A month ago the telcos were poised to strike a death blow to net neutrality. Thanks to the fine leadership of Matt Stoller and the efforts of many bloggers, there has been an incredible turnaround and unless some of the Democrats start to wobble things look good. It will come up again next session and we may have to fight this all again, but in the short term it has been quite a victory.
But Matt had a lot of unexpected help, it should be noted. I’d also like to thank teleco lobbyist Mike McCurry, whose arrogance over at HuffPo energized the entire blogosphere. And then there’s the other teleco lobbyist, Steve Elmendorf, he of the famous quote:
"The bloggers and online donors represent an important resource for the party, but they are not representative of the majority you need to win elections,” said Steve Elmendorf, a Democratic lobbyist who advised Kerry’s 2004 presidential campaign. “The trick will be to harness their energy and their money without looking like you are a captive of the activist left."
I’d personally like to extend my sincere apreciation to these guys who don’t seem to have quite mastered that "trick" yet. Their killer online strategy was to patronize everyone, spread a passel of telecom money around to bloggers who need it by plastering a bunch of ineffectual ads all over our sites and then planting the flag of abject failure in the middle of a battle they were already winning.
Thanks, guys. I certainly hope you achieve your dreams and replace all the Republicans on K Street when they’re carted off to jail. Though unlike the Democratic Party, these clients probably aren’t interested in paying you for repeatedly failing. So if you’d like a letter of recommendation to present to the oil companies, maybe big pharma or the defense contractors, let me know. I’ll be right there for you.
Oh and per Howie Klein, Lou Reed has come out in favor of net neutrality. Feel free to watch the above video of the Velvet Underground doing Sunday Morning (from The Velvet Underground & Nico) while licking your wounds. A little present from me to you for a job well done.

OT – There’s a very weird sentence in the Glenn Kessler story about Iran negotiations:
“Since becoming secretary of state last year, Rice has worked assiduously to make certain that the United States does not maneuver itself into becoming the world’s enemy No. 1, as it did on the Iraq war” (my emphasis).
Is it radical that Kessler got this into the Post? Or is it more that we’re expected to just sort of accept being despised now and it ain’t a big deal?

Ah, you reminded me of one of my favorite movies of all time. If you don’t like to be lectured, then fall prey to the natural consequences of continued republican leadership. Just don’t say we never sounded a warning when you finally “get it.”
NPR’s On Point had a good show on Net Neutrality this morning. I didn’t hear all of it, but one of the pro-neutrality guests (Lawrence Lessig, I think) was doing a pretty good job of calling bullshit on the telecom lobbyist’s arguments. Also, if I recall correctly, the host referred to the industry guy as a lobbyist, rather than as the head of the astroturf group as he’s presented in the show’s guest list. In addition, they had a rep from Google on to point out that although Google could now afford to be one of the “winners” in a non-neutral net, without net neutrality, they never would have gotten off the ground, and the “next Google” wouldn’t either. The show doesn’t seem to do transcripts, but it’s well worth a listen.
(Also amusing — looking at the website of Scott Cleland’s astroturf “netcompetition.org”, he mentions the appearance and whines about “While I had hoped for a more balanced debate…” Yeah, I bet you did!)

As I’ve mentioned, I worked for Telco equipment manufacturers and with Telcos worldwide. These people are arrogant swine that assume they can steal whatever they want and will do exactly that until stopped. That’s their history and tradition—take whatever you want and wait for the national government to regulate you, to stop your actions and pull you back. As a matter of business plan they go for the max and let the regulators establish limits.
Oh, and I went from growing up in Beach Boys/Dick Dale/Doors/Buffalo Springfield LA to Coast Guard electronics school in July 1970 on Governors Island, NY, and pulled a roomate from New York. First day there I get hit with Velvet Underground, White Light/White Heat. Never been the same.

