rehab that isn’t willful rarely works, at least not the first go around. This man will have to hit rock bottom, just like any other mortal. That’s will be the hardest lesson for someone like this to learn, there will be a point were no amount of money, power, fame or influence will be able to help him. He’ll have to “pull himself up by his bootstraps”. I don’t think he has the type of fabric in his character to pull it off . I don’t wish him ill but I will say that he is probably the largest single cancer on the National Character, he’s done immense damage to this country. The man his good at what he does. His only rival is Karl rove, and they were both cut from the same cloth. High School scarred these 2 beyond all recognition, it all comes back to the geek factor for me.

What you said sounds right to me. My husband is a Military Physician and some of the ‘rules’, I know are different. He isn’t licensed in this state, but because he works in a military hospital, he can write scripts in this state. Also when we’ve traveled, he’s written a script for me with a ‘counter prescription’ (for antibiotics) at the pharmacy in the city we were visiting. Pharmacies have national registries for physicians. He always has his Medical License with him. And self-perscribed ‘controlled subtances’ are always a no-no as far as I know-know. Dying to know what other drugs mr limpdick had on him…

Also, Muzzy is correct. Self prescribing is not the problem. A pattern of prescribing oneself controlled substances is a problem.
I think the issue with Rush is going to turn out to be that he got his hands on his doctors prescriptions. Probably paid for the medication out of pocket so as not to attract attention. Why he used his MD’s name is beyond me.

And the idea that having the script filled for the doctor “for privacy” is pretty weird – privacy of what? The medical records are hippa protected – noone’s gonna see that. The only thing it would mean is that the doctor is gonna queue up at the pharmacists window, rather than rush. And if that was a big deal, then rush could mail order it and noone would see at all.
So i don’t get it.
What seems more likely is that he wanted to get the stuff quickly… like -
rush: hey doc., i’m off to the carribean and want to have some fun. Can you get me some viagra pronto?
Doc: well, i can call in a script, but it’ll take them a while to fill.
rush: i’m on my way to the airport. can’t i just pick up a sample or something
doc: don’t have any samples, but i can give you some of mine…

When patients use a pseudonym at a hospital, they sign in with their proper ssn, their real name, medical history etc is known to those who treat them. It is legal. Prescriptions are another whole ball of wax.

As I explained, Rush was put on informal probation and if he fouled out of the program the original prosecution can be re-introduced. This is bad news for Rush because it means that Rush’s violation of his good conduct agreement can lead to his prosecution on felony charges.

I wondered in recent weeks how Hindenburg was doing with his drug rehab. My prediction was that someone as arrogant, egotistical, “rules don’t apply to me” self-righteous, hypocritical and self-indulgent, who spends his life surrounded by ass-kissers, would not stay substance-free for long.
I wish him all the compassion and leniency that he would wish for if it were happening to some average person in the street — which is none. Too bad you weren’t arrested in Singapore instead of Palm Beach, you vicious fat fuck.

What’s overlooked in all of this is Rush’s pre-Carribean travels — to D.C. to meet with Clarence Thomas and friends and then with Karl Rove.
This puts Thomas and Rove in proximity of a felon (albeit one with a sweetheart deal).
More than this, it brings into question why Rush needs Viagra. Didn’t he recently divorce his 3rd wife? Is he having sex outside of marriage? So much for family values.

I’m late but…. I spent a year or so cruising the coasts of the Dominican Republic, and I can tell you, it’s Viagra heaven. There are hookers and HOOKERS in the DR – they are everywhere, and Rush pretty much BRAGGED abotu the trip by bleating he “wished he could tell us about the trip”. Many folks go to the DRE on a pussy junket these days, and it’s no secret.
