
Seems like falling on your sword to protect your boss is a habit at the White House these days. Harriet Miers withdrew her name from consideration for the Supreme court this morning, according to the WaPo.
Harriet Miers withdrew her nomination to be a Supreme Court justice Thursday in the face of stiff opposition and mounting criticism about her qualifications.
Bushie released a statement blaming the meanies in Congress for wanting actual information about his nominee. (Looks like the Krauthammer face-saving out idea came just in time.)
…He blamed her withdrawal on calls in the Senate for the release of internal White House documents that the administration has insisted were protected by executive privilege.
“It is clear that senators would not be satisfied until they gained access to internal documents concerning advice provided during her tenure at the White House — disclosures that would undermine a president’s ability to receive candid counsel,” Bush said…
Thank goodness for Harriet’s commitment to separation of powers issues and…well, and for the Republican leadership in the Senate clearly communicating to the WH that this was going to get more and more embarassing if they kept going. Oh, and that the votes were not there. Wow, thank goodness for that adherence to principles…thingy.
Good day to sink the nomination, what with all the Fitzgerald speculation occupying the media. Except, there weren’t any indictments announced yesterday to eat up the spotlight…maybe they know something we don’t in terms of what will be announced today?
Tweety was just on MSNBC saying essentially that this is an embarassment mainly for the “B-Team,” and that no one knows who is really in charge at the White House right now in terms of the top decisions in the wake of the Traitorgate investigation and all the turmoil that has gone on for months with the Administration — Katrina, Iraq, Miers, potential indictments, etc.
Okay, now I feel safer.
Ted Olson, Michael McConnell, and the other usual suspects have their names already floating around. Again. The one thing we can be certain of is that this time, some vetting my actually be done. Beyond that, all bets are off.
More as we get it on this.

MSNBC (via Chip Reid) is reporting that a Republican Senator on the Judiciary Committee phoned the President and told him that the nomination had to be withdrawn and that the votes were not there. The call occurred last night, according to the reporting. No word on the particular Senator, but they then flashed up information on Sam Brownback. Hmmmmmm…..
UPDATE #2: Some questions for this morning. Is this the point where Senators push themselves forward to fill the perceived void that Rove may be leaving in his legal distractions? Senators are not used to being told what to do, by the WH or anyone else, and the behind the scenes and public chafing at being given marching orders by Rove has been interesting to watch. Once that bit has been removed from their mouths — as it seemed to be in all of the Republican opposition to Miers — it is awfully hard to get them back in the bridle.
But which faction of Senators will win the wrestling match? The more moderate Specter judicial wing, the Christian Conservative Brownback group, or the maverick competence-touting McCain and Hegel crew? It’s going to be an interesting tea-leaf reading experience over the next few weeks as the next phase of judicial nominee contemplation occurs.
And does this mean that Rove re-asserts himself as indespensable, using the problems with this nomination to wedge himself back through the crack in the door that had widened through all the Traitorgate mess? Does he stay in place, whether or not he gets indicted, because Bush is now too afraid to make decisions without him again? Or has Rove already overplayed his hand by putting himself out in the press as the “Bush’s brain” kind of guy and the Preznit has had enough? This dynamic will be interesting to watch as well.
Finally, Ed Gillespie and a lot of other GOP operatives have been much more visible over the last few days. Has the beauty pageant started already to select the Rove replacement, regardless of what happens with the legal case, because Rove has become so radioactive? Or does this mean that Andy Card should be watching his back?

Rove could offer up the Preznit o’ these NewNighted States on a Nambe platter and Fitzgerald couldn’t do anything with it. Arbusta is immunized against indictment by his office. Fitzgerald could refer information to the House of Representatives, but if anyone believes for a moment that DeLayCo, Inc is going to offer up impeachment charges, I have a bridge in Brooklyn I’d like to sell you.
So, if Rove/Luskin is negotiating with Fitz, doesn’t it pretty much have to be Darth Cheney’s scalp he’d offer?

Why does there have to be a winning group, or a winning group quickly? When I worked in Congress as a legislative assistant I was taught there was one rule to political decision making if you have to make a decision amongst groups: Figure out which group you can fuck the most and vote the other way. I.e. you take for granted those who “have to support you.” The “conservative agenda” has never been supported by a majority of people (abortion is a great example – with 60% or so of Americans consistently supporting a right to choose), but by a small but very vocal minority. The Conservatives and their acolytes have been/are being exposed for the frauds most of them are (Preznit, Cheney, Rove, DeLay, Frist, Ralph Reed and on and on). If you are a senator, you look at what is happening (Traitorgate, Abramoff, Delay, Abramoff/Delay, Frist, and on and on)and exclaim “Free at last” from the tyranny of the minority we, and they, have lived under. Some of the Conservative politicians will stay “true” to their false gods and beliefs, but Moderates (the Spectors) or good government types (the McCains), if they are doing their political calculations, will figure that at this point in time, given the mood of the country (and a majority of their constituents), they not only don’t have to kowtow to the Conservative politicians or the conservative agenda (either the social or the economic) , but doing so would not good for their re-election campaigns – they can read polls.
We may actually get to see real government in action where different blocks have to negotiate and compromise to reach and enact decisions.
Hamilton (assuming it was him who wrote it) really was on to something in The Federalist Papers about that tyranny of the minority thing being bad.

