Why would Scooter Libby tell such an intricate series of lies, which were clearly contradicted by his own detailed notes, unless…he’s covering for someone else. Say, his boss.
In the opening days of the CIA leak investigation in early October 2003, FBI agents working the case already had in their possession a wealth of valuable evidence. There were White House phone and visitor logs, which clearly documented the administration’s contacts with reporters.And they had something that law enforcement officials would later describe as their “guidebook” for the opening phase of the investigation: the daily, diary-like notes compiled by I. Lewis “Scooter” Libby, then Vice President Cheney’s chief of staff, that chronicled crucial events inside the White House in the weeks before the identity of CIA operative Valerie Plame was publicly disclosed.
Even the WaPo has started speculating about Libby’s stupid decision to make his case all about “journalists told me…no, really.”
To critics, the timing suggests an attempt to obscure Cheney’s role, and possibly his legal culpability. The vice president is shown by the indictment to be aware of and interested in Plame and her CIA status long before her cover was blown. Even some White House aides privately wonder whether Libby was seeking to protect Cheney from political embarrassment. One of them noted with resignation, “Obviously, the indictment speaks for itself.”In addition, Cheney also advised Libby on a media strategy to counter Plame’s husband, former ambassador Wilson, according to a person familiar with the case.
Gee, wonder why all eyes have been on Dick Cheney? Hmmm…I wonder. *snerk*
And who does the WaPo interview for the GOP perspective? Why look, it’s Victoria Toensing, attempting to spin things for her team again.
“People have different memories,” said lawyer Victoria Toensing, a Justice Department official in the Reagan administration. She said the fact that Fitzgerald did not indict on the crime he set out to investigate — illegal disclosure of classified evidence — supports the conclusion that no such crime took place. Fitzgerald has said he could not make such a determination because his inquiry was obstructed by Libby’s deceptions.
Wrong. Wrong. Wrong. Shamefully wrong. Toensing rides on her prior DoJ laurels way too often in pretending to speak for prosecutors nationwide and she steps way over the line here.
The truth is, prosecutors often face a defendant that is guilty as sin, and they know it — but the evidence gathered by investigators isn’t enough to make the full case. You can’t charge something unless and until you have the evidence to meet every count, but that sure as hell doesn’t mean that you don’t know a crime has been committed, and that you wouldn’t love to be able to charge that crime if you had the evidence to do so.
I can personally name a number of people that I had to charge with lesser offenses that I would suit back up again just to charge them with the full load if the evidence became available.
And where you have a defendant who is deliberately lying in order to obstruct your investigation, perhaps to protect his boss and others in the Administration, you have someone who deserves prosecution to the fullest extent of the law. Period.
I wish someone in the MSM would ask Victoria (or her apologist hubby Joe DeGenova) how many times they charged Obstruction, Perjury and False Statements in their careers with the DoJ — and how important those charges are as tools for getting to the heart of a criminal enterprise (you know, like the mob or a drug cartel conspiracy, ahem).
One interesting tidbit in the WaPo article was this:
Libby’s defense must also reckon with his own notes. Lawyers familiar with the case said in general his notes do not recount the details of conversations and do not specifically contradict his account to investigators. Usually the notes explain with whom he met each day. One remarkable exception was when he chronicled a meeting with his boss on or about June 12, in which Libby wrote that Cheney told him that he learned from the CIA that Wilson’s wife worked at the agency.
Hmmmm…was Libby taking detailed notes in this instance as a form of pardon insurance? But, with Cheney’s waning influence with Bushie, the dangling threat of further charges looming in the case for Rove and for a potentially broader conspiracy, and the substantially sagging Preznit poll numbers — and the even more waning influence that Bushie has with anyone in Congress — well, that pardon isn’t looking so certain these days, now is it?
Do you risk the rest of your life on a Preznit that governs on petulant whims? Do you risk Rove not stabbing you further in the back — or trust Dick Cheney to do the right thing by you? Don’t know about Scooty Poot, but were I his wife, I’d be bending his ear about negotiating something more definite with Fitz — he seems like a guy that actually keeps his word.

