
Chris Matthews just said on Hardball that the "CIA leak grand jury meets tomorrow, Friday." According to Christy, grand jury members are given a phone number to call in that will let them know if they’re going to be meeting the next day, so it’s entirely possible that someone would know.
Matthews says that they’ll be covering it tomorrow at 5 and 7 pm. We will, of course, be all ears first thing in the morning.
Could it be Fitzo-de-Mayo?

I think RH reviewed the archives and concluded that Fitz didn’t announce the press conference until Friday early a.m. last time.
Of course, that was a different situation in that the GJ’s term was expiring on Oct. 28th – I’m not sure when this one expires but it’s not soon.
Also, I suppose there’s some doubt as to how the GJ will vote. In the case of the Libby indictment, he may decided to hold a press conference one way or the other.

The GJ will meet tomorrow. IF they return indictments, Fitz will announce a press conference to be held – he will give a 24 hour “heads up” on that conference.
Speculation is that the announcement will be made on Tuesday as to what indictments the GJ approved.
The GJ only needs 13 votes to indict, out of 24.

Fitz did NOT give the media a day of notice last time. He issued a press release announcing a press conference later that same day.
That was a little different since that was the very last day that GJ met, so we all new something was going to happen one way or another that day.
But there’s no reason to think (Jason Leopold’s flawed reporting, notwithstanding) he wouldn’t proceed the same way this time: GJ meets, press release given, press conference a few hours later.

Fitz owed the public something that day, it was the day the grand jury expired and one way or another with that much anticipation built up he had to say something. Can he know for a fact that the grand jury will hand down indictments if in fact he requests them tomorrow? If he calls a press conference the day before and nobody winds up being indicted, what’s he supposed to say? “Nice try?”

VG- from my experience as a GJ, I think time to hammer out the wording; jurors don’t absorb so much as forget during the lapses between meetings. When I served, the USAs kind of made it clear that their expectation was when in doubt, we were to request more information rather than vote no true bill…When we started asking too many questions, they would go back to their investigation. When and if the GJ does vote a true bill, the indictment can be sealed until the prosecutor decides to serve it up.
Tony Snow better work on his “I refuse to comment on an ongoing investigation” delivery tonight….
obsessed at 28 — that’s correct — there was media buzz and rumors, but the announcement from Fitz’s office did not come until the jury had officially voted, the morning that Libby was indicted. Anything earlier that was official would have been improper. And there was a recent report that Libby’s attorney’s weren’t notified until the morning of the indictment either (a target letter or any other notification is NOT a requirement, FYI, it’s a courtesy). (I think Schuster reported the morning Libby notification earlier in the week, if I remember correctly.)
Just a word of caution for everyone — if the grand jury is meeting tomorrow, and really what we have is Matthews public statement on this on MSNBC on Hardball, not an official court announcement, but still…just because the jury is meeting does not mean that there will be an indictment. (Although, damn, it sure would be sweet, wouldn’t it? I’m gonna be up at the crack of dawn in anticipation.) All I’m saying is, there is a lot of information that the jurors have to absorb and consider in this case — built up from months and months of investigation. Just don’t go all celebratory until we know for sure that there is an indictment — we’ll see that when Fitz takes things to the presiding judge along with the foreperson of the jury, just like last time. Justice takes time, and I don’t want everyone to be hugely disappointed if it doesn’t happen tomorrow, that’s all I’m saying.
The GJ was given a Request for Indictment to review. They have been reviewing the documents and we will find out if they “return” the Indictment (which means the Prosecutor has proven there is enough evidence to take the case forward).
Also, at this point, we don’t know exactly “who” the indictment has been requested for – how many (Rove/Cheney/Hadley???) or how many charges are requested against each.
The frequent comment referring to Grand Juries is that – if a Prosecutor requests, they will indict a ham sandwich.

Well, I’ve been wrong before – but I would give good odds that nothing is coming for a while. The big push to get this wrapped up soon is coming from Gold Bars Luskin and Rove -not the leak-proof Fitz team. Rove just testified, so you would think the GJ would need a couple of weeks to chew over that, at least.
Is there any indication that we’re close to a decision, besides the press leaks from Rove’s team? The GJ term doesn’t end for months, FItz has no deadline imposed on him, and last time he announced Libby’s indictements at the last possible minute, on the very last day for the GJ. Something doesn’t scan to me.