It may have been the confluence of several “calculations” one of which you stated was the WH’s perception that they needed to get treasongate off the front page. IMO and with props to your post, WH anticipated and wanted to bait the Democrats. WH miscalculated badly with respect to conservative support badly. The Dems did a great job of holding back and letting the Republicans do the heavy lifting with respect to sinking her nomination.
After reading your post, I keep returning to the sense that both Dems and GOP understand that they have a common interest in keeping Plamegate a WH scandal, so that no one will look at the absence of oversight from the House and Senate Intelligence committees. Please someone correct me if I am wrong, but our representatives on those committees had more to read than Judy’s articles in the New York Times.

If Rove pleads guilty to any charge–perjury, obstruction, false statements–he will be forced to resign. If he refuses to plead, he will be indicted and forced to resign. I think what might be going on instead is that Rove is trying to get all charges against him dropped, in exchange for information Fitz wants. Rove and Luskin may be trying to negotiate exactly how much info they can give up without definitively incriminating Cheney and/or Bush. But Fitz holds the upper hand, since if he doesn’t like what they’re selling, he can always call off the talks and proceed forward with indictments. Does this scenario make any sense? The idea that Rove would be happy with a plea deal just doesn’t feel right. It would still remove him from the corner office in the West Wing and all the power that comes with that. So I think he’s got to be after something else.

I don’t have time to dissect everything lately Luskin’s Leak and Public Relations Shop, but if anyone has the time to go back over the last week in the major dailies, then it will be clear that:
ALL of the unsourced information about Rove’s degree of danger comes from Luskin’s Leak Shop.
THIS is a Rove/Lusking campaign to frame Rove as a hapless, innocent side player in this whole nasty business.
THE PURPOSE of this is to set a baseline of expectations pre-indictment to smear Fitzy as overzealous, bullying, partisan and unfair if he does not go easy on Karl.
BE WARNED.
That is the PR strategy. Rove is in campaign mode, for himself and for all of them. He is trying to make himself the new martyr of the brutal, out of control prosecutor. They want to use that wedge to smear the whole investigation and its aftermath.

The ramifications of illegal abortion are staggering. So, Republicans have been able to successfully hide behind their moralistic shield of being anti-abortion for years knowing if they really defeat Roe v.Wade the political consequences will be enormous and devasting. ItÂ’s hard to even imagine the changes that will result.
Meirs was the perfect candidate for continuing with their all talk and no action carrot and donkey policy. While on paper she looked like she might criminalize abortion, Bush knew he could trust her to leave the status quo relatively unchanged so he wouldn’t be tarnished.

I was also very confused about why the wingnuts didn’t catch on to Bush’s “code” about Miers. All that stuff about her being a good Chistian conservative, and was an upstanding member of some Texas church. Cripes… Even *I* knew what that meant, she would vote to repeal Roe v. Wade at the first opportunity.
Personally, I think the conservatives blew it. They threw a fit when they probably would have been quite happy with the eventual outcome.

I think the Miers nomination was a straw “woman” all along. Smirk and mirrors. She was announced on a day when something was happening, maybe about Treasongate, can’t exactly remember, wish I could. She was the story that kept on giving and kept Treasongate out of the news until really this week. Now they pull the nom with the indictments coming down soon. When they do, chimp will nominate one of the right wing nutjobs. Tomorrow or Monday. The name is all ready to throw out there. Decisions already made. This will keep the story going on all angles. Prolly even be able to turn the attention to the Dems and the obstructionist meme and of course to the nuclear option discussion in the Senate. Should keep the lapdog press busy for a long while. Still amazing the press buys it all. Only one problem. None of it will stop or change what Fitzy is going to do. This is jmo, of course.

The phone-jamming case from NH is due to implicate the RNC at any moment. Don’t you think there’s a decent chance there’ll be a case called NH v. GOP and Gillespie in the near future??
Also, a second hand impression from an unnamed source may not be a good reason to panic yet. It isn’t terribly good news, but it isn’t anything I would necessarily worry about yet.

