
SHUSTER: Well, Karl Rove’s legal team has told me that they expect that a decision will come sometime in the next two weeks. And I am convinced that Karl Rove will, in fact, be indicted. And there are a couple of reasons why. First of all, you don’t put somebody in front of a grand jury at the end of an investigation or for the fifth time, as Karl Rove testified a couple, a week and a half ago, unless you feel that’s your only chance of avoiding indictment. So in other words, the burden starts with Karl Rove to stop the charges. Secondly, it’s now been 13 days since Rove testified. After testifying for three and a half hours, prosecutors refused to give him any indication that he was clear. He has not gotten any indication since then. And the lawyers that I’ve spoken with outside of this case say that if Rove had gotten himself out of the jam, he would have heard something by now. And then the third issue is something we’ve talked about before. And that is, in the Scooter Libby indictment, Karl Rove was identified as ‘Official A.’ It’s the term that prosecutors use when they try to get around restrictions on naming somebody in an indictment. We’ve looked through the records of Patrick Fitzgerald from when he was prosecuting cases in New York and from when he’s been US attorney in Chicago. And in every single investigation, whenever Fitzgerald has identified somebody as Official A, that person eventually gets indicted themselves, in every single investigation. Will Karl Rove defy history in this particular case? I suppose anything is possible when you are dealing with a White House official. But the lawyers that I’ve been speaking with who know this stuff say, don’t bet on Karl Rove getting out of this.

If Hadley were in the crosshairs for any sort of perjury/lying/obstruction charge, I think he would have been charged along with Libby. He dodges an indictment for now.

Been busy having one of those “zero” birthdays. I’ve been reading y’all but had no time to chime in. Now I can take the time to say, “Wow! I’m excited! Indictments are imminent!” Reading others’ guesses tells me I’d have to go back and review the facts I obsess over. No time to get too specific but I expect Rove to be indicted now, and maybe Hadley and Woodward, but questions remain as to whether Fitzgerald will continue to chip away at the alleged conspirators one by one as we’ve learned he does.
I’ll leave it to the lawyers and judges to analyze how many counts. I do expect obstruction, perjury and making false statements. No idea if conspiracy charges will come now or later. But I expect them too. The evidence is there.

Karl Rove will be charged with: 3 counts of making a false statement (18 USC 1001), 2 counts of perjury, 1 count of obstruction of justice. 0 counts of conspiracy to obstruct justice, for the moment. Date of public announcement of the next indictment: May 11, 2006. Then, if there is no plea bargain, look for a superceding indictment this summer which includes conspiracy to obstruct justice, charging Rove, Libby and other named defendants, and with an unindicted co-conspirator whose last name is Cheney.
This will be followed by Cheney’s resignation for “Health reasons.” Which will be followed by the Bush’s efforts to name a new Veep. (The obvious favorite for this position will be McCain, but he won’t get the nod unless he makes a secret promise to pardon George and his buddies.)
Also look for the resignation of Alberto Gonzalez before the year is over.
Colbert on signing statements – so funny. Karl Rove’s signature cracked me up. He really deserves a Rove or other indictment for his birthday, but I bet he’d be willing to celebrate one night early.

Belowthread – Scarecrow 121 – there is no requirement for proving motive, but it does come into play IMO. It is hard to put together the proof and “tell the story” without motive entering in, although I think it is all a matter of degree – that motive is less an issue with the perjury and more with the IIPA (JMO though).
ValleyG – as per what you mentioned, conspiracy would not have to involve IIPA and could be conspiracy to obstruct, for example. Also, there are quite a few cases where conspiracy charges were brought separate from and later – so you are good to go on that too.

non-sequitor – when I was in Lexington in school, there was a high profile local case involving conspiracy – wealthy families, new money v old money, grandjury testimony sold to targets(typists carbons – remember carbons? – stolen by her boyfriend) etc. In true American fashion, there were probably 5 or 6 who were charged with conspiracy – the wealthy targets and the broke boyfriend. Everyone was acquitted on conspiracy – except the no-money guy. He was convicted for conspiracy. With – ?????????
One of those charges was a new $$$ onceupona trophy wife, by then bleached and brassy, who got an actual soapbox and a megaphone and put it up in Triangle Square on the day she was acquitted and gave very impromptu, very drunken, speeches on life and liberty, wearing very sheer RedWhite&Blue and bouncing a lot.
I always think of that case when I hear conspiracy. Lexington is an interesting little city.