That was my impression as well. I’ve kept my eyes peeled for follow-up, and haven’t seen anything. You’d probably need the FBI to comment, and they won’t comment, I’m sure.
When there’s the whole question of “which FBI?” whenever there’s an investigation: the career FBI and DOJ people who’ve been fucked over by the administration and held back from doing their duties for so long (there was just an article yesterday about how demoralized the Civil Rights Division of DoJ is because they’re not allowed to do their job), or the part of the FBI and DoJ who’s looking to cover corrupt GOP ass?
It’s hard to tell as an observer on the outside. There are internecine wars going on in almost every agency.

i saw something about this on the net a week or two ago. as i remember, di santo is an aide or at least a colleague for/of congressman grassley. he’s a republican but he’s a pretty tough and seemingly independent guy. i used to live in iowa and met his brother who is an eccentric who lives in a very small house out in the country.
congressman grassley is an old school conservative. he seems to take a pretty dim view of the whole delay phenomena in the house.
that attack somehow smells like the modus operandi of jackie a’s associates. remember they offed a guy down in florida over a deal gone sour.

Has anyone seen anything further about Emilia DiSanto, the woman someone apparently intended to kill with a baseball bat? I know that she was involved in investigating the Sibel Edmonds whistleblower claims. Bobby — Preznit Clusterfuck tried yapping about martial law in the event of a flu pandemic. There was a swift reaction — a recoiling, in horror, from most segments of the population. The UN black helicopter crowd was definitely not pleased, either. Uniformed military types were quoted in news articles, undermining Clusterfuck’s whole approach.
Successful imposition of martial law requires having the military in your pocket in terms of loyal support. He ain’t got that.
Bush is on a hell bound train.
He can’t afford to discuss Rove. He can’t EVER talk about what he knew and when he knew it. He can’t say:
“Rove lied to me” without explaining why he has left him around.
He can’t say “Rove told me the truth” without convicting himself of obstruction.
He’s in a box- that he built himself. Everything he does from here on out will be an attempt to make people forget the box.
Why would Libby lie? He was in a trap between the President and the Prosecutor. His boss, the President, said that the leaker would be dealt with. The President said that everyone must fully cooperate. He was the leaker. He panicked.
As for the notes with Cheney, yes Libby was able to look into the future and know that this would be referred to DOJ and that he would be dealing with a SP.
Seriously, he took more detailed notes for the same reason we all take detailed notes at work. It was an important meeting w/the Boss who was ticked about a clown named Wilson.

I read that WaPo article and it is like the entire Administration is filled with Wizards of Oz who keep saying, “Who are you going to believe? Me, or your own lying eyes?”
The lynch pin for this case will be Scooter Libby’s wife and how long she will tolerate him being in prison and away from her kids.
If she is any kind of parent, she will lay the law down to Scooter and tell him that he has a responsibility to his children first. Cheney can go take care of his own mess.

I listened carefully to Fitzgerald’s news conference and read the indictment.
Several points;
-he specifically stated that Cheney did nothing illegal or improper in discussing Wilson and Plame with his COS;
-he indicated his work is substantially complete;
-the only one still under any cloud is Rove and that is for making false statements.
Cheney will be a witness for the prosecution in any Libby trial and probably a more reliable one than the media members
I suspect that Cheney told Fitzgerald all about his conversations with Libby and the fact that there was no charge for an underlying crime means that he found what the VP did perfectly legal and reasonable.

It would serve no purpose but this: Americans would pause to consider just why the president would refuse to respond to the question, as most certainly would continue to prove the case. Under most circumstances, such a refusal could be easily defended. But this is no usual circumstance. This entails a national security breach, by members of the executive branch in intimate contact with the Oval Office, and in a time of war.
The fundamental fairness of Reid’s question will resonate with all but the willfully blind. The media bagmen of this administration will stand exposed. The GOP would be forced to defend the indefensible, a few short years after impeaching a president for a blow job.
Those people must be crushed to powder. They must be exposed for who and what they are. I’ve read that Reid is considered quite a ruthless fellow when crossed. I hope that’s true. I pray that he and Pelosi possess the acumen to orchestrate the destruction of those vile abortions of humanity.
It won’t be easy, of course. Not with Jonah Goldberg now opining for the LA Times. Still, we “must endeavor to persevere”. For the sake of the children, and the puppies, and just plain goodness.