I was away from all news outlets all day, just found out about the latest Bush administration illegal spying on millions of people without a warrant scandal. Has Bush commented on it today?
Part of it is that even if Fitz asks for an indictment, he doesn’t know that the GJ will vote for it.
RH – if you’re the prosecutor dealing with a GJ, how informal is it? Can he poll the jury and can they talk strategy? In other words, is he like the foreman of the jury and they’re all coming to a decision, or is he strictly behaving like a prosecutor, presenting his case to them and then they deliberate without him?

I think we don’t really know how much notice Fitz will give because the last time, for Libby’s indictment (God, that’s a beautiful word – indictment!) we were already pretty much “on call” due to the GJ term expiring.
Maybe he’ll give us more notice this time…

So, if that is one of the steps in the indictment dance, is this Request given to a GJ during a meeting, or can it be distributed to jurors w/o a meeting? If it has to be distributed at a regular meeting, then I can’t see that it would have been given at the last known meeting, the latest Rove visit. Also, I would guess that a review wouldn’t be done “on the day”, but then IANAL. Maybe this is what goes on on the day- GJ gets document to review, meets and discusses, and then returns “true bill” or req. for more info?
Curiouser and curiouser. My suspicion is that something else may be happening. There was a media frenzy the last time because the Grand Jury was expiring. This time, it sounds like the press has been tipped off. I see two big possibilities: (a) Someone’s been called to testify, and that lead to the word getting out. (Would LOVE it if Libby has flipped, by the way. It’s also possible that JudyJudyJudy had her memory jogged by one of Libby’s filings.) Or (b) Fitz made a courtesy call to someone’s lawyer(s) to let them know that he’d be asking the GJ to indict their client tomorrow, and the lawyer(s) tipped off the press. That’s the kind of thing a media-whore like Luskin would do in a heartbeat.
Wish I could take the day off tomorrow to catch any breaking news on the tube. I will check FDL every chance I get.

You know, it also occurs to me that should Rove be testifying again, Luskin would be aware of the schedule on that and would be a possibility for media notification as well. That would be equally true for any other potential witness and their legal representatives. (e.g. Cathie Martin, Susan Ralston, Stephen Hadley, someone like that…) So media notification could have happened for a number of reasons. But I am POSITIVE that there was no official announcement until the morning of the indictment being handed down by the jury.

There is definitely a possibility that someone has flipped. This would be the natural time to do it so as to beat the clock before an indictment comes down, which would change the playing field significantly for all involved.
I missed the last thread, but since Sprint was listed as a non-NSA alternative, I’ve been wondering if anyone knows anything solid about their position. (I have Sprint for long distance and cell service.) They weren’t one of the “big three” listed in the USA Today article, but it says that Qwest is “the only one of the largest telecoms” to refuse.
I don’t know is whether Sprint is smaller than Qwest, but I haven’t found anything definitive that says they’re not involved. Has anyone else?
Also, they were mentioned as cooperating in the earlier “only international calls” version of the program, so without solid evidence, I’m not inclined to let them off the hook.

OT – This was probably discussed in another thread today, but I’m still trying to catch up with everything today. Given that the same telecos operate a large part of the internet traffic, does this mean that internet traffic is a part of this database? I realize that there is probably yet another “classified” program which may monitor email in realtime looking for “keywords” or something, but I am wondering about keeping a permanent copy of emails. I am no techie, so I was wondering is that logistically possible using the technology talked about today?

One reason that I hope Rove is indicted soon is that we need the media to clear the decks for the upcoming Rep. Jerry Lewis (R-CA) Show. That should be good. It’s Duke and Jerry instead of Dean and Jerry, and the humore is black this time, not goofy. But heck, I think Dean and Jerry broke up before I was born, so I really have no point of comparison.
I want the DOJ to rip through the GOP CA House Delegation asap. For two reasons. One, so we can get rid of those crooks and I don’t have to wear the shame of having 1/4 of my state’s whole damn House delegation being crooks (even if that half ain’t my party). And I think it would make some kind of nice slogan for the election if a whole bunch of them were indicted. I’ll have to think of a good slogan for that though.
DOJ needs to work though this bunch before election. Anyone know of other R-CA representatives who need a look-see?

At the credit card bank where I worked for 5 years til lrecently, we were instructed to be vigilant for any “suspicious” transactions and to submit routine federal “SARs” (Suspicious Activities Reports), which started out decades ago as anti- drug money laundering stuff, but post- 9/11 got ramped up to include potential “terrist” vigilance. During our training we were told that were were immune from any civil legal actions resulting from filing any erroneous SARs. We could completely fuck up someone’s life, and there’d be no recourse.