Keep the pressure on Congress… Talking about impeachment wakes people up… They question, it’s a strong motivator to get people thinking. It also lets Congress know how intense the dissapproval is for this President… They seem to be a little slow on the uptake. So please:
1) Sign petitions if you have not done so
2) Send a letter to Congress (both Senators & House rep)
3) Send a copy to the media
4) Enlist friends and family to help, ask them to chip in time

I’m going to go long. Fitzgerald didn’t indict Libby until almost the end of the grand jury term.
So:
Rove gets it June 2nd. Four counts on one charge of perjury. One count on one charge of making false statements to FBI. Three counts on one charge of obstructing justice. Two counts on one charge of violating 50 USC 421. Since we still don’t know what Bush said to Fitzgerald in private interview, Cheney named unindicted co-conspirator on the obstructing justice charge. Bush a longshot for the same.
Hadley, on the same day as Rove. Two counts on one charge of obstructing justice (one for grand jury testimony, one for not supplying the email he received from Rove that Luskin magically produced after VNovak’s tete-a-tete with him).
The outliers: Ari Fleischer gets it on or near June 21st. One count on one charge of obstructing justice. Same for Karen Hughes on one count on one charge of making false statements.
The other wild card here would be indictments of various members of WHIG for conspiracy to obstruct justice. I think Fitzgerald knows that they were all in on the effort to discredit Wilson and discussed responses to Wilson’s charges, in detail, as a normal part of that group’s duties, and it seems more than a little likely that they all would have known about Rove’s and Libby’s efforts. This charge could well be an afterthought, though.

Kapow! Within a day, I got more than 2,000 e-mails. A day later, I got 1,000 more. On a more serious note, some comments on Cohen’s column. It’s got to be the saddest and most pathetic thing I’ve read in a long time. These people have been treating Rush Limbaugh, Bill O’Reilly and Ann Coulter respectfully as peers for years — all the while they called for terrorist attacks on San Francisco and for the military internment of all liberals and sicced hordes of freepers to harass journalists (to which the media’s response is always ‘thank you sir, can I have another’). But now Cohen is shocked, shocked that sane people have had enough of the lies and of the catastrophic damage to the country that our media classes enabled.
The analogy to Nixon’s election is tired and ridiculous. Actually, there is a good analogy to Nixon, but not to his election. I don’t remember there being an unpopular corrupt Republican President in power before Nixon?… In Nixon’s election, the frustration of liberals was destructive because it was directed at a Democratic President.

If anything, that outrage, which as now was backed by a broad popular consensus (this time minus the press) got us a President who was much too decent for the toxic slime of the Washington political and media elites in which people like Cohen are so thoroughly soaked they can’t even smell it anymore.

It seems that Mr. Fitzgerald is trying to determine whether the decision to “assassinate†Wilson was made by Libby and Rove alone, separately, or whether it was part of a group decision, and who was involved in making that decision, if there was one. He has already disclosed that at least two meetings occurred where this subject was discussed among some/all of WHIG (June 12, 2003, in the Vice President’s office and July 12, 2003, on the Vice President’s plane). President Bush has acknowledged another meeting that he participated in with some/all of WHIG where this subject was discussed (thus WHIG+W). It is interesting that President Bush volunteered that he “de-classified†certain information, but it is still to be seen whether he did in fact de-classify that information before it was disclosed.
For me Libby and Rove are “mob†hit men that tried to hide the crime they committed by throwing sand in the air to blind the FBI, Mr. Fitzgerald, and the Grand Jury. They are also trying to obscure another level of crime: did WHIG+W commit a crime by agreeing to bring down Joseph Wilson by “outing†his wife through the knowing disclosure of classified information.
Patrick Fitzgerald is prosecuting Libby, and I believe Rove, for throwing sand. Mr. Fitzgerald has said that he cannot see yet what actually happened, whether crimes were committed. He can only see the sand and knows who threw it.

If this Plame thing FDLers are so obsessed about was really sexy, like say the Michael Jackson trial for child molestation, then maybe there’d be someone willing to stage a mock re-enactment in the form of a C&L type video link continuously up-dated as if it were a blog. Remember the live re-enactments of the Jackson trial?
It would be cool (and very powerful) to have a video blog (with actors, scenery, scripts and everything) to re-enact the Plame story with continuous up-dates as more is learned with each passing day and Grand Jury appearance.
A blog soap opera of The Plame Affair, if you will, on a video loop and updated daily as new facts are learned.