Net Neutrality and the eBay Community: A Call to Action
Dear xxx,
As you know, I almost never reach out to you personally with a request to get involved in a debate in the U.S. Congress. However, today I feel I must.
Right now, the telephone and cable companies in control of Internet access are trying to use their enormous political muscle to dramatically change the Internet. It might be hard to believe, but lawmakers in Washington are seriously debating whether consumers should be free to use the Internet as they want in the future.
The phone and cable companies now control more than 95% of all Internet access. These large corporations are spending millions of dollars to promote legislation that would divide the Internet into a two-tiered system.
The top tier would be a “Pay-to-Play” high-speed toll-road restricted to only the largest companies that can afford to pay high fees for preferential access to the Net.
The bottom tier — the slow lane — would be what is left for everyone else. If the fast lane is the information “super-highway,” the slow lane will operate more like a dirt road.
Today’s Internet is an incredible open marketplace for goods, services, information and ideas. We can’t give that up. A two lane system will restrict innovation because start-ups and small companies — the companies that can’t afford the high fees — will be unable to succeed, and we’ll lose out on the jobs, creativity and inspiration that come with them.
The power belongs with Internet users, not the big phone and cable companies. Let’s use that power to send as many messages as possible to our elected officials in Washington. marksb #31: good point on history of telcos. Is there a list of their outrages someplace. Remember switching coustomers to different long distance services without, like, even asking them, cause they could. What was that called, “slamming”? Some one ought to make a list of the history. If you could get a good short list of problems sense deregulation, and get it out to voters, I think net neutrality would win.
Anyone who thinks US approach to regulating communications is working has never been to Asia or Europe. It’s all about grabbing legal control of resources and services for which they are already compensated, establishing monoopoly, or small oligopoly, restricting access, and grabbing the cash. There is a name for it in economics: rent seeking.

It did have one useful result — I found out that registration wasn’t necessary to read comments, there just were no comments.
The musicians coalition asked me to find out if any of the artists I used to work with at Warner and Reprise are into this. I was blown away by the 100% positive response. Lou was the first one to get back to me with a resounding YES and about 15 minutes ago the Book of Love asked me to count them in too. It took a whole day because Ted had to poll all the members of the band. I think the coalition is going to announce all the musicians who are part of this next week.
By the way, I help John over at Crooks and Liars with his Late Night Music Club on Wednesdays. Yesterday we played a version of the Clique/REM song “Superman” by Roger Troutman that was recorded for a Superman movie. The song was never used because Warners scrapped the film and then Roger’s brother shot him. The song had never been heard by anyone but Roger and I (and a few friends) until last night. For next week… I have 2 incredible Lou Reed songs that have never been released (one a duet with Laurie Anderson done for the same Superman film!) and I’m going to ask Lou if John and I can play ‘em on C&L.

It’s an amazing speech and I keep getting amazed to find out that Al was out front on all this stuff. Seems like he’s been out front of most everything newsworthy today. This was back in October he said this. Here’s the closing paragraphs for a taste:

Seems like there is a new battle blooming on Net privacy too. The Justice Department is meeting with companies and pressuring them to come up with proposals about saving data on who comes to their Web sites for as long as two years. Not just for monitoring kiddie porn, but comprehensive data on which of their customers visits which site and what people search for. In other words, if Gonzales gets his way, Big Brother will be able to watch every keystroke you make when you search. Before modern US Forces whack a nation bigtime, they take out the Communications, effectively lobotomising the opposition. No brain, no service. Then the remainder of the blitzkrieg stuff is a cakewalk. That’s what will happen to Kos and co.(people like us) if the net status quo is not preserved. An attendant irony is that intelligent, articulate dissent will probably still florish should the vote hold, but as a by-product of the commercial imperatives of the likes of Google.
However, if America slide into Fascism, not the longest of long shots, then we can expect similar net control/censorship as now prevails in China and is enabled by Yahoo, Google and the gang. In the short term, the preservation of net neutrality looms as a significant victory for those who champion government by we, the people.

A brave and lone Federal judge in Detroit, Michigan, has rejected (on May 31) the Department of Justice’s request that she postpone a hearing on the legality of the NSA domestic spying program. She has ordered the public court session to take place on June 12.

The Bush Administration failed twice to meet Judge Anna Diggs Taylor’s deadlines to respond to the plaintiff’s motion. Instead the U.S. Department of Justice filed a motion last Friday asking that she first rule on its own arguments that Federal courts have no power to consider the issue because it involves “state secrets.” The Honorable Anna Diggs Taylor, U.S. District Judge, has just denied the government’s motion.
Assuming that events proceed as expected, the U.S. Department of Justice will, of course, now appeal her order to the U.S. Court of Appeals for the Sixth Circuit in an attempt to get it overturned and, if unsuccessful, will ask the U.S. Supreme Court to block her order.

