Juan Cole has discovered a new game. I think we should join in. It's called "All Right, Not All Right." The facts of the game are something we started talking about yesterday. It began with the Leaker in Chief being able to leak classified information for political purposes. Then our Leaker in Chief gives the information to Deadeye Dick, who then dispenses the information to Karl Rove and Scooter Libby. There's no problem with that, evidently. But when Mary McCarthy shares information about black sites where President Bush, through the permission of Attorney General Alberto Gonzales, is sanctioning torture, as Cole says, that's "not all right."
Well, let's take this game a step further. Enter the Secretary of State Condoleezza Rice. Larry Frankllin is now in jail for passing documents to AIPAC, which then got to the Israeli embassy. But when Dr. Rice discusses the same documents that put Larry Franklin in jail with Steve Rosen, it's just hunky-dory. As Larry Johnson said yesterday, something smells.
Bush administration officials, including Condoleezza Rice, reportedly will be asked to testify in the Virginia espionage case of former Israeli lobbyists.
U.S. District Court Judge T.S. Ellis allowed the defense of former staff members of the American Israeli Public Affairs Committee to subpoena Secretary of State Rice, along with former Middle East envoy Anthony Zinni, former assistant Secretary of State for Near East William Burns and Burns' former deputy David Satterfield, The Jerusalem Post reports.
Burns is now ambassador to Moscow and Satterfield the deputy chief of mission in Baghdad.
Steve Rosen and Keith Weissman are accused of passing on U.S. defense secrets to Israel.
Former Pentagon analyst Larry Franklin pleaded guilty to giving the information to the two and was sentenced to 12 years in prison.
But Rosen and Weissman said the information was the same that was passed to them from Rice and the other four, and not an anomaly.
When I think of Condoleezza Rice testifying only one image comes to mind. You might remember it as well. It was that moment in front of the 9/11 Commission when Richard Ben-Veniste asked her about the now infamous PDB: BIN LADEN DETERMINED TO STRIKE IN U.S. One has to wonder if Dr. Rice will have a similar moment during her upcoming testimony, which has yet another member of the Bush administration hauled into court for some dubious shenanigans in which they've been engaged.
The convergence of Dr. Rice, the bombshell that she was also may be a leaker, along with yet another tape of Osama harkens back to the question I still don't understand. Why is Osama bin Laden still alive? No, his death -- because he will never allow us to capture him alive -- won't stop terrorism. It's not that his death will solve our problems either. It's that punishing this man is finishing the chapter on 9/11, though the book will forever remain open. Instead we went into Iraq. That we're still being taunted by yet another edition of Osama's greatest hits makes Bush's incompetence on national security all the more dangerous. It's not a game we're playing, unfortunately, but the Leaker in Chief hasn't a clue.

The rules of the game are simple, leaks that are in the Republican party’s interest generally and Bush administration’s interest specifically (whether or not they are in the public interest) are good. Leaks that are in the public interest alone but damage the Republicans/Bush administration are bad Bad BAD!

IMO, there will be no need for a ‘defense fund’ for Mary McCarthy. They can’t dare try her - information emerging from discovery would be devastating. (OTOH, if I were a betting man, I’d have long ago gone broke betting against ’surely they can’t be *that* stupid’…) However, I just don’t see a criminal trial in her future.
I would be willing though, to include a few dollars out of each weekly budget to contribute to a suit brought by Mary McCarthy for wrongful termination….

If you are policing me with your unkind comment, I think the post is about leaking classified information, and the political considerations dictating the consequences, or not. Maybe I just don’t get what you see as the subject, but “blathering” is not a word that I expect to see aimed at whoever your target is.
More topically, just what defense secrets doesn’t Israel have already? It seems they’ve infiltrated our security/defense establishment so thoroughly you are a bit surprised there’s anything left to steal.