Can Bush really refuse to accept a withdrawal of a resignation letter? I don’t think so. They could try to pressure her NOT to withdraw her resignation but they couldn’t prevent her from doing so. All she’d have to do is make it known to the Prez AND the Press and that would be it. She would agree to stay on until the end of the session and this whole googaw would end – and ALL attention would be on Traitorgate, Phonejamming, Delay, and Frist.
Separately, Randall Samborn, a spokesman for Special Counsel Patrick Fitzgerald, said there would be no announcements in the probe on Thursday
I suspect that we are going to be hearing a lot from Randall Samborn in the days ahead. Anyone know who he is?
Now I’m no pundit, nor the son of a pundit, but if one looks at Pat Fitzgerald’s list of accomplishments (at least in Illinois), he demonstrates a marked ability to “follow the money.” If this were just about outing a covered agent, and the obstruction of justice that clearly ensued–not that these are insignificant offenses, especially to those whose ability to serve honorably in that capacity depends on secrecy–but if it were just about that web of crimes, I think we’d have wrapped it up, and moved on by now. I sense that there’s something more at stake here–either Rove has offered to turn state’s evidence with regard to massive electoral fraud, or Libby’s cabal is furiously dealing evidence of its influence-peddling. Fitzgerald has caught the scent of something that will bring down the Adminstration (hence the meeting with the judge after yesterday’s grand jury session). That’s just my two cents’ worth.
Bush is probably pissed – but he ducked a bullet with the withdrawal. He had put gooper senators in a can’t win situation. They could support Bush or support the snakehandlers- but not both.
The issue is the 06 elections. If Bush is faced with a dems congress- he’s dead. There would be a constant stream of congressional investigations into his presidency. From a gooper point of view- that’s death.
I predicted this Meirs scenario in a comment at MyDD last week.
If they nominate a wingnut, so much the better. We take it and ram it down their fucking throats. No quarter.
I doubt they will have the votes to break the filibuster. It will bust the GOP completely apart and lose them the moderates. There is not enough popular support for a wingbut.

I find the MSM coverage pretty hilarious. First, they knew they didn’t have anything to really talk about, so they wrote stories that said essentially nothing. And then, others started writing stories about the stories that say nothing.
Fitz better do something soon or the MSM…. Wait. That has already happened. Never mind.
Bush has prospered with an image of being tough and mean- ya don’t cross the pres and get away with it.
I suspect that the withdrawal does a lot to puncture that balloon. Goopers may gain the ability to speak.

It also will be interesting to see how Bush reconciles two conflicting aspects of his personality – slavish attention to Rovian strategy (picking a red meat conservative for the court) or peevishness at not getting his way (picking another crony just to piss off the righties who were so mean to poor Harriet).

As I mentioned previously I really appreciated your comment, previous threat, about Trent Lott.
There is a lot of good scholarship about the physiological changes the brain goes through once a person goes from being non literate to literate. These physiological changes require generations and are ongoing. U.S. citizens who had ancestors who were slaves are always affected by this, because slaves were not allowed, by law, to learn how to read. Frederick Douglass is the rarest of exceptions, he was a “playmate” for his master’s son and so sat in on the classes.
Post 1865 Jim Crow laws prevented African Americans from equal access to education. For example in the 1920’s, the State of Florida had four high schools that would accept non-whites. While the Civil Rights achievements of the 60’s were significant, it will take generations for African Americans to catch up in terms of SAT/ACT scores and that is what translates into “employability.” In the mean time they are at a much greater risk for substance abuse, unemployment, mental illness, and incarceration than other Americans whose ancestors became literate in earlier generations.

We could see Bush following Kerry’s suggestion of announcing victory in Iraq and beginning withdrawals. It has to be something that dramatic to manuever out of the tailspin.

Yes, the extreme right wing wants Bush to pick one of theirs and, yes, it should trigger the nuclear option–however, that does not assure that all will go the way the Right Wing wants it to. It may also not detract from attention to Traitorgate. It may actually help really turn the American people against the Rupubs. Don’t forget, their views are not the views of the majority. Miers’ withdrawal will be blamed not on non-support of religious right, but on requests for documents from Democratic Senators. Note her letter says she supports President’s disire for conservative, non-legislating judges. If she is willing to sign a letter ghost-written by Rove. maybe she wouldn’t have made such a good judge.

I agree, but I think it depends a lot on what the indictments are, how many, who etc. I remain hopeful that the scope of the damage will be such that it will be difficult for the second string to bring as much venom to the fore. DeLay and Frist aren’t helping things, along with the rest. I know the freepers see it differently, but indictments are different from suspicion.
