But secret information that supports their policies, particularly about the Iraq war, has surfaced everywhere from the U.N. Security Council to major newspapers and magazines. Much of the information that the administration leaked or declassified, however, has proved to be incomplete, exaggerated, incorrect or fabricated.

I have been reading non-stop for hours. Jane and Christy, Mary, lph, and everyone have have been absolutely wonderful in the lively and smart exchange about the Leaker-in-Chief and all things plame-related. I can’t begin to tell you how much I’ve learned. And jojo, yes, the EFF lawsuit against AT&T certainly does bother me. If there isn’t a full. stop. soon, I can’t imagine how bad things will be in another week, or month, or god forbid, two+ more years.

EFF’s evidence regarding AT&T’s dragnet surveillance of its networks includes a declaration by Mark Klein, a retired AT&T telecommunications technician, and several internal AT&T documents. This evidence was bolstered and explained by the expert opinion of J. Scott Marcus, who served as Senior Advisor for Internet Technology to the Federal Communications Commission from July 2001 until July 2005.

If, as McClellan contends, the selective leaks by the administration were made with the public’s interest im mind, they should be willing to provide a list of each and every instance when that’s been done. As well, they should be prepared to cite the specific misinformation the leaks were meant to correct.
Of course, the lying weasels won’t be able or willing to do it. But the White House press corps(e), or the fighting giants of the democratic party, should continue to insist it be done.

And a lawyer for AT&T sought to prevent the documents being filed with the court, even under seal, in the following April 4 letter:

The three AT&T Documents have been furnished to engineers at AT&T. I am informed that these documents relate to the technical structure of AT&T telephone networks and are extremely sensitive in nature—for reasons having nothing to do with the subject matter of this case. Were they or any one of them to fall into the wrong hands, they could be used to “hack†into the AT&T network, compromising its integrity.
. . . we ask that:
• You not file these documents, even under seal pursuant to Civil L.R. 79-5(d),
without prior leave of court.
• You provide us with a log detailing exactly who has seen or been given access to, or copies of, these documents.
• You return all copies of these documents to AT&T and refrain from using them, pending a judicial determination as to whether you have the right to possess them, obtain them through normal discovery and/or use them in litigation.
• You identify the former AT&T employee and his/her counsel to us so that we may seek the return of the documents from them and ensure that they will not disseminate the documents any further than they already have.

And then the Electronic Frontier Foundation’s lawyer replied to AT&T’s lawyer thusly:

Our case alleges that every day AT&T is violating the law and privacy of millions of AT&T customers, and those who communicate with them, by diverting their communications to the government. These allegations are critical to the public interest and are supported by the documents. We must take appropriate steps to stop what we believe is a gross violation of law as soon as possible and those steps must include presenting our evidence to the court.

So it seems that EFF has got its hands on some pretty incriminating documents, which it contends demonstrate how AT&T opens up its datastream to the NSA to faciliate the government wiretapping us.

Actually, today’s Wapo story advanced the ball a bit. Buried deep in the story is this new snippet:
Libby also leaked information from the National Intelligence Estimate to Bob Woodward of The Washington Post prior to the date that the White House said it was officially declassified. In sworn testimony, Woodward told Fitzgerald that on June 27, 2003 — 11 days before the Libby-Miller conversation — Libby told him about the CIA estimate and an Iraqi effort to obtain “yellowcake” uranium in Africa, according to a statement Woodward released on Nov. 14, 2005.
In an interview, Woodward said his notes, which were not released publicly but were shown to Fitzgerald, included Libby using the word “vigorous” to describe the Iraqi effort. Libby used similar language when he provided the NIE information Bush declassified to Miller at their July 8, 2003, meeting, according to Fitzgerald’s filing.
The precise status of the information at the time Libby provided it to Woodward is unclear because of conflicting accounts of the declassification process provided by Libby and McClellan. Fitzgerald’s court filing does not provide the date when Bush and Cheney — who have both been interviewed by the special prosecutor — said they authorized Libby’s disclosures.
WH seems to be saying that that they “pre-disclosed” the info to NYT because it was going to be officially declassified a week later anyway. Now, this puts the leak about 20 days before the July 18 official declassification date.
Also, what is interesting to me that they selected Woodward and Miller to leak this.
But anyone with street sense could have told them that those two wouldn’t or couldn’t publish those stories. Woodward would have - and has - kept it for his book and by that time, Miller was asked to “stand in the corner”
by NYT editors because of her WMD reporting and at least some NYT editors were questioning themselves. So WH had to go to the B-team guy Novak, who was ready and willing to oblige.