I’ll probably get hammered for this, but selective enforcement of existing laws has long been a tool of the Executive.
Even as far back as Andrew Jackson that was so. I’m trying to recall the specific circumstance (I think it had to do with the removal of the Cherokee), but the Supreme Court ruled against him. Jackson replied “the Chief Justice has rendered his decision, now let him enforce it” and continued doing as he pleased.
I still don’t believe that this behaviour or action is *right*…I”m only noting that it has historical precedent. To me, this usually smacks of Imperial Presidency, and used to be a good indicator of how little regard the President had for the populace (or at least for the Congress and/or Courts).
November can’t come quickly enough….This administration has enough time between now and then to recover enough of their damaged reputation to prevent a Democratic sweep, or, their party operatives will make sure the game is sufficiently rigged that the Dems won’t win even if they did. After all, those who cast the vote matter less in the end than those who count the vote, these days….
The leaks, the total incompetence, the rising gas prices are all increasing the pressure on the Republicans. There is even gossip of the GOP firing Rumsfeld and retiring Cheney. The thing is nothing at all will happen. As with the discussion with Senator Murray’s staff below, the most obvious policies to avoid the collapse of the US economy or WWIII are being blithely ignored.
Why. Democrats and Republicans politicians have gerrymandered Congress and their sources of money so they and their supporters all get their piece of the pie. Their one and only goal is milking cash from American citizens. I am more and more convinced that the 2006 election will change nothing unless disaster strikes and then the election will be called off.

Democratic leaders should be on the soap box, RIGHT NOW, demanding a congressional investigation into the allegation of Rice’s leaks. Oh…we won’t GET a congressional investigation, but the plea would be well-heard and resonate. Virtually no downside to banging the drum over this.
My beloved democrats sometimes frustrate me. It’s as if they’ve lost the will to ATTACK. This Rice allegation is like a gaping hole in the repub defensive line. Those repub linemen are standing around with their hands on their hips, winded. What to do? A smart football coach doesn’t get fancy or nuanced…in these conditions he rams the football right up the middle…over and over.

The wingnut club spent the entire Clinton era biding their time, building political infrastructure.. slowly infusing their ideologues into Congress, the bureaucracy, the Republican party apparatus, the military, etc, etc, etc. By the time 2000 came around, a cabal of ruthless and evil men simply activated this apparatus, instantly outmaneauvering, outorganizing, outfundraising, outclassing us in every sense imagineable. These brown shirts sinmply walked in and took over.
If we ever want to rule again, for more than a single term, we have to destroy this apparatus, at all levels, from the grassroots up to the White House, with the same ruthlessness with which it was constructed in the first place.
And we have to have our own apparatus. Maybe Moveon or whoever their successors will be can do that for us, maybe it’s the Janes of the world, who now run the leftyblogs, I don’t know. But after we get back Congress, somebody’s going to have create our political infrastructure. And be ready to greet the next wingnut to emerge with even a hint of political ambition, with a boot in the face.

Mary McCarthys “leak” resurrects an underlying debate that all of us should re-visit and keep front and center in our minds when discussing the depraved criminality of the Bush administration and their enablers….

STATE-SANCTIONED TORTURE
One of the things that I think gets less attention than it deserves in the debate about torture is the crucial difference between torture and state-sanctioned torture. It’s an important distinction, and one that’s too often elided.
The infamous “ticking bomb scenario,” for example, asks whether we should torture someone if we had good reason to believe that this would cause our prisoner to reveal the location of the bomb and save thousands of innocent lives. Should we?
Keep in mind that it’s not practical issues that are at stake in this thought experiment. Rather, the question is simpler: assuming that torture would actually work in this case, would you do it?
I would. Likewise, in the unlikely event that I could travel back in time and murder Hitler, I’d do that too. In the imperfect world we inhabit, it’s simply not possible to say that there are never any circumstances in which we might choose the lesser of two evils.
But that’s not and never has been the question at stake in the torture debate. The real question is whether the United States should support the routine use of state-sanctioned torture, and that’s quite a different thing. Are beatings, waterboardings, endless hours of stress positions, cigarette butts in ear opening, strangulations, sleep deprivation, and murder examples of torture? And as a routine matter, should the CIA be allowed to use these techniques on prisoners in order to coerce information out of them?
I’m not naive enough to think that the United States has never engaged in torture. But even though we’ve fought in more than dozen wars in the past 70 years, some of them against existential enemies far more dangerous than al-Qaeda, we’ve never felt that routine torture — or even abuse — of prisoners should be government policy. On the contrary: it’s the kind of thing we always believed that only our enemies engaged in. But now we have met the enemy. And it is us.
In our hearts, we all know that state sanctioned torture has long been the exclusive tool of the thugs and dictators we’ve spent most of our history reviling. For reasons both moral and practical, we shouldn’t join their company.