Wayne Madsen claims the U.S. is crating prisoners in kennel-sized cages and flying them around in C-130 “prison planes”:
“According to a well-placed intelligence source who served in eastern Europe, prisoners from Iraq and elsewhere have been flown from airport to airport in eastern Europe on board C-130 planes. Placed in what were described as ‘dog-sized’ cages, the covert operation became fully operational after the disclosures of prisoner abuse at Abu Ghraib, Baghdad and Camp Bucca, Umm Qasr, Iraq. The ‘crated’ prisoners were either removed from the C-130s for interrogation at Soviet-era detention centers that were in various states of repair or were kept on board the aircraft and subjected to brutal interrogation by U.S. and/or contractor personnel, who, in some cases, were ex-members of the Soviet KGB, Stasi, and other eastern European security services. Watching Bush giving his speech for Kilgore on Crooks and Liars, it’s hard to believe Bush hasn’t had some kind of stroke. It’s shocking to me because I haven’t seen Bush speak for a long time, maybe since the Kery debates–I don’t wait for my news anymore, I chase after it at places like this.

I just read it. Glad they put “The Truth About Torture” and McCain on the cover, but the article sure pulls its punches: Discussion of “torture-lite” (only one constitutional violation per serving!). The word “abuse” is often substituted for torture, as if the issue is foul language and a few slaps in the face. And the article makes a let’s-look-at-both-sides attempt to be “balanced”. About torture.
Can you imagine Newsweek discussing both sides of, say, Jim Crow laws, or ethnic cleansing?
One balance, Newsweek comes down on the side of McCain, but talk about your soft-hitting journalism… This issue deserves outrage, not handwringing.
Redd – But he hasn’t been in a hurry, which makes me wonder if hubris isn’t triumphing over common sense, at least for now.
On the other hand, he hasn’t yet seen Fitz’s discovery, has he? So maybe he’s waiting to see Fitz’s cards before making his next move.
Percy — when you add in the pressure that a deal is only sweetened when you are the first to flip, you can see the added pressure in this situation. Having represented clients on the back end of the flipping game, if you wait too long, there is no deal. In Libby’s case, would you want to put all your money on a deal waiting for you if Rove gets charged — not me. Rove would sell out whomever he had to in order to save his sorry ass, I’d bet on that in a heartbeat. Libby has to factor that into the calculations as well — and he has experienced attorneys who will help him to do just that.

As for the differing memories defense? It is the defense of all criminals. If you look at any “white collar” type trial, it comes down to “recollection.” And, invariably, it almost always fails and it will this time. If it were Scooter vs. Judy, that would be one thing,and it would have a chance. But, it is Scooter vs. a lot of reporters, plus his notes, plus his logs, plus his own anal brilliance.

Also – I want to invest a word for Gooper bullshit. My choice is Winglistics (it may or may not be original – a seach on Yahoo came up with nothing).
It would be defined as “1. whatever is said is a lie, fanciful, inane; 2. The American English dialect of the GOP (Republican Party).” Victoria Toensing’s use of Winglistics scientifically exposes her for the lying liar that she is.
Feel free to conjugate it !!!!!!

