Last night’s outcome wasn’t just the by-product by Bush’s late hour visit. Kilgore lacked substance and ideas and ran the one of the nastiest campaigns imaginable. (A 72-year Japanese friend of mine who speaks only broken English wanted to vote for the first time because Kilgore had pissed her off in some way with those ads.) Warner’s endorsement of course had alot to do with it all.

The illegality of disclosing the existence of the Black Sites derives from the fact that the information is classified. Otherwise talking about them would not be illegal. So you have the conundrum that if you want to hide illegal activity, and you have the power to do so, you classify the information. That also gives the illegal sites a patina of legality.
Leaking about the existence of the Black Sites may therefore be illegal, but it could be an illegal act in order to expose another, possibly illegal act (violation of the Geneva convention and possibly some domestic laws in the nations hosting the sites). So it could fall under the category of “whistle blowing.”
By contrast the Plame leak was not whistle blowing, but if anything “blow-back” against Wilson.
Who knows what the true motivation of the leaker(s) is in the Black Sites case, whether political, patriotic, or a mixture.
The crux of the matter is whether the public has a right to know about the existence of these facilities. My gut feeling is that it will take the Supreme Court to decide. And since the court is being stacked with people who believe in unbridled executive power in time of war, I think the assertion will be that, in this case, the public has no right to know because the security of the country would be compromised.
Maybe so, but a misled and deceived public will be the loser. And that is not even factoring in the moral questions about these sites.
On the subject of prosecuting leaks, knowingly leaking the identity of an agent is a felony. Leaking classified information is not. That’s a pretty easy line to draw.
Remember history. Even if Bush were to install Condi-Mushroom Rice, do you really think that would make her a shoo-in for the presidency?
A single, confirmed bachleorette, black woman? Do you really think that the “the base” would rally to her cause? The southern cracker-o-publicans would rather shit themselves than vote for a single, black woman.

I think it’s possible to fall into a trap if you don’t consider whether the “leak” regarding the torture chambers was really illegal. Is it really, or do we just want to think that because we think it was done by a republican. What if Lott is part of the Plan? Everybody yells that it’s illegal to disclose our torture chambers. But maybe that argument requires a predicate argument that the torture chambers are legal. Then, Cheney says, ” Thanks , I thought so.” Be pure good people.

CA Prop 74 just went from Yes to No with 22.7% of precincts reporting. Of the props that Swartzenneger supported, prop 75, public union dues, is the only one that is still showing as a yes, and the margin there is decreasing. (53.5% yes, down from 56%)
Marky, I understand your point, but, for me, it’s a matter of survival. If I don’t vote absentee, I don’t trust my vote being counted. Or at least counted the way I cast it.
I think we all need to consider things like this, in this day and age.

I just want to make a note of comments I have seen about McCain. Last Tuesday, during that torture lunch with Dick the Prick, he was out here in California campaigning with Ahnold.
“I hate absentee balloting.”
They expect 40% of all votes cast in this California election to be absentee. I know that I prefer it. You select absentee and as long as you vote in every election, they automatically send you the absentee ballet for each election.
I understand that a few small precincts mail out absentee ballets to every registered voter in the precinct and that is there only option. It saves them a lot of money. And apparently they have good participation.
I think that anything that you can do to make voting more convenient and get higher levels of voter participation is great. I would love to see voting at your local ATM or your computer during election week. Think of it – a nationwide, secure private network, the same level of integrity as you see in financial transaction processing, a paper receipt at the time of voting, and the ability to go online and validate that your vote was counted as you cast it.
Adam and Puzzled I think you both make very excellent points. Perhaps additional factors to throw into the equation are these: Undercover CIA agents are legitimate and legal. As a society we accept and acknowledge their existence. But are off site torture factories legal under US law? Keep in mind that the Constitution says the US is bound by its treaties, (not that this provision would actually be enforced by the “strict constructionists.”) I don’t know if it’s legal for the US to operate its torture chambers. I lke to think not. But assuming for the purposes of argument that is isn’t legal, isn’t there are a counterbalancing duty on our government to report it rather than to keep it a secret? This would all require a well-researched legal analysis. But I, for one, would not like to think that the law requires a government official to keep a heinous crime a secret while it’s actively being committed and would look for an alternative anaylsis.

the basic idea being that the disclosure of a spy’s identity is set above the simple leaking of classified information in the legal code.
A second distinction is admittedly hazier, but I think it’s equally important. Essentially, I see the leaking of classified information about policy as being quite different from the leaking of classified information about individuals. Whistleblowing tends to fall into the first category, while smear campaigns almost always fall into the second. Clearly, there are some gray areas (which category would Mark FeltÂ’s leaks have fallen into, for example?) but I still think that the difference matters a great deal, and that the distinction isnÂ’t so murky that it couldnÂ’t be recognized by, say, Congress.
Like I said, though, my thoughts on this are still kind of nascent at this point.

