– Pat Fitzgerald is working with a new grand jury, continuing an investigation that has "senior administration officials" stumbling over each other to grab a journalist and deny they’ve ever spoken with Bob Woodward.
– Congress is pissing on his legislative goals. Again.
As the House and Senate struggled with spending and tax measures, two of Mr. Bush’s main objectives – oil-drilling in Alaska’s National Wildlife Refuge and an extension of the deep cuts to taxes on capital gains and dividends – were shelved by opposition from Democrats and some moderate Republicans.
The defeats for the White House on the oil-drilling and tax-cut proposals came as Senate Democrats threatened to mount a filibuster against extension of the USA Patriot Act, which was enacted just after the Sept. 11 attacks and is a centerpiece of Mr. Bush’s antiterrorism policies. Democrats have been joined by several Republicans, some of them conservative, in contending that some parts of the act intrude too much on personal privacy in the name of national security.
Hmmmm…sucks when your pets in Congress decide to stand on their own feet again and actually do their jobs, doesn’t it?
– Jack Murtha is all over the news. Still. And making reporters look like shills for asking him stupid questions about your political spin hack friends instead of sticking to the issues. Gotta love that. (And he made Norah O’Donnell look like she wanted to cry on MSNBC earlier, in a segment that concluded with the MSNBC anchors talking about how impressive, patriotic and decent a guy Murtha is. – Remember last week when the DOJ was trying to downplay losing so many of its experienced civil rights attorneys? Well, turns out that Georgia "worse than Jim Crow" case the DOJ wanted championed was pooh poohed internally — and overrulled by Administration appointees higher up in the chain. The WaPo has the scoop. Nice — now the GOP is trying to cut benefits for the poor out of the budget and tinker with race relations. Really good combo. Ahem.
– Oh, and Iraq? Not so good.
And that’s just for starters. I could keep going on and on, but a girl only has so much time. No wonder Bushie fled to Asia this week for horsemanship and archery shows.

CORRECTION: Oh, and it just gets better. In re-reading the "indictment" article, at Pach’s suggestion, it wasn’t an indictment after all. It was an information.
In a one-count criminal information filed by the government, Scanlon was charged with conspiring with another lobbyist, who was not identified.
Although the document lists Scanlon’s co-conspirator only as "Lobbyist A," it has been a matter of public record for more than a year that Scanlon and Abramoff had a fee-splitting arrangement and represented several Indian tribes.
For the non-legal folks among us, what this most likely means is that Jack Abramoff’s partner cut a deal — which likely means that he has flipped and turned State’s evidence. Oh man. What a glorious, schadenfreude-filled Friday this is turning out to be.

FWIW, while I was in the car NPR news up date said Fritz had a new grand jury. The got it wrong a bit, but the point was they thought it was important enough to have it in their hourly news summary.

The big downside was sports. My company had a box at the Delta center and the AAA ball park. And we’d have clients come in from out of town, so of course you want to bring them to an event. So one night I’m at a basketball game with 9 oil refinery operators from the MidWest. Only to discover that to liker them up, we had to leave the box, go down to the main level, buy our beers, and lug them up. The company was just too Mormon to have a liquor license. Boy was that embarrassing. And a pain in the ass. How can you have a luxury box with no liquor license??

I actually lived in UT for two years. Since I had lived in SoCal’s inland empire (there are numerically more Mormons in Orange and SD counties than in all of UT), I was used to the culture. So it wasn’t so bad–you were guaranteed to have the mountains to yourself every Sunday morning. And frankly, the liquor laws were slightly less byzantine than those of PA.

It turns out that Fitzgerald has questioned Washington Post reporter Glenn Kessler (as well as Walter Pincus) about the leak. While all attention is focused on Woodward, it is also important to focus on Kessler because he is also mentioned in the AIPAC probe in a report by the Jewish Telegraph Agency:

I think these guys are more likely to hang themselves if they continue to have security clearances. That is, they’re more likely to fuckup once again. So allowing them to keep their SC is a way to let them hang themselvs.
I think Fitz probably has a greater respect for authority, for not wanting to do really bad things (look at his caution at subpoenaing journalists, his nod to executive privilege, doing Bush and Cheney’s interview not under oath. his caution with espionage). This may be more of the same.
Once people lose security clearances, they lose their job. Which means he can’t hide what he knows any longer. And, once they lose their job, they can have Cheney’s deep-pocketed friends pay for their defense. Libby has $5 million already for defense, from undisclosed sources. Better to let them piddle along with their self-paid lawyers until you have things really sewn up.
I mentioned at the end of a thread a few days ago that during the Watergate scandal, Richard Nixon in 1974 would wander the rooms and halls of the White House at night, talking to the portraits of Abraham Lincoln. Other earlier presidents have been reported to do this, too. The phenomenon is called “getting right with Lincoln”. Bush can’t do this: he is asleep by nightfall, and he can’t speak English so that Lincoln could understand it.

