It is important how you think about these serious issues isn’t it kids.

Dick Cheney is obviously shooting Republican lawyers in Texas so that we don’t have to shoot them in Washington DC.

Could Clinton have issued a classified pardon of Marc Rich? Could Bush 41 have issued a classified pardon to Weinburger & Co? “Here you go, just show this to the judge quietly and on the sly, then go on your merry way. If anyone asks about it, just smile and wave.”

My knowledge of classified materials comes from the State Department, not Justice. The Bush adminstration practices aside, there has to be a reason WHY a particular action of the executive is to be classified. Other than the wild hypothetical of Rove being an undercover agent I cited above (and wouldn’t that be a wild cover!), I can’t come up with a reason that Bush could use to classify a pardon.

Not that he wouldn’t try, mind you. I just don’t see how it works legally. I know it’s a hard question to answer, but are you aware of any cases where that’s been done? (Would have to have been long ago, of course - else they wouldn’t be secret.)

They had to dismiss and reseat in Safavian, so I think today is really just day one with the new juror.

BTW - I think the timing of the announcement was interesting. Right AFTER the hearing before Walton on discovery matters, esp with Walton having put a hold on Libby access to Rove info, but indicating he would be willing to revisit it when the Rove issue resolved. Interesting to see if Libby pushes that after all or not and if not — why not.

If they do push, then the prosecutor may be forced to say more about whether any aspects of the GJ are still proceeding.