The mayor’s race in Cincinnati Ohio went to a Democrat, Mark Mallory. Cincinnati has had a Republican mayor for about 16 or more years, so this, too, signifies a change in environment!

It’s hard to tell anything yet. If you look at most of the Bay Area counties (as blue as you can get), there are 0 precincts in. But many of the blue counties have 20% of their precincts counted.
I am counting on this changing or it will be harder to take than that 1 indictment was when it first happened.

It looks like all 4 of the election reforms initiatives have been voted down in Ohio. Consider that these defeats were a result of the Diebold machines, which threw the presidential race in 2000 and 2004, and now most likely 2005 in Ohio. No, one could not refuse to vote on a Diebold machine in OH and still get to vote. Of course, voting on them, your vote didn’t really count either, unless you voted the Diebold way.

you make an excellent point, Adam, but I’m not sure how you can legitimately pick and choose which secret info leak to prosecute and which not to. Sure, from a partisan level (and I’m a partisan), disclosure of the torture prison has a beneficial impact and we’d like to see more of that nasty stuff disclosed. But to say ‘kings X’ on punishing someone for disclosing info that we like disclosed, but let’s punish the heck out of someone who leaks something we, as partisans, would just as soon be kept secret, makes us no different than the Repugs – and part of the beauty of what is going on is that the Repug’s relentless hypocrisy is being disclosed.
Further, some on the left would argue that outing CIA agents is itself is a good thing. So, where do you draw the line?

The most interesting question regarding the prison leak story is whether or not Cheney broke the law by spilling the beans about it to gooper senators. If so- it looks like an open and shut case.
Delicious as the prison leak story is, I’m going to play Adlai Stevenson here and suggest that even if it was GOP folks who leaked, maybe an investigation isn’t the best idea. I’m willing to reconsider, but hear me out:
The leak of Valerie Wilson’s CIA employment was malicious. The information’s exposure does almost nothing to advance the public interest; it was a carefully selected datum whose only real purpose was to harm the Wilsons. I would like to see the leakers and conspirators in this case prosecuted and taken out of office.
The leak of the prison story, by contrast, puts some very important information where it belongs: in the hands of the American people. I believe that we deserve to know what our government does in our name with its prisoners. I wouldn’t have wanted Daniel Ellsburg prosecuted for leaking the Pentagon Papers, and I’m not sure that I’d want anyone prosecuted for leaking information about black sites, regardless of what I think about the leakers’ politics.

Oh yes, and Randy Kelly, the mayor of St. Paul, the so-called Democrat who endorsed Bush last year is being fired by the good folks of St. Paul. Kelly is down by 2 to 1 with 60 percent of the votes counted. He’s the first incumbent mayor to lose an election in St. Paul since 1974.
I keep hearing national pundits spin this as irrational anger on the part of St. Paul voters. But it ain’t irrational. And yes, it IS about values. With his endorsement of Bush, Kelly proved he doesn’t share the values of most of his city’s residents. Good riddance, Randy. Don’t let the door hit you on the way out.
Of course, what are the odds of having him quickly get a job offer from W.—-or from our wing-nut Republican governor.
Maybe Randy can replace Brownie down at FEMA. Frankly, he’d do a heckuva better job.
Come on folks…this thing is a LONG way from over, we got ta make it to November ‘06. With the complete breakdown of the rulin’ party and with the courts packed full of fascist appointees, the next engagements are NOT gunna be popular referenda.

But what can we make about Ohio? Where all the Reform Ohio ballot measures appear to be going down to defeat? Especially after the Republican party in Ohio is neck-deep in its own corruption and scandal.
I’m thrilled about Virginia and New Jersey. So maybe I’m just being greedy. But I really, really, really wanted to see some reform happen in Ohio, dammit.
Any good Ohio Dems have an explanation?