Steiner was hardly the first or last victim to be spoofed by Papcun’s team members. To refine their method, they took various high quality recordings of generals and experimented with creating fake statements. One of the most memorable is Colin Powell stating “I am being treated well by my captors.”

Am I being too simplistic to think that:
1) If the information Mary McCarthy provided to Dana Priest was false, she commited no crime.
2) If the information MM provided DP was regarding an illegal operation, or was illegally classified, she commited no crime.
3) Even though the CIA could fire her for not follwing whistleblower protocol, they would be foolish to disallow her pension and subject themselves to civil suit. (Has there been any discussion on whether or not she did or didn’t follw WB protocol?)

Anyone want to bet that if the heat gets turned up high enough, Bush will ride to Condi’s rescue and admit that he “declassified” whatever it was she “leaked,” thus rendering what she said not a leak? I mean, isn’t that how this game is played?
I think the most important bit of information to get out in the mainstream - and maybe we have to shame them into it - is that it is not possible to classify information about activities that are illegal. One has to wonder how many other illegal activities and programs exist and are as yet unknown because they are “classified.”
And while it may be routine to polygraph those working in the CIA and NSA, does anyone doubt that the Mary McCarthy firing is designed to button the lips of anyone else within these organizations who might dare to reveal illegal activities? By extension, the threats to polygraph reporters are part of the same design.
We can only hope that these fascist actions will spur investigations, rather than chill disclosure.
Goopers have been playing down expectations for the 06 elections for some time. They want it to be viewed as a major victory if they hold both houses- even if by only one seat.
If they lose even one house- they are convinced that it will be catastrophic for them. Clusterfuck will be unmasked- goopers will be forced to make a decision as to whether to defend him or not- and it all gets uglier from there as to the likely scenarios following his term.
They will do whatever it takes to hold majorities. They think that their lives depend on it.

OT The problem with making your employees sign side agreements, such as non-disclosure agreements, is that your contract of employment no longer is an integrated contract. The first thing you have to do when you litigate is prove the contract of employment. This is particularly troublesome in a civil service regimen where the job description or class specification or whatever it’s called is essentially regulatory. How many other documents or regulations, guidelines, statutes, etc., govern the work of IG’s in particular or U. S. government employees ingeneral?
I do not believe Bush is interested in getting bin Laden. He’s making zero effort to get him. And, if the chapter is closed on 9/11, where does that leave Bush? Even before 9/11, people in the Bush administration were talking about needing a “Pearl Harbor-like event” to justify war against Afghanistan (where the Taliban were refusing to agree to a Unocal pipeline), Iraq (becaue of old scores and oil), and Iran (basically the same reasons as Iraq).
It is deliberate and conscious policy to allow bin Laden to remain free, at least until the US has dealt with Iran. 9/11 was mana from heaven for the neocons, and they’ve been milking it for all it’s worth. They’re not about to kill the goose that laid the golden egg.
Federal employees keeping silent about worldwide slaughter and domestic treason so they can keep there jobs make me want to puke. Public service? Puleeeze! I’d wear out 17 copy machines and be flappin my mouth like crazy.
