New LA Times article out that says Fitzgerald is still questioning people, this time Rove associates about contact he had with reporters in the days leading up to his outing of Valerie Plame. We can only imagine he is cross-checking Rove’s recent four-hour testimony, thus giving Unka Karl a case of prickly heat. Sounds like his command performance did not impress Mr. Fitzgerald with its bravura.
Fitzgerald has also got FBI agents combing the Wilson’s neighborhood, asking neighbors whether they were aware Mrs. Wilson worked for the CIA before she was outed by Robert Novak. Again, it sounds like an attempt to head off a defense that claims “no foul” because her place of employment was common knowledge, and something that is going to be a lot easier to establish now than after the whole thing turns into a bigger media circus than it already is.
It’s an impressive attention to detail. And then there’s this delightful stocking stuffer:
Some of the questioning indicated that Fitzgerald may still be considering indictments on charges that some have viewed as too difficult to pursue, including a prosecution under a federal law that makes it a felony to reveal the name of a covert agent.(snip)
But neighbors contacted by The Times said they told the FBI agents that they had no idea of her agency life, and that they knew her only as a mother of twins who worked as an energy consultant.
Critics of the leak investigation have argued that it was an open secret that Plame worked for the CIA; if many people knew that she worked for the agency, it would make prosecution under the 1982 law protecting covert agents impossible. (my emphasis)
Oh please, let it be true. If only to send Victoria Toensing into inchoate rage.
Some people familiar with national security investigations said they found this week’s questioning to be curious at a time when Fitzgerald appeared to be wrapping up his investigation. They said establishing her covert status should have been a priority at the outset of the case; if her employer was already well known, the prosecutor would not have a case to bring under the agent-protection law.
Or maybe the claim is just so specious and absurd nobody bothered to try and disprove it until someone raised it like it actually made sense.

Update: Jeralyn says the Raw Story post about Fitzgerald having been seen at the offices of Rove’s attorney today means that he was probably interviewing the “cooperative Rove” once again.

This thread may be dead – but I will opine nonetheless.
It just occurred to me that one reason Fitzgerald may have gone back to question the Wilson neighbors was to make certain that no one had “gotten” to any of them. Not sure what that would be, but I wouldn’t be surprised if it was attempted by this cabal.
Now, if it’s occurred to me then it must have occurred to all of you way before – so does anyone here have any thoughts?
And thank you again for all the brilliant work here. IÂ’ve included the internet address for firedoglake in all my emails. (I hope that is okay.)
Today is a dangerous day. It’s the last time that all the perps are in office without the public odium of an indictment hanging over them. If W wants to go the cowboy route of issuing blanket pre-pardons and having a mob of spontaneously enraged citizens attack the SP’s office, this might be his best chance.
So perhaps it’s a good time to pause and praise our bloggers for their amazing stamina, generosity in sharing their expertise and prose that is a joy to read. And since I have posted next to nothing here, perhaps I am an appropriate person to point out out that they have gotten the commenters they deserve.
Maybe Fitz took a video of the movie American Me to show Karl what life is prison would be like for him.

It’s so damn logical and well informed that I just hate it. Here’s a sample:

Read the rest. It appears Fitz is hard after the VPs office and cutting a deal with Rove makes sense for both parties, Fitzgerald makes his case and Rove protects the President and his own fat ass.

The Fitzgerald indictments are coming at the exact same time that the country marks the 2000th death in the war and the Italian government is starting to publicly investigate the origins and handling of the forged Niger documents.
Hold on tight, this story has legs (and I don’t just mean the powerful symbol that Valerie Plame herself represents)..

I remember that storyline which when added to the possibility that an Agent died as a result of the outing has led me to the belief, regardless of how unbelievable if sounds that, if Fitz is as good as he sounds, he may be following the trail to very high crimes, which may lead to TREASON.
Our friend Me has implied as much when he speaks of death penalty indictments…. (none of the other possibilities lead to that option)

Me, if you’re in the know, however tangentially, and not just speculating, about Rove (and presumably others) being legally on the line for someone’s death, and about Fitz having his prosecutor’s sites on Bush, then this case and its fallout are going to be far bigger than anyone anticipates.