DETROIT — A federal judge in Detroit said she will proceed with hearings in a suit that challenges a domestic spying program run by the National Security Agency, despite assertions from the Bush administration that doing so would reveal “state secrets” that affect national security.
U.S. District Judge Anna Diggs Taylor also chided the NSA and lawyers for the Department of Justice for failing to respond to the court challenge, brought Jan. 18 by a local resident, Nizah Hassan, the American Civil Liberties Union and the Council on American Islamic Relations. Despite having twice extended time for the government, Diggs Taylor said it has failed to respond.
The plaintiffs also filed a motion March 9 asking Diggs Taylor to summarily declare the NSA’s program illegal. They assert the NSA must go to a secret court provided by the Foreign Intelligence Surveillance Act for approval of spying in the United States.
The government eventually filed a motion saying that, by law, no court can consider the issues because of a privilege against revealing state secrets, if doing so diminishes national security.
But in her order, Diggs Taylor said she will hear the government’s motion only after proceeding with a hearing on the plaintiffs’ motion to summarily declare the spying illegal.
“The hearing shall be held on Monday, June 12, 2006, as scheduled,” Diggs Taylor ordered. “Although defendants have not responded to said motion they may, if they appear, argue against it.”
The ACLU and the other plaintiffs say the NSA has illegally operated a domestic spying program, tapping the phone calls of callers who frequently converse with people in the Middle East. President Bush has said the program is legal.
“We are glad the judge appears to be skeptical of the government’s argument that no court can consider the legality of the NSA’s program,” said Ann Beeson, the associate legal director of the ACLU.
A spokeswoman for the NSA said no one from the agency would be available to comment on the order until Monday.
A spokesman for the Department of Justice said lawyers are reviewing the order before deciding whether to comment and how to proceed.
Legal observers said the government can appeal the judge’s lawyer before Diggs Taylor proceeds with the hearing.
The government has succeeded in two recent cases to block lawsuits against its tactics in the war against terror by using the so-called state secrets doctrine, which provides the government a privilege against legal action if that action would diminish national security.
Once rarely used, the doctrine is now routinely wielded by the Bush administration, which is expected this month to intervene in some 20 cases filed against telephone companies that may have shared data on patterns of telephone calls with federal officials.

One of the emerging trends on the internet is the ability of musicians to put their music out for download from their own websites. This applies to local “struggling” artists as well as the big name acts. Here’s the question: if the big telcons control the internets, how would that affect those local artists trying to get their music out there?
BTW, one of my favorite Lou Reed moments is when he sings on “Strawman” (from New York), “Does anyone need another politician caught with his pants down money sticking in his hole.” Lou does have a way with words, doesn’t he?

Iraqis are apparently not so sanguine- the Prime Minister of the government that George built says that killing Iraqis is a daily exercise for US Troops. We may need to double up on the ethical training.

A thought that occurs to me this morning (one of two, the other involves coffee) is that our (democrats, progressives, liberals, netrootsers) challenge is, in addition to winning back power and stopping the madness that Republican rule has brought to our country and the world, to eliminate the so-called policies that Bushco has managed to shove down our throats.
Permanent tax cuts for the wealthy, corporate welfare for big oil, big stick and no carrot foreign policy all need to be repealled immediately. But they also need to be replaced with policies based on reality and facts. I know I’m being optimistic but I do see the political will to provide the leadership the country needs in peple like Lamont, Feingold, Gore, Kennedy, and Murtha.
Now we just need fair and open elections.
Keep your head down, swing easy, follow through, rwcole. Take the money and run.

Say, Howie, you might know the answer to this… What’s the deal with the fact that there’s so little watchable footage of the Velvets out there? Now days we got hours of stuff of the MC5 (some of it courtesy the FOIA!) But with the Velvet Underground we have a very visually interesting, high-profile NYC band that for about two years was in almost constant proximity to Andy Warhol and his filmmaking equipment, yet there’s very little film representation available, at least as far as I can surmise.