For those interested in some *gossip* I heard, under the proviso that I don’t state where I heard it (other than to say that it is indeed *gossip* — someone heard it from someone who heard it from someone, yadda yadda, you know how that goes), read on:
What I heard is that the decision whether or not to ask the grand jury for indictment(s) against Rove was made sometime around the end of last week. Nobody was able to say WHAT Fitzgerald’s decision WAS.
One of the reasons why our dear Fitz is so good at not having any leaks from his office is that, at this stage of the game, he and his helpers are communicating with the judge using a previously determined “codespeak” just in case, you know, there are some nosy people who might be, you know, trying to listen in.
I report this FWIW, which I guess isn’t much. It is a current strand of *gossip* amongst a certain set of civil servants. I have no way of verifying. But it’s also nothing very surprising. We’ve been thinking for some time that the Special Prosecutor has been making up his mind, and I guess he’d have to be stupid (which we know he ISN’T) to not take sensible precautions to ensure privacy in his communications.
So this is really just a crumb, which anybody here could have reasoned our for him/herself.
But it’s all I’ve got! Except for a seat in front of my teevee tomorrow; that I’ve got! Thanks, guys, for making this a great COMMUNITY experience! Since hanging out at FDL, each one of us knows we’re not really alone.

Keep the pressure on Congress… Talking about impeachment wakes people up… They question, it’s a strong motivator to get people thinking. It also lets Congress know how intense the dissapproval is for this President… They seem to be a little slow on the uptake. So please:
1) Sign petitions if you have not done so
2) Send a letter to Congress (both Senators & House rep)
3) Send a copy to the media
4) Enlist friends and family to help, ask them to chip in time
5) Spread the link around, email it (with a request to forward) post it on a blog, or in the comments of a news story.

So, supposing that Team Fitz has been getting together all of the stuff (written) to ask for an indictment since Rove’s last vist. And, suppose that that is presented to the GJ tomorrow. Could the GJ review this info in just one meeting (after they “retire” to discuss privately) and come back with a decision? Is this time frame reasonable as to what the GJ would have to read and consider on a single day?

Correct me if I’m wrong but it seems that there is no hard evidence Mr. Fitzgerald is seeking an indictment tomorrow and several reasons to believe that even if he is seeking one or more indictments, that process may not be completed tomorrow. (Fitzgerald needs time to present to GJ, GJ needs time to consider, etc.)
Also, even if the GJ comes back with an indictment, he may wait 24 hours beyond that to issue and public statement.
All this appears to add up no indictment announcements tomorrow. Am I missing something?

Mr. K8 heads a technical testing-type department, which MUST remain totally independent, with no favors to any single client (a favor to one means screwing the other, a competitor, over). One day a sleaze — who had been taking employees (but NOT Mr. K8) to lunch in a fancy rented limo — offered a plain white envelope to my guy. Actually he had stuck it in his folder, and Mr. K8 found it later. It was filled with cash. Mr. K8 didn’t even wait to count it. He walked throughout his department waving it, saying “if anyone here got an envelope like this, you’d better come with me right this second. I’m turning this in to the man who deserves to know about it.”
Then he went straight to the office of the owner of the company, who himself is a great guy, European born (who firmly believes in giving his employees the best health care and vacation benefits possible), an owner who himself is a straight shooter in ethical matters. The owner immediately cancelled all contracts with the sleazy client, commended Mr. K8, and warned all employees that this highly successful company could be destroyed by one single corrupt employee.
There were a few underlings (some silently grumbling) who coughed up their white envelopes filled with cash. The happy ending to the story is that the grumblers left the company shortly thereafter; they came under increased scrutiny but were NOT treated badly — they were a couple of guys who were spoiled brats who didn’t like hard work; they preferred a “quick buck” and headed off for other companies with less honest owners. Mr. K8 has been deeply trusted and respected by the owner ever since.
I wish every similar story in corporate America worked out this way, but know that isn’t the norm. We don’t make a ton of money in this household. But we’re happy with a modest life and ownership of our souls.
My hat’s off to you and all the other sexy guys out there who can look the woman they love straight in the eye, and she sees a bright soul there.