I saw the MSNBC interview with Rep. Murtha today. He fielded the questions with real dignity (and indignity at how stupid he made them sound!) Murtha is the worst nightmare for W’s war cabal – a distinguished vet who visits wounded soldiers in the hospital every week, and who shreds the rhetoric and provides no-nonsense answers.
Murtha threw down the gauntlet. Now it’s time for the Dems to come up with a workable exit strategy for Iraq, and get together and start pushing it as a solid group. We should quit complaining about the war and start providing real solutions.
Because the Repugs ain’t gonna do anything anytime soon.
Also, Wyo, Idaho, and Utah just have no large urban areas to balance out their very conservative rural populations.

You know, ever since 9-11, I’ve just been overwhelmed with the stench of death and suffering that has occurred on this administration’s watch. And no, I’m not blaming 9-11 on BushCo, but jeez, I’m convinced these guys are capable of just about anything.
My point is, since 9-11 we’ve had anthrax scares, snipers, two wars, terrorism around the world, natural disasters. Personally, I’ve had close friends and family die in the Pentagon, of cancer, and the daughter of an English friend get off the bus in London only moments before it blew up. I think everybody has a story like this.
This administration’s policies have the unhappy consequence of hurting those who can least afford it-the poor, the young, the elderly, the sick. More suffering. I’m a typical middle class guy, but I’m scared for my two sons who may grow up to be draft fodder for another oil war ten years from now.
I don’t blame everything on the Bushies (actually, I do, but that’s for another rant), but, clearly, they are totally incapable of leading the country out of this era of death, destruction, and suffering in which it finds itself.
This began to change last week when reality-based Democrat leaders scored electoral victories across the country. I pray that this momentum carries through for many more elections to come. And remember, politics is local-support reality-based Dem candidates who run for mayor, city council, school board, county supervisor, etc. Those are the people who will one day be governors, senators, congresspersons, and presidents.
Fitz may or may not eventually get these assholes, but the only real change will come from us-the people.
I just should have written: Nearly all of television, b/c soap operas and talk shows also prove the point. Cable has changed it somewhat, but the idea is still valid even today.

The answer… most of the population is, of course, LDS. Now, the conclusions that many will draw from that are probably wrong. It’s not about ideology, whiteness, or anything like that.

Thaxter, I’m no lawyer, but I can imagine three reasons:
1) Innocent until proven guilty. His interest is in the criminal case, and not the enforcement of executive branch policies.
2) Taking on that issue detracts from his focus. It’s a side issue. Singularity of purpose is one of his strenths. he hits hardest at the biggest issue after preparation and on his own terms.
3) Taking on that argument would require the sharing of evidence to back it up that might compromise some of his other work. he runs a quiet shop for a reason. The element of surprise is his friend.
Lots of sites (but I’m looking at Suburban Guerrilla) have the House mulling the possibility of putting a non-binding resolution that would “register and up-or-down vote” concerning Rep. Murtha’s call for withdrawal.
Apparently the R’s think this might be a good tactic to paint the D’s who vote for it as being cowards.
I expect they’re doing the whip count right now. Hope it scares them.

Do any of the intelligent people here have input on the civil measures Fitzgerald could take in restricting national security clearance to those who have violated it . . . and why he may have rejected this option because it ultimately hurts his case?
Rove and other leakers are still receiving classified information. I didn’t know that Fitzgerald had the means to revoke this privilege through civil litigation, but apparently he does.
Is it possible that Fitzgerald has a larger goal in mind, and if so, what might that be?
Also, how might that goal be weighed in relation to the potential risk posed by the continued presence in the administration of those who have demonstrably dishonored their national security contracts?
I appreciate those who reassert we must have faith in Fitzgerald. I have a great deal of faith in him, yet I still would like to know the possible reasoning behind why he has avoided, so far, “cleaning house” before prosecuting the criminal case.
I’m not sure but I think Sen. John Sununu (R-NH) is possibly onboard with a filibuster alongside Feingold. He’s been a partner in what Feingold has been doing to this point (see editorial link). I hope he goes all the way alongside him.