Somewhere- in the bowel of gooper america- some very powerful people are looking at the prospects for the next three years and beginning to realize that looks like a wasteland.
When they imagine what “could” have been- they are puking.
They have to be thinking about the better prognosis they would have if McCain were in the White House- all of a sudden, they are in top of the world again- and they could make it happen- in a weekend.
Cheney resigns- Bush taps McCain- Bush resigns.
I would not be surprised to see this happen in the next few months- too much money involved to keep it riding on an idiot.
Would be devastating for the dems- who would have to run against and incumbent in 08.
It would get McCain through the primaries where the snakehandlers would likely kill him.
It makes too much sense to be ignored.
Redd – excellent post. Unless Fitz is bluffing (which I sincerely doubt) he’s eventually going to unload a whole barrel of whupass on Libby, and Scooter is then going to have to make the bet of his life: Count on a get-out-of-jail-free card from an increasingly dysfunctional, back-stabbing WH, headed (nominally) by an unstable GWB, or cop a plea and know for sure that he’ll get to spend *some* of his remaining lifetime with his family.
No one can read the man for sure, but I’d happily give even odds and put another bottle of single malt on the table, that eventually Libby is going to flip (unless some WH aid beats him to it. Tick, tick, tick…)

There is something seriously wrong in America.
1) The upcoming trial of “Scooter” Libby: He claims he is a busy man and does not remember his contacts or information that was given to him in regards to the Valerie Plame case. He spoke with his boss Richard Cheney. He took notes. He ordered reports on Ms. Plame. He spoke with his aides.
Then when asked… He forgets everything? This man was given a high level position in the White House, as a Presidential aide. With a security clearance.
If he is not guilty, he is completely incompetent. This is the level of personnel President Bush chooses for his top aides? I seriously question the veracity of the White House on _all_ matters. This is inexcusable.
2) Secret Prisons. The White House clearly approves of the use of torture in secret detention facilities. There has already been documented prisoner abuse and deaths from torture in Iraq. There is the “Gitmo” detention facility, where detainees without legal counsel or trial are being held and abused. They have become so depressed and dejected they have stopped eating. Yet Rumsfeld says it is normal for people to go on diets periodically? You don’t have to force feed people that are on diets in order to keep them alive. These men are being punished to death for crimes they have never been formally charged for. I would bet money that prisoner treatment in secret facilities is much worse than what the public has seen at “Gitmo”, and that is enough to turn my stomach.
3) Outing intelligence resources. The President promised Americans that he would investigate the outing of Ms. Plame. He did nothing. Patrick Fitzgerald has implicated Karl Rove, the President has done nothing. Somebody in the White House is guilty of a high crime against the people of the United States of America. Nobody will come clean, nobody will admit the truth. When “Scooter” Libby was indicted, he was not even fired. He resigned, and the White House expressed their sympathies. What kind of people are these?
4) The war in Iraq is going very poorly. Why are we there? Is it to stop the production of weapons of mass destruction that did not exist? It becomes more and more clear to America that we as a people were lied to by the Bush administration for the purposes of engaging in illegal warfare. People that would lie in order to take a country to war, would lie about anything. Indeed, from all appearance, they lie about virtually _everything_.
5) The budget has run away. Federal spending has been soaring, there is no accountability for where the money is going. Services have been declining. Billions of dollars in development money has been sent to Iraq, and there is virtually nothing to show for it. The money has been stolen, embezzled, or misspent.
Billions of dollars were appropriated for the victims of hurricane Katrina. The contracts were awarded on a no-bid basis, just like Iraq, the money was given to companies with close ties to the White House. I highly suspect the existence of complicated kickback schemes and racketeering. Judging from the ethical standards this administration goes by, it is safe to assume that like Iraq, much of this money has been stolen from the American people.
Instead of a democracy being led by the people, for the people; our country looks more like it is being led by a gang of hardened criminals. People who want to torture, oppress and suppress their enemies. People who lie, cheat, and steal. People who have no regard for human life. People that lie to engage in war and high crime.
Is this the kind of America _you_ support?

I continue to doubt that there will EVER be a Libby trial. Whatever happened there would be very bad news for the White House.
Libby will put on a brave fighting face and there will be plenty of discussions about his “defense” etc.- but at the eleventh hour- he’ll plea out— and at the thirteenth hour- Bush will pardon him- unless Fitzy has the goods on the larger case- in that case- it could get VERY interesting.