I was listening to Rush “Karl’s Brain to his Mouth” Limbaugh the other day and he was very confidently predicting that the Hayden nomination was a carefully laid bear trap, like the sobbing Mrs. Alito, and that Hayden would make a very forceful and convincing case for the necessity of the illegal wiretaps and the democrats would again end up with egg on their faces.
Should be curious to see if he changes his tune tomorrow. Anyone care to volunteer for reconnaissance duty? I can’t stand to hear his pompous voice twice in the same week.

When it was time to take the children to the bathroom it was decided that the girls would go with one teacher and the boys would go with the other. The teacher assigned to the boys was waiting outside the men’s room when one of the boys came out and told her that none of them could reach the urinal.
Having no choice, she went inside, helped the boys with their pants, and began hoisting the little boys up one by one, holding on to their “wee-wees” to direct the flow away from their clothes. As she lifted one, she couldn’t help but notice that he was unusually well endowed.
Trying not to show that she was staring the teacher said, “You must be in the 5th grade.” “No, ma’am”, he replied. “I’m the jockey riding Silver Arrow in the seventh race, but I appreciate your help.”

Judge J. Michael Luttig, one of the country’s most prominent conservative jurists and once considered a likely Supreme Court nominee, has resigned from the Fourth U.S. Circuit Court of Appeals in Richmond, Va.
I’m sure life (read: $$) in private sector was part of the motivation, but TIME seems to think that he resigned partly out of qualms regarding civil liberties. He was on the Padilla case. If you remember, the administration did a 180 on trying him in civilian court and Luttig basically called the DOJ liars. Hard to believe that Bush & Co. are offending even their base to such a degree.

Christy, we used to make maple syrup. In the town I partly grew up in, I used to see buckets hanging from the trees. For some reason, this stopped. Now maple syrup seems to all come from Vermont (the other dairy state). Arghh. Farms have been sold off like crazy probably since the 1970s.

Now, I predicted to a couple of friends lo ten days or two weeks ago that Fitzmas was going to be either yesterday or tomorrow (and I’ve got the email to prove it) or never, and I remain hopeful that it is tomorrow. But I strongly suspect that this is just Chris Matthews doing the Note’s shtick observing that the grand jury is scheduled to meet tomorrow – like it’s scheduled to meet every Wednesday and Friday! – and Matthews is just mentioning it now because a lot of people expect Fitzmas to happen this week, and tomorrow is the last day of this week. Rawstory – which tends to track Shuster’s reporting quite nicely or not-nicely (and Matthews is probably just echoing what Shuster told him) – did the same thing today, making it sound at first like Fitzgerald was scheduled to meet with the grand jury tomorrow, but then making clear that all they meant was that the grand jury was scheduled to meet – like always on Fridays!
Again, maybe it is going to happen. But I think all Matthews is working from is the speculation we all have that tomorrow seems like a day where it would make sense for Rove to be indicted. Nothing more than that, and that’s not much.
Let’s all send Fitz some positive thoughts right about now. The guy is carrying the weight of the world — or, at least, of this country — on his shoulders.
Yes the grand jury will meet Friday and they will indict Karl Rove. Americans should thank Fitzgerald and his staff for all the hard work and fighting the odds that were against them. This is just the beginning of alot more convictions to come. This case is part of a wider corruption plan unfolding and it involves most of the GOP and some Dems too. America was build on honesty and Americans working together. WWe can rebuild this country of ours as we clean up the corruption and crimes committed by the Bush Administration. As for Chris Matthews well he has a personal interest in this matter because of his involvement in the Libby case. He is up to his neck in the corruption of his friends in the White House.

If I was the producer I’d want something a little more conlusive than that Note shit to start booking guests on, you look a little stupid with a bunch of people sitting there and no particular news driving them. I don’t think they’ve got any clue about what’s going to happen in the GJ, or even if Fitzgerald is going to be there himself, but I’d wager (though not a whole lot of money) that they at least think they’ve got some kind of indepenent corroboration. It could all vaporize into bullshit quite easily, though, I admit.
If it were to happen, will be able to measure the number of indictments based on the size of the document dump that follows tomorrow afternoon?

Well, I’m not chilling the champagne just yet… we’ve had plenty of false alarms throughout this investigation, and though Matthews’ intention to devote his show to it tomorrow does give at least some ring of credibility to speculation that Rove may finally get his frog-march tomorrow, this does seem to largely be the same sort of thing we get from The Note every week.
My prediction for tomorrow, based on absolutely nothing, is that we will be experiencing Fitzmas Interruptus yet again.