I’ve heard a lot of speculation tonight about the story that Fitzgerald has been talking to Rove’s attorney and has sent FBI agents to interview neighbors of the Wilsons today. As I’ve pored over the blogs tonight an aspect of the Plame story which I heard some time ago came to mind. I first heard of this angle earlier in the year on Randi Rhodes radio show on Air America. I found it hard to follow on the radio and made a mental note to look into it further but never got around to it. Well tonight I did some digging and found this (scroll down, it’s near the bottom of the page):
U.S. intelligence insiders have pointed out that the White House is using “Rovegate” and “Who in the White House said what to whom?” as a smoke screen to divert attention away from the actual counter-proliferation work Mrs. Wilson and her Brewster Jennings & Associates team were engaged in. The arrival of Timothy Flanigan as Patrick J. Fitzgerald’s boss is likely related to the mountains of evidence Fitzgerald has now collected to indict senior White House officials, particularly, Lewis “Scooter” Libby, for criminal conspiracy in exposing a sensitive U.S. intelligence operation that was targeting some of their closest political and business associates. Libby, it will be recalled, was the attorney for fugitive global smuggler and Clinton-pardoned multi-billionaire Marc Rich, someone who has close ties to the Sharon government and Israeli intelligence. It is no coincidence that FBI translator-turned-whistleblower Sibel Edmonds uncovered nuclear material and narcotics trafficking involving Turkish intermediaries with ties to Israel at the same time Brewster Jennings and the CIA’s Counter Proliferation Division was hot on the trail of nuclear proliferators tied to the Israeli government of Ariel Sharon and the A. Q. Khan network of Pakistan.
Feith and Libby: Ultimate targets of CIA counter-proliferation team?
Time magazine reported on July 31 that White House knew about Plame’s identity long before Joseph Wilson’s July 6, 2003 OP ED in the New York Times. Feith and Libby had reasons to be worried about Plame and her team’s counter-proliferation work.
An arrest in early 2004 points to the links between Israeli agents and Islamist groups bent on producing weapons of mass destruction, including nuclear weapons. According to intelligence sources, this was a network that was a major focus of Edmonds’ and Valerie Plame Wilson’s work. In January 2004, FBI and U.S. Customs agents arrested Asher Karni, a Hungarian-born Orthodox Jew, Israeli citizen, and resident of Cape Town, South Africa, at Denver International Airport for illegally exporting 200 electrically triggered spark gaps — devices that send synchronized electrical pulses and are used in nuclear weapons…
So now we have Libby, Rove and Cheney, implicated in a plot to burn a CIA anti-proliferation network working to collect evidence and follow the money in an arms sales ring that had ties to the Bush administration. It is important to note that the leak to Novak that outed Ms. Wilson was only part of the Novack story. I don’t see too many people discussing the followup story that Novak wrote a week later that outed Ms. Wilson’s cover operation, Brewster Jennings and burned her whole undercover network.
Now this story is almost as hard to follow in print as it was on the radio, but if the evidence is leading Fitzgerald to consider this as one of the motives for the outing of Ms. Wilson and Brewster Jennings this could turn out to be bigger than any of us may have imagined. Add to this the possibility of Fitgerald looking into whether the Bush administration lied to congress in the run-up to the war and we may be in for a real shitstorm if he’s able to connect all the dots.

argument, but I wonder if it wasn’t kind of a sting operation. I mean, if you read Wilson’s original editorial, you could construe it that he was looking for a fight. Then , when the WH overreacted as expected, the spooks were ready for ‘em.
First there are indictments and then, later on, there can be more indictments. The investigators are in the “later on” stage.
Remember, indictments generate plea bargains which generates information which generates indictments. And one always starts with little fish and work upward.

Sorry, but I just don’t buy the FBI doing some last-minute checking of Wilson’s neighbors for Fitzgerald. From what we know of this man, to do this at the zenith hour is way out of character. I think it’s a lot more likely that these so-called FBI agents are really Rove/Libby, Cheney (take your pick) hirelings directed to unearth anyone, anything, anywhere to say “OF COURSE I knew that Wilson woman was an undercover CIA agent. ” Sounds just like them, but doesn’t sound at all like Fitz.

The underlining issue is decision making and how could it get so screwed up.
One of the really intersting things about GW is that though he can mislead, he is incapabie of the “direct statement” lie. That is inate in his personality. That is why he rarely speaks ‘free-form’. (The stats on how often that happens are skewed by the notion of ’stats’ because we know virtually everytime it happens because of what is said.)
Cheney is being thown overboard. To protect what? Not Libby. His job was to protect the VEEP. Well, not really… it is to protect the neocon philosophy.
Not that I give a freep about the VEEP. That stuff was about the energy comission task force. Big shock when the USG moved their peak predictions down, Whoa… better get moving on a plan. GW recently said (last 14 days) it would an issue if Al Qaeuda(TM) got their hands on the oil fields.

The Espionage Act appears to prohibit, and make criminal, not only the intentional disclosure of classified information, but also being grossly negligent in handling classified information. Further, it appears that at least some people given security clearance have to sign a statement showing that they understand that they are required to handle classified information with all due care (see the Larry Franklin indictment.) Therefore, it shouldn’t matter if you don’t know the status of an agent, you probably have a duty to find out before you disclose her identity or you risk breaking the law. I also question whether it would be a defense to say that some people already knew the information, although it might be a mitigating factor in detemining the seriousness of the offense.

