&lt;p&gt;Could Clinton have issued a classified pardon of Marc Rich? Could Bush 41 have issued a classified pardon to Weinburger &amp; Co? “Here you go, just show this to the judge quietly and on the sly, then go on your merry way. If anyone asks about it, just smile and wave.” &lt;/p&gt;
&lt;p&gt;My knowledge of classified materials comes from the State Department, not Justice. The Bush adminstration practices aside, there has to be a reason WHY a particular action of the executive is to be classified. Other than the wild hypothetical of Rove being an undercover agent I cited above (and wouldn’t &lt;i&gt;that&lt;/i&gt; be a wild cover!), I can’t come up with a reason that Bush could use to classify a pardon.&lt;/p&gt;
&lt;p&gt;Not that he wouldn’t try, mind you. I just don’t see how it works legally. I know it’s a hard question to answer, but are you aware of any cases where that’s been done? (Would have to have been long ago, of course - else they wouldn’t be secret.)&lt;/p&gt;</description>