This is a lie: Rover has a 16 year old son Andrew who has been doing some multiple count drug dealing to a DEA agent. They closed in on the son a few weeks ago… Remember Rove vanished for awhile in the thick of things, and the WH said he was with his son visiting colleges? Uh-uh.
And no, Rove won’t get off at this late date… It is unlikely he would have gotten off he had spilled the beans from the very start… But I think the family pressure, plus the threat of a death penalty charge has finally cracked him.
Then there are the financials… The charges are going to be tightly woven around his neck, and he could $250,000 just delaying the legal process without much hope of overturning a conviction.
Fitz fucked him good. He can turn some evidence against the other conspirators to tighten the case, but my understanding was he has to give up the preznit.

Yes I think Rover never had a chance. And I think the idea of fighting a death penalty charge from inside a gray barred jail cell eating green balonga twice a day has gone a long way towards rearranging his priorities. Word is also there are some problems at home which further complicate his position.
Me, that’s a good angle. It explains how Fitz knew that Tenet spoke with Dr. No about Wilson/Plame. It doesn’t make sense that Libby handed over his notes about his conversation with Dr. No as part of a deal just to save his own skin. Several people in the Company would have known that Tenet conveyed the info to Dr. No, and they probably wanted to get even for having to take the fall for the WH intel fuck-ups. I’ll sleep better knowing there are still some spooks out there with a cold eye on the cowboys.

The LATimes piece has a nice casual mention at the end about Italy’s involvement in the Niger docs and call it a “related controversy”:
“Italian parliamentary officials announced Tuesday that the head of Italy’s military secret service, the SISMI intelligence agency, would be questioned next month over allegations that his agency gave the disputed documents to the United States and Britain, according to an Associated Press report. A spokeswoman said Nicolo Pollari, the agency director, asked to be questioned after reports this week in Italy’s La Republica newspaper claiming that SISMI sent the CIA and U.S. and British officials information that it knew to be forged.
The newspaper reported that Pollari met at the White House on Sept. 9, 2002 with then-Deputy National Security Advisor Stephen Hadley. The Niger claims surfaced shortly thereafter. A spokesman for Hadley, now the national security advisor, confirmed that the meeting took place, but declined to say what was discussed.”

I’m having some doubts about whether Fitz has got Rove too. It seems that if he did, he’d have had the case pretty well sewn up by last week.

See there were TWO investigations of this matter in the WH… The FBI investigation which everybody in the WH was aware of… And a secret CIA investigation that nobody will talk about because it never happened.
See the CIA is not supposed to spy domestically… But at the same time they were not going to let the WH get away scot free… Sooo, they picked up an evidence trail that ended with a high crime, and presented it to the Dept. of Justice to be developed.
That’s how Fitz knew who said what when where how and why… He has been getting spook help since day one.

It means he is closing the back door on the defense claims. Prior to making the formal charges, his office had no reason to believe that anyone other than the leakers were aware of her covert status. Then the wags start saying “Oh everybody knew” after the fact.
So Fitz sends out the bloodhounds to disprove their malicious gossip. And seriously, if the defense comes back and says “so and so knew this and it was common knowledge” Fitz can say “Oh yeah, where did they get that info because whoever told so and so, commited a federal crime and I would very much like to speak with them ;)
Maybe it is Fitzgerald’s last effort to put pressure on Rove

The fact the Fitz had investigators out on foot is very good news. It means he is dotting his “i”’s and crossing the “t”’s to make sure the charges are bulletproof once presented.

But when history looks back at this sad affair, the most telling and damning evidence against each of these conspirators, indicted and unindicted, will be the efforts taken to deny that anything out of the ordinary was going on at all.The most tawdry aspect of this episode is that what happened to Wilson and to Plame was business as usual

Well, if you believe Raw Story’s scoop on Wurmser (not sure I do), then Fitz just heard a story listing all the journalists who, reinforcing what JimmyJeff and Cliff May said in 2003, claimed they knew Plame’s identity significantly before she was outed.
He has the positive story now (who was told). Now he has to double check the negative story–re-prove that no one BUT the people who heard from Wurmser knew of Plame’s identity.

Tucker Bowtie just had one of the neighbors on … quite a fellow, his houseboy (sic) refused to answer questions when 2 FBI agents showed up unexpectedly … he told them he had no idea Valerie was CIA, his interview with them was a bit rushed since he was getting ready for a “black tie event” but he assured Tucker that no one in the neighborhood had any idea – he said he still has trouble believing it when he sees Valerie out in the yard playing with the kids.
Well, what do you know? It worked! Hey, where is everybody?
